    Federal judge issues stay for 3 upcoming Ohio executions

    A federal judge has issued a stay in the January execution of an Ohio death row inmate and the next two inmates scheduled to die in 2017.

    The move announced Monday comes amid a challenge of a state law that shields details about the lethal injection drugs the state plans to use.

    The order says the stay could be lifted if a federal appeals court hands down a ruling in the related challenge before the scheduled execution of Ronald Phillips on Jan. 12.

    A spokesman for Ohio Attorney General Mike DeWine says the office is deciding whether or not to appeal it.

    Ohio announced in the fall it plans to resume executions for the first time in nearly three years by using a new three-drug combination of lethal chemicals.

    U.S. judge halts scheduled executions in Ohio

    A federal judge on Monday ordered a stay of three scheduled executions in Ohio pending the resolution of a lawsuit brought by dozens of death row inmates that challenges the state's secrecy around where it procures execution drugs.

    State killings in Ohio were set to resume in January 2017 after a three-year pause due to prison officials facing difficulties obtaining the drugs needed to perform lethal injections.

    U.S. Magistrate Judge Michael Merz issued the 20-page ruling on Monday, staying the upcoming executions of inmates Ronald Phillips, Raymond Tibbetts, and Gary Otte.

    Merz wrote his order would be vacated once a ruling was made by the Sixth U.S. Circuit Court of Appeals in a separate case brought by more than 60 inmates that argues Ohio keeping secret the source of the execution drugs it aims to use is unconstitutional.

    In that case, titled Fears v Kasich, a judge entered a protective order effectively blocking the inmates from discovering where Ohio obtained its execution drugs amid a shortage of lethal injection drugs from large pharmaceutical companies.

    "Absent a stay, Phillips, Tibbetts, and Otte will be executed without being able to obtain the information which may be useful to them and may be permitted by the impending decision in Fears v. Kasich. That constitutes irreparable harm," Merz wrote in the order.

    Dan Tierney, a spokesman for Ohio's Attorney General, said by phone, "We are currently reviewing that ruling from Magistrate Merz to determine whether or not we'll appeal."

    In January 2014, Ohio became the first state to use a combination of the sedative midazolam and painkiller hydromorphone when it executed Dennis McGuire for the 1993 rape and murder of a pregnant woman.

    COLUMBUS, Ohio (AP) — A condemned Ohio killer who shot two people to death in back-to-back robberies over two days is asking the state parole board to spare his life.

    Gary Otte (OH'-tay) was sentenced to die for the Feb. 12, 1992, killing of Robert Wasikowski (wah-sih-KOW-skee) and the Feb. 13, 1992, killing of Sharon Kostura. Both killings took place in Parma in suburban Cleveland.

    Otte's attorneys argue that drug addiction, intoxication and depression led to both slayings. They also say he received poor legal help at his trial.

    The Cuyahoga (ky-uh-HOH'-guh) County Prosecutor's Office says the 45-year-old Otte still won't take full responsibility and tries to blame others, including the victims.

    A hearing before the parole board was underway Thursday. Otte's execution is set for March 15.

    On February 21, 2017, oral argument will be heard in the State of Ohio's appeal before the Sixth Circuit regarding the constitutionality of Ohio's lethal-injection protocol. The panel will be made up of Judges Moore (Clinton), Kethledge (G.W. Bush) and Stranch (Obama).

    No it doesn't. Montgomery has or will be rescheduled.
