    Gary Otte v. Mark Houk

Federal appeals court upholds 1992 death sentence for condemned Ohio killer of 2

CINCINNATI — A federal appeals court has upheld the death sentence of an Ohio man condemned to die for fatally shooting two people in a 1992 robbery spree.

Friday's decision by the 6th U.S. Circuit Court of Appeals was the latest setback for Gary Otte, who has lost several previous appeals of his death sentence.

A three-judge panel sentenced the 39-year-old Otte to die for killing Robert Wasikowski in an apartment in Parma in suburban Cleveland on Feb. 12, 1992, and for killing Sharon Kostura in the same apartment complex the next day.

The 6th Circuit's 2-1 decision rejected Otte's arguments that he improperly waived his right to a jury trial, that he received poor legal representation and that his confession should have been suppressed.

Execution Date for a Murder That Happened in Parma

Columbus — The Ohio Supreme Court has set an execution date for a man condemned to die for fatally shooting two people in a 1992 robbery spree.

A three-judge panel sentenced Gary Otte to die for killing Robert Wasikowski in an apartment in Parma on Feb. 12, 1992, and for killing Sharon Kostura in the same apartment complex the next day.

The high court on Wednesday set a March 15, 2017, execution date for the 43-year-old Otte, who has lost previous appeals of his death sentence.

The decision makes Otte the 24th inmate on death row with an execution date. The prison system is scheduled to resume executions in January but hasn't been able to obtain new supplies of lethal injection drugs.

I don't know why. All I know is that the Ohio Supreme Court has left some months open in 2017 even though they've already set dates for 2018 and 2019. The Ohio Supreme Court's policy (or lack thereof) for setting execution dates has utterly mystified me over the past few years.
