    Summary of Offense:

    On January 18, 1993, Phillips murdered his girlfriend's daughter, three-year-old Sheila Marie Evans, at her home in Akron. Phillips had been sexually and physically abusing Sheila for some time. Phillips severely beat Sheila in the head, face and abdomen, threw her against the walls, dragged her by her hair and anally raped her. Phillips confessed to police.

    On June 1, 2010, Phillips was denied a Certificate of Appealability by the US Court of Appeals for the Sixth Circuit with one judge dissenting.

    In today's United States Supreme Court orders, Phillips' petition for a writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    Akron killer to be first executed under new Ohio death penalty plan

    Ohio plans to come up with a new process for executing condemned inmates no later than Oct. 4 as the supply of its current drug is ready to expire, according to a court filing.

    The new process, which is not spelled out in the filing, will apply to the November execution of Ronald Phillips, sentenced to die for raping and killing his girlfriend’s 3-year-old daughter in Akron in 1993, according to the order filed Monday by federal judge Gregory Frost.

    Frost’s order, reviewed by the Associated Press, notes that the process won’t be in place for next month’s execution of Harry Mitts. The Department of Rehabilitation and Correction raised the Oct. 4 date in a recent telephone conference with the judge, according to the order.

    The state did not immediately respond to a request for comment, but said a statement was forthcoming.

    The change in the execution process is necessary because supplies of the sedative pentobarbital, the drug Ohio uses for executions, have been put off limits by its manufacturer, and the state’s remaining supplies expire at the end of September.

    One option floated by Ohio authorities is obtaining the drug from compounding pharmacies, which are licensed to create small batches of drugs for specific clients.

    This would be the third time the state has changed its protocol because of difficulty finding an execution drug. Manufacturers also restricted distribution of sodium thiopental, the drug used before pentobarbital.

    A condemned Ohio killer facing execution next month for raping and killing a 3-year-old girl wants to challenge the state's new lethal injection drug policy.

    Lawyers for death row inmate Ronald Phillips say the state's plan to switch to a non-FDA-regulated dose of pentobarbital raises the possibility that Phillips and other condemned inmates could suffer tremendous pain

    The lawyers also said in court filings late Friday the state has watered down its execution procedures by giving individuals designated by the prisons director authority for execution decisions instead of the director himself.

    The filings also ask a federal judge permission to include whatever specialty pharmacy is chosen to make the new dose of pentobarbital in the lawsuit.

    The state has until Wednesday to respond.

    Ohio Supreme Court schedules 2013, 2014 executions for 2 condemned killers

    The Ohio Supreme Court has set execution dates for an Akron man who raped and killed a 3-year-old girl and for a southwest Ohio man who raped and killed a pregnant woman.

    The court on Friday set one of the executions for late 2013 and the other for the beginning of 2014.

    The first new execution on the calendar is for Ronald Phillips, who was convicted in the killing of his girlfriend's 3-year-old daughter back in 1993. He's now set to be put to death on Nov. 14, 2013.

    The court also says Dennis McGuire of Preble County is now scheduled to be executed on Jan. 16, 2014. McGuire was sent to death row for the 1989 rape and stabbing death of a woman who was pregnant.

    Akron girl’s killer wants his organs donated after execution

    COLUMBUS: An Ohio child killer scheduled for execution in three days has asked that his organs be donated to help his mother and sister.

    Lawyers for death row inmate Ronald Phillips say in a letter to the Ohio prisons agency that Phillips would also be willing to donate the organs to other individuals.

    The letter obtained Monday by the Associated Press says Phillips, of Akron, wants as many people as possible to benefit from his death.

    A message was left with the Department of Rehabilitation and Correction seeking comment.

    The 40-year-old Phillips faces execution Thursday by a never-tried two-drug combination of a sedative and painkiller.

    He was sentenced to die for raping and killing his girlfriend’s daughter, 3-year-old Sheila Marie Evans, in Akron in 1993.

    “Ron is making this generous request without any conditions or expectations,” according to the letter.

    “He is nonetheless willing to do whatever is necessary to enable as many people as possible to benefit from his death,” the letter continued.

    Phillips’ request is not a delay tactic, public defender Lisa Lagos said Monday.

    “Ron just wants to be able to do a charitable act and help bring any closure to the victim’s family that he can,” she said in an interview.

    His mother has kidney disease and is on dialysis and his sister has a heart condition, the letter said.

    Phillips’ request for mercy was denied last week by Ohio Gov. John Kasich. Phillips has dropped all his appeals, Lagos said.

    Phillips, 40, is scheduled to die Wednesday by an untried injection of a sedative and painkiller that has never been used in a U.S. execution.

    Attorneys for Phillips note that Ohio has stopped using two drugs that damaged an inmate’s organs — one a paralyzing agent, the other a drug that stops the heart.

    On Wednesday, Ohio plans to use midazolam, a sedative, and hydromorphone, a painkiller. It was not immediately clear Monday what effect those might have on organs.
