    Summary of Offense:

    On November 24, 1991, Wogenstahl murdered 10-year-old Amber Garrett of Harrison, Ohio. Amber was the daughter of Wogenstahl's friend. Wogenstahl kidnapped Amber as she slept in her bed, stabbed her 11 times in the chest and neck, beat her with a car jack handle and then dumped her body in a heavily wooded area in West Harrison, Indiana. Wogenstahl admitted to a fellow inmate that he had kidnapped Amber to rape her. DNA testing, conducted during federal appeals in 2001, identified Amber as the source of blood in Wogenstahl's car.

    Honoring Memory of Girl Abducted and Killed

    There are some things that happen in our lives that stay with us forever. Some are good memories. some are painful. For the city of Harrison, what happened 20 years ago shook the city until its heart was broken.

    A ten year old girl was walked from her own bed into the night, raped and murdered. An acquaintance of Amber's mother is on death row. Local 12's Deborah Dixon tells us how people are turning the pain into something positive.

    Karlei Bouffard is learning about personal space. Instructor Scott Wegman tells her she has permission to say no to an adult when she's uncomfortable and to get physical. Karlei is Amber Garrett's cousin. Amber was 10 years old when she was killed by Jeffrey Wogenstahl, an acquaintance of her mother.

    Money from this weekend's Amberfest in Harrison will pay for self defense classes for children. There is alot of thought about what could have been as Amber's family sets up the festival, with rides, games barbecue burgers and five bands. April Garrett says she and Amber were more like sisters than cousins. "It doesn't get any easier. That's why I wanted to do something for her since she's not here."

    The people of Harrison didn't let Jeffrey Wogenstahl get away with murder. Someone saw him drive through town with a little girl that night, and when her body was found in Bright, Indiana, someone else recalled his car was there too. "Its something that stays with you forever when something that dramatic that traumatic situation."

    Harrison's Mayor has declared Sunday, October 2nd as Amber Garrett day-the day that would have been Amber's 30th birthday.

    Apparently, Wogenstahl's awaiting a decision by the US Court of Appeals for the Sixth Circuit on his appeal over the denial of his habeas petition in Federal District Court.

    Court upholds death penalty despite errors

    Convicted child killer Jeffrey Wogenstahl will stay on Ohio’s Death Row even though Hamilton County prosecutors made mistakes and improper comments during his trial, a federal appeals court ruled Thursday.

    The U.S. 6th Circuit Court of Appeals in Cincinnati found numerous problems with the prosecution’s conduct during Wogenstahl’s 1995 trial, particularly with comments Prosecutor Joe Deters made to the jury about Wogenstahl and his possible motives.

    But the three judges said the evidence that Wogenstahl abducted, beat and stabbed to death 10-year-old Amber Garrett in 1991 is so overwhelming that the prosecutors’ actions did not change the outcome of the trial.

    “We conclude that, though these comments were likely improper, they were harmless,” wrote Judge Julia Smith Gibbons, who was joined in the decision by Judge David McKeague.

    Another judge, Karen Nelson Moore, agreed with the decision but wrote a separate opinion that blasted the prosecution’s conduct. She said prosecutors withheld evidence, denigrated defense lawyers, improperly inflamed the jury and may have allowed false testimony into the trial.

    “The prosecutorial misconduct here was plain and plentiful,” Moore wrote.

    Deters took issue with the criticism and has said the attacks on his conduct are desperate attempts by a guilty man to avoid a death sentence. He said he hoped the ruling Thursday would bring the long appeals process closer to an end.

    “We have a 10-year-old girl who was kidnapped and murdered,” Deters said. “I just hope she gets justice some day.”

    Defense attorneys could not be reached Thursday. The case still may be appealed to the U.S. Supreme Court.

    Prosecutors said Wogenstahl went to Amber’s home in Harrison on the night of the murder and tricked her half-brother, who was babysitting, into leaving. They said he then abducted her and stabbed her to death.

    Wogenstahl claims he is innocent. He said prosecutors failed to disclose some evidence, including a previous drug arrest involving Amber’s half-brother, and accused them of repeatedly making inflammatory comments to the jury.

    But Deters and the appellate judges say the evidence against him is strong. Deters said that evidence now includes a DNA test requested by Wogenstahl years after his trial, which found that a speck of blood in his car matched Amber’s DNA.

    So will he get a date scheduled soon in OH? I'd assume they'd put him on the calendar for sometime in 2014.

    More than likely he will appeal to a full panel before the 6th Circuit, and he can still appeal to the US Supreme Court.

    High court sets execution date for Ohio killer

    The Ohio Supreme Court has set an execution date for a condemned killer who stabbed a 10-year-old girl.

    Jeffrey Wogenstahl was convicted in Hamilton County of kidnapping the girl from her home, taking her to a secluded area and stabbing her to death in 1991.

    The Supreme Court on Friday set a May 14, 2015, execution date for Wogenstahl.

    Justice William O'Neill dissented, saying the death penalty is "inherently both cruel and unusual" and is unconstitutional. The Democrat said it was time for Ohio to end what he called an outdated form of punishment.

    O'Neill's comments were unusual for what is usually a routine matter. Even Justice Paul Pfeifer, now a death penalty opponent who wants Ohio's law overturned, voted in favor of the date and sometimes upholds death sentences.

    This judge should be romoved by the voters and if not possible impeached for derelict of duty.
