    Ernest Donald Suggs - Florida Death Row




    Summary of Offense:

    Ernest Suggs was convicted and sentenced to death for the murder of Pauline Casey. Pauline Casey worked at the Teddy Bear Bar in Walton County. On August 6, 1990, the bar was found unlocked and cash was missing. Furthermore, Casey’s purse, keys, and car were found at the bar, but the victim was not. Ray Hamilton, a neighbor of Casey’s, reported to police that Casey and a customer, who he did not recognize, were playing pool when he left. The police were put on alert looking for the man and the man’s car that matched Hamilton’s description.

    Ernest Suggs was pulled over based on the description of the car. Suggs permitted police to search his home and car. They found $170 in small bills, hand and fingerprints belonging to Casey in Suggs’ car, and blood that matched the victim’s blood on a shirt belonging to Suggs. In the bay behind Suggs’ residence, the police also found a key to the bar and a beer mug similar to the beer mugs at the Teddy Bear Bar. The police matched Suggs’ tire tracks from his automobile to tracks found on a local dirt road. In a search of this area, police found Casey’s body a short distance from the road on which the tire tracks were found. She was stabbed twice in the neck and once in the back. Suggs was arrested after the discovery of Casey’s body. Ernest Suggs asserted that he had been framed for the murder of Casey.

    Suggs was sentenced to death in Walton County on July 15, 1992.

    Suggs was denied a Certificate of Appealability by the US Eleventh Circuit Court of Appeals on June 24, 2010.

    In today's United States Supreme Court orders, Suggs' petition for a writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    Florida Supreme Court rejects 10 Death Row appeals, including in Duval and Clay

    The Florida Supreme Court on Monday rejected appeals by 10 Death Row inmates, including three in Duval County and one in Clay County.

    The Supreme Court’s release of 10 nearly identical rulings at the same time was a somewhat-unusual move. But each of the cases involved inmates challenging their death sentences because juries did not unanimously recommend execution.

    The appeals were rooted in a 2016 U.S. Supreme Court ruling in a case known as Hurst v. Florida and a subsequent Florida Supreme Court decision. The 2016 ruling found Florida’s death-penalty sentencing system was unconstitutional because it gave too much authority to judges, instead of juries. The subsequent Florida Supreme Court ruling said juries must unanimously agree on critical findings before judges can impose death sentences and must unanimously recommend the death penalty.

    But the Florida Supreme Court made the new sentencing requirements apply to cases since 2002. That is when the U.S. Supreme Court issued a ruling known as Ring v. Arizona that was a premise for striking down Florida’s death-penalty sentencing system in 2016.

    In each of the cases Monday, the Death Row inmates had been sentenced to death before the Ring decision and argued that the jury-unanimity requirements should also apply to their cases.

    The Jacksonville cases were Marvin Burnett Jones, Pressley Bernard Alston and Jason Demetrius Stephens. In Clay County, Donald Bradley’s appeal was denied.

    The others were Eric Scott Branch in Escambia County, Kayle Barrington Bates in Bay County, Daniel Jon Peterka in Okaloosa County, Harry Franklin Phillips in Miami-Dade County, Ernest D. Suggs in Walton County and Frank A. Walls in Okaloosa County.

    CUSTODY STATUS: Recaptured Parole Violator
    LOCATION: Florida
    This man was convicted of 1st degree murder in 1979 in Alabama with a life sentence consecutive to a 15 year sentence for attempted murder. Alabama saw fit to release him on parole. He violated his parole by leaving the state, and committing the murder in Florida in 1990, putting him on death row. Alabama has responsibility for any lives he ruined by turning him loose. It cannot happen now after sentencing changes enacted. Small comfort to his victims families.
