    Facts of the Crime:

    Received two death sentences in 2000 for the 1979 robberies, rapes and murders of Betty Sue McConnell and Harriett Delaney Simmons. The case went unsolved until a man walked into the sheriff's office in 1998 and admitted helping Hyatt abduct one of the women. Hyatt is white, as were his victims. He was the last person sentenced to death in Buncombe County.

    Hyatt was denied a Certificate of Appealabilty by the US Court of Appeals for the Fourth Circuit on June 23, 2009.

    Appeals court upholds NC death row case

    A federal appeals court has upheld a North Carolina death row inmate's conviction and sentence.

    Terry Alvin Hyatt was sentenced to death for the 1979 robberies, rapes and murders of 2 women in Buncombe County. The victims, 21-year-old Betty Sue McConnell and 40-year-old Harriet Delaney Simmons, were stabbed to death.

    The case went unsolved until a man walked into the sheriff's office in 1998 and admitted helping Hyatt abduct McConnell. The man provided information that ultimately linked Hyatt to the Simmons slaying as well.

    A 3-judge panel of the 4th U.S. Circuit Court of Appeals on Tuesday rejected Hyatt's claims that he was improperly questioned before he had a lawyer and that he should have been allowed to fire his court-appointed attorneys.

    On March 29, 2010, the US Supreme Court denied Hyatt's certiorari petition.

    This means Federal Appeals are DONE and when North Carolina resumes executions Hyatt could receive an execution date.
