    Rodney Lyn Emil - Nevada Death Row




    Facts of the Crime:

    On June 18, 1984, Rodney Emil's stepfather, Charles Howard Emil, 46, was found shot to death in a pickup truck parked in Las Vegas. He had killed his stepfather to collect on his life insurance policy.

    Emil was sentenced to death in 1988.

    Court rejects death row inmate’s appeal

    CARSON CITY – The Nevada Supreme Court says death row inmate Rodney Emil waited too long to file his instant appeal.

    The court said Emil failed to show a “fundamental miscarriage of justice” in his conviction and death penalty. He was sentenced to death in 1988 for the killing of his stepfather, Charles Howard Emil, in Las Vegas.

    Emil, now 49, had two prior unsuccessful appeals to the Supreme Court, the latest one more than six years ago. “Thus, the instant petition is untimely,” the court said.

    Emil reportedly killed his stepfather for his mother and for half of the life insurance policy.

    He is also serving a life term without the possibility of parole for the fatal shooting of Ross Tolley in 1983, also in Las Vegas.

    On January 11, 2011, habeas corpus proceedings were re-opened in Emil's case in Federal District Court.

    I went to middle School with this guy. Cashman Jr. High. I didn't know him well. But when I met he seemed a little off. We smoked some weed and that's what I knew of him.

    On June 17, 2016, oral argument will be heard in Emil's appeal before the US Court of Appeals for the Ninth Circuit.

    Nevada Supreme Court rejects appeal of death row inmate

    CARSON CITY — The Nevada Supreme Court has rejected the appeal of death row inmate Rodney Emil, convicted in the killing of his stepfather in 1984 in Las Vegas to collect on an insurance policy, according to court documents.

    The court rejected the fourth petition of Emil, 55, who maintained his attorney was ineffective and he is innocent of the murder of Charles Howard Emile, 46, who was shot four times in the desert outside of Las Vegas, according to the court documents.

    Emil is also serving a life term without parole for killing Ross Tolley in 1983 in Las Vegas.

    Court rejects death row inmate’s 28th appeal

    CARSON CITY — Rodney Emil, who has been on death row since 1988 for a Las Vegas killing, has lost his 28th appeal to overturn his conviction.

    The 9th U.S. Circuit Court of Appeals on Friday turned down a petition for a writ of habeas corpus. Emil maintains prosecutors failed to file the correct charges against him, according to court documents.

    Emil, now 55, was convicted in 1988 of killing his stepfather, Charles Howard, who was shot four times, according to documents.

    He is also serving two life sentences without the possibility of parole in the slaying of Ross Tolley in 1983 in Las Vegas, according to court records.
