Court rejects appeal of man who killed girlfriend and her son

CARSON CITY — The Nevada Supreme Court has rejected the latest appeal of Timmy J. Weber, sentenced to death for the slaying of his girlfriend and her 15-year-old son in Las Vegas in 2002.

The court rejected claims that Weber’s defense lawyer was ineffective for not investigating and presenting mitigating evidence that Weber suffered from brain damage.

Weber’s claim that the prosecuting attorney made improper remarks during his opening statement to the jury was also turned away by the Supreme Court.

Weber’s girlfriend, Kim Gautier, 38, died after being hit on the head, possibly with a baseball bat, and then being strangled. Her body was found in a plastic container inside her closet.

Her son Anthony Gautier was tortured before he died. A shirt was shoved into the boy’s mouth, duct tape wrapped around his face and head and a plastic bag placed over his head and tied with speaker wire.

There was testimony at the trial that Weber had sexually abused Gautier’s 14-year-old daughter since she was 9 years old.

Ten days after the murders, Weber attempted to kill Gautier’s 17-year-old son, Chris, and William Froman, the temporary guardian of the boy and girl.

Weber, now 37, was an eight-time convicted felon at the time of the slayings. He was sentenced to death for the torture killing of Anthony Gautier and to a life term for the murder of Kim Gautier.

The Supreme Court had previously upheld his conviction and penalty in 2005.

Man on death row for two Las Vegas murders dies at hospital

    KSNV Las Veags

A man on death row for committing two murders in Las Vegas two decades ago has died, according to a prison spokesperson.

Timmy "TJ" Weber, 48, was pronounced dead at Sunrise Hospital on Wednesday, May 18.

Weber was serving a death sentence in Ely State Prison following his conviction on two counts of first-degree murder, attempted murder and sexual assault, among other charges.

The cause of death was not listed. The Nevada Department of Corrections says an autopsy has been requested.

Weber was convicted for the 2002 murders of Kim Gautier, 38, and her 15-year-old son, Anthony. He also was convicted of sexually assaulting Gautier's daughter and ambushing her other son with a baseball bat.

A jury sentenced him to death in 2003.

"There is a point in the history of a society when it becomes so pathologically soft and tender that among other things it sides even with those who harm it, criminals, and does this quite seriously and honestly. Punishing somehow seems unfair to it, and it is certain that imagining ‘punishment’ and ‘being supposed to punish’ hurts it, arouses fear in it." Friedrich Nietzsche
