    Joe Leonard Lambright - Arizona

    Facts of the Crime:

    Sometime between March 11 and March 14, 1980, Lambright, Robert Douglas Smith and Kathy Foreman picked up Sandra Owen, a young woman with mental problems, who was hitchhiking in the Tucson area. Smith raped Ms. Owen twice and the group took her to a remote area in the mountains outside Tucson. Lambright and Smith then killed the victim by choking her, stabbing her and hitting her in the head with a large rock.

    Lambright and Smith were tried in a joint trial before two separate juries. Ms. Foreman testified against them in exchange for a grant of immunity.

    Lambright was sentenced to death on May 27, 1982.

    On June 18, 2010, Lambright filed an appeal in the US Ninth Circuit Court of Appeals over the denial of his habeas petition in Federal District Court.

    This is a complex case. Joe Lambright was issued a writ of habeas corpus back in 2007. I see there is oral arguments scheduled before the 9th circuit, but the states cert petition was denied... Was Lambright under 2 death sentences?

    He is not listed on the 'Inmates in Death Row' list but he is still under the sentence of death!

    3 weeks ago his sentence was death... Seems like he's a free man now

    I have seen nothing here in the local press, as to whether the sentence was overturned by any court that would be involved in this case. However, I Googled him with the term "vacated" in the search string, and found a "findacase" entry, that mention something about vacating the sentence, however I cannot read all of it as I do not have an account.

    This doesn't explain how he's suddenly free with absolutely no mention of it anywhere. I wonder if the victim's family knows about all this...
