Man gets death in 2002 murder case

A Mesa man who kidnapped and murdered another man five years ago and then shot a DPS officer while on the run was sentenced Thursday to death.
Aaron Brian Gunches, 36, pled guilty to the December 2002 kidnapping and execution-style shooting death of Ted Price, and to shooting Department of Public Safety Officer Robert Flannery in January 2003, according to the Maricopa County Attorney's Office.
Price's body was found in the desert east of Mesa off the Beeline Highway. Gunches fled the Valley after the murder.
Gunches shot Flannery twice during a traffic stop Jan. 15, 2003, on Interstate 10 about 30 miles east of the California border, authorities said. Flannery escaped with minor injuries when his bulletproof vest stopped one of the bullets and the other was deflected off his wristwatch, police said.
Police arrested Gunches after a manhunt that included more than 50 officers, records show.
He pled guilty to attempted first-degree murder and aggravated assault charges in that case and was sentenced to 21 years in prison.
In October 2003, Gunches was indicted on first-degree murder and kidnapping charges in connection with Price's death, and he pled guilty in November, authorities said.
Gunches served a two-year prison term for a drug paraphernalia conviction in June 1999.

Court vacates death sentence in Mesa man's killing
PHOENIX (AP) - The Arizona Supreme Court has set aside the death sentence a jury handed a man who killed a Mesa man in 2002.
Aaron Brian Gunches pleaded guilty to kidnapping and first-degree murder for shooting his girlfriend's ex-husband, Ted Price. The now-38-year-old had a woman drive Price to the Salt River Indian Reservation, and then shot him three times in the chest and once in the head.
A Maricopa County jury sentenced him to death in 2007. The Supreme Court ruling handed down Wednesday says the jury erred when it decided that Price's killing was "especially heinous or depraved," a finding needed to impose the death sentence.
The unanimous ruling also upheld the convictions. A new penalty phase must be held if prosecutors still want Gunches sentenced to death.

Arizona Supreme Court upholds man's second death sentence
PHOENIX (AP) — A new Arizona Supreme Court decision upholds the second death sentence of a Mesa man who pleaded guilty in a homicide and who didn't seek leniency when he represented himself in his sentencing.
The justices on Thursday upheld Aaron Brian Gunches' sentence for the 2002 killing of Ted Price, Gunches' girlfriend's ex-husband.
Gunches was resentenced in 2013 after his first death sentence was overturned in 2010 because the court said jurors erred in deciding the killing was "especially heinous or depraved."
An appeal filed for Gunches said the trial judge shouldn't have allowed Gunches to represent himself during sentencing or allow Gunches to skip presenting evidence supporting leniency.
The justice said defendants have a long-established right to represent themselves and that Gunches voluntarily and knowingly waived offering any mitigating evidence.

It’s just for attention he knows it won’t happen Brnovich pledged to execute 20 inmates all he managed to do was execute 3 senile old men before he leaves office. Arizona has been a dead death penalty state since 2014. These executions were just token.
