On July 22, 2010, the following habeas decision was made in Federal District Court:

JUDGMENT by Judge Christina A. Snyder. IT IS HEREBY ADJUDGED that the petition for writ of habeas corpus by a person in state custody under a sentence of death 49 is GRANTED IN PART AND DENIED IN PART. The Court ORDERS the State of California either to grant petitioner a new trial on the special circumstance allegations and, if appropriate, the penalty phase verdict, or to vacate the special circumstance findings and the sentence of death and to re-sentence petitioner in accordance with California state law and the United States Constitution.

Allison is no longer listed on California's death row although he does remain incarcerated at Solano Prison.

"...I also represented Watson Allison ("Al") in federal habeas proceedings that resulted in the reversal of his death sentence and capital conviction. In early 2012 Al was resentenced to 25 years to life with 30 years time served and we expect him to be paroled in the not too distant future...."

Mr. Clough has the advantage of being able to cherry pick and choose his cases. Hence he appears rather more formidable than he actually is to a less sophisticated eye. Like many criminal defense attorney's he's manufactured a reasonable facsimile of heft, gravitas and expertise with out actually possessing heft, gravitas and expertise. A 2 or 3 trick pony impresses some people all of the time and or most people some of the time, but never all of the people at any time.
