    Wash. prepares for Woods execution

    The Washington state Department of Corrections is preparing for a March 20 execution at the state Penitentiary at Walla Walla.

    The state attorney general's office says the U.S. District Court in Eastern Washington on Thursday lifted a stay on the execution of Dwayne Woods.

    Woods was convicted of 2 counts of aggravated 1st-degree murder for the April 1996 slayings of Telisha Shaver and Jade Moore in Spokane County. During his trial, Woods did not admit to the killings, but asked jurors to sentence him to death.

    Another inmate, Cal Coburn Brown, is scheduled to be executed on March 13.

    WALLA WALLA — A man facing the death penalty for the beating deaths of two women nearly 13 years ago has been scheduled for execution next month.

    The U.S. District Court Thursday denied the latest appeal by Dwayne A. Woods, 39, said Janelle Guthrie, communications director for the state Attorney General’s office. The court denied all remaining claims and lifted the stay of execution in his case, which automatically reset the date to March 20, Guthrie said.

    Woods was convicted in 1997 by a Spokane County jury of two counts of aggravated first-degree murder for the deaths of Telisha Shaver and Jade Moore. According to a 1998 article in the Spokane Spokesman-Review, Woods raped and then beat Moore to death with an aluminum baseball bat, then beat Shaver to death when she unexpectedly arrived at the residence where the crime occurred.

    Woods is the second person now facing a March execution date. Cal Coburn Brown, 50, is scheduled to die one week earlier, March 13, for the 1991 murder of Holly Washa in King County.

    Another inmate facing the death penalty, Darold Ray Stenson, remains on hold. Stenson had been scheduled to die on Dec. 3 but won a reprieve when the state Supreme Court refused to list a stay of execution issued by Clallam County Superior Court Kenneth Williams.

    Williams had ordered the execution halted to allow additional DNA testing of evidence in Stenson’s double-murder case.

    A total of eight men are currently under the death sentence in Washington state. All are incarcerated at Washington State Penitentiary.

    A court has issued a stay of execution for Washington inmate Dwayne Woods, convicted of 2 counts of aggravated 1st-degree murder for the April 1996 slayings of Telisha Shaver and Jade Moore in Spokane County.

    The U.S. District Court of Eastern Washington has issued a stay of execution for Washington inmate Dwayne Woods.

    Woods had been scheduled to die March 20 at the Washington state Penitentiary in Walla Walla. But Woods has appealed, and Judge Lonny Suko issued a stay today while the appeal works its way through the courts.

    Woods was convicted of 2 counts of aggravated 1st-degree murder for the April 1996 slayings of Telisha Shaver and Jade Moore in Spokane County. During his trial, Woods did not admit to the killings, but asked jurors to sentence him to death.

    On April 24, 2009, Woods filed an appeal in the US Court of Appeals for the Ninth Circuit over the denial of his habeas petition in Federal District Court.

    Dwayne Woods is closest in line to being the next inmate executed in Washington. Oral Argument in his case was heard 3/04/10 which was well over a year ago. In most cases, when an opinion is handed down so late after oral arguments, it's generally a split decision of 2-1 with either 2 judges upholding the sentence and 1 judge voting to overturn it, or 2 Judges overturning the sentence and 1 Judge voting to uphold it. In this case, it looks like a relatively conservative panel as Judges Paez, Tallman, and Milan Smith. I'm predicting the sentence will be upheld 2-1 by Tallman and Smith, while Paez dissents. (he always does)

    Ninth Circuit Rejects Dwayne Woods' Death Penalty Appeal

    Dwayne Woods, who was sentenced to the death penalty for beating two women to death with a baseball bat in 1996, has lost another appeal of his case.

    In 1997, a jury found Woods guilty on two counts of aggravated first degree murder, one count of attempted first degree murder and one county of attempting to elude police officers. A year prior he raped and killed Telisha Shaver and Jade Moore.

    He also tried to kill Venus Shaver but she survived the attack.

    In court, Woods asked for the death penalty, only to turn around and appeal that decision. In his latest appeal, Woods tried to argue that he was denied the right to defend himself. He also said, among other claims, that his counsel was inexperienced and the prosecution withheld material evidence.

    The Ninth Circuit Court of Appeals rejected his appeal. He previously appealed his sentence in district court. That appeal was also rejected.

    pauperis and the petition for a writ of certiorari are granted. The judgment is vacated, and the case is remanded to the United States Court of Appeals for the Ninth Circuit for further consideration in light of Martinez v. Ryan, 566 U.S. ___ (2012).

    On August 10, 2011, the Ninth Circuit upheld the denial of Woods' habeas petition. Judge Paez authored the 3-0 decision.

    On September 29, 2011, the Ninth Circuit denied a rehearing en banc.

    On March 26, 2012, the US Supreme Court granted Woods' petition for certiorari, vacated the judgment and remanded to the Ninth Circuit for further consideration in light of Martinez v. Ryan.

    In today's Ninth Circuit Court of Appeals opinions, the court, on remand from the United States Supreme Court, remanded Woods' habeas corpus petition to the district court to consider whether the petitioner can show cause and prejudice under Martinez v. Ryan, 132 S. Ct. 1309 (2012).
