I think it´s too late to apologize...
No murder can be so cruel that there are not still useful imbeciles who do gloss over the murderer and apologize.

Tina Brown to be sentenced Friday

The woman accused of beating and burning a teenager to death in Ensley will be sentenced Friday, and the judge will have to decide whether to sentence her to life or death.

Tina Brown, 42, was convicted in June of killing Audreanna Zimmerman, 19, in March 2010. Zimmerman was repeatedly beaten and hit with a stun gun before she was taken out to a wooded area and set on fire.

A jury unanimously recommended that Circuit Judge Gary Bergosh sentence Brown to death, but the decision is ultimately in Bergosh’s hands. Bergosh will make that determination during a hearing and sentencing set for Friday afternoon. He is also able to sentence Brown to life in prison.

Brown’s daughter, 19-year-old Britnee Miller, is awaiting sentencing after pleading to a first-degree charge in the same case. Another co-defendant, Heather Lee, received a 25-year prison sentence from Bergosh after pleading to a second-degree murder charge.

Judge sentences Tina Brown to death

The woman who beat and burned a teenager to death in Ensley in March 2010 was sentenced to death this afternoon.

Tina Brown, 42, was convicted in June of killing Audreanna Zimmerman, 19. Zimmerman was repeatedly beaten and hit with a stun gun before she was taken out to a wooded area and set on fire.

During a brief hearing this afternoon, Circuit Judge Gary Bergosh sentenced Brown to death. Reading from his order, Bergosh said the case made by prosecutors, which in part detailed the heinous way Zimmerman died, outweighed evidence presented by the defense.

The defense, during the penalty phase of the trial, had multiple family members and doctors testify, and said Brown has lived a hard life full of drugs and sexual abuse.

This life influenced her state of mind and the decisions she made at the time Zimmerman was killed, according to testimony.

Prior to Bergosh’s sentence, Brown made one last statement, saying she was sorry for her involvement in Zimmerman’s death, and that “I want them to have closure.”
“I hope today they get it,” Brown said.

Bridgette Jensen, the prosecutor handling the case, said she is pleased with the judge’s decision, as the State Attorney’s Office do not take seeking the death penalty lightly.

“This is certainly one that qualified based on the nature (of the murder),” Jensen said.
Bergosh noted that everyone sentenced to death has their case reviewed by the state Supreme Court. John Jay Gontarek, Brown’s attorney, also pointed this out during comments made after the sentencing.

“These cases are difficult cases, and of course we’re sympathetic to the family of the victim,” Gontarek said.

Brown's daughter, 19-year-old Britnee Miller, is awaiting sentencing after pleading to a first-degree charge in the same case. Another co-defendant, Heather Lee, received a 25-year prison sentence from Bergosh after pleading to a second-degree murder charge.

Tina Brown remains on death row for brutal murder

The Florida Supreme Court unanimously upheld the conviction and death penalty sentence of a Pensacola woman accused of beating a 19-year-old with a crowbar, shocking her with a stun gun and then setting her on fire, according to the State Attorney’s Office.

In 2012, Tina Lasonya Brown, 43, was found guilty of first-degree murder in the death of Audreanna Zimmerman.

Brown, her daughter Britnee Miller, then 16, and neighbor Heather Lee, then 27, attacked Zimmerman in Brown’s Ensley trailer in 2010.

After beating and stunning her, the trio put Zimmerman in the trunk of a car, drove her to a wooded area off Lepley Avenue, doused her with gasoline and set her on fire.

Investigators said the attack was sparked by a disagreement over a male.

Zimmerman was able to run to a nearby home and call 911 after the attack, investigators said. She was transported to a Mobile, Ala., hospital with severe burns across 60 percent of her body. She died two weeks later.

Brown’s jury found her guilty and recommended the death penalty unanimously. Last week, the Florida Supreme Court denied Brown’s appeal of the sentence and conviction.

Lee, 30, testified against Brown during the trial, pleaded guilty to second-degree murder and was sentenced to 25 years in prison.

Miller, now 20, was sentenced to life in prison without parole in 2013 for her role in the attack. During her trial, Miller told Circuit Judge Gary Bergosh that the initial plan had been for her to fight Zimmerman, but that attack escalated out of control.

Death row inmate who set woman on fire claims her attorneys were ineffective

    By Emma Kennedy
    The Pensacola News-Journal

Death row inmate Tina Brown — who was convicted in 2012 for tasing, beating and setting a woman on fire — is again in Escambia County court as she argues for a new trial.

The jury in Brown's case unanimously recommended that she be sentenced to death for the murder of Audreanna Zimmerman in 2010.

Brown, 47, was the only defendant sentenced to death. Her daughter, Britnee Miller, who was 16 at the time, is serving a life sentence for murder, and a third woman, Heather Lee, 35, is serving a 25-year sentence for second-degree murder.

Much of Brown's arguments, which are in a lengthy series of court filings, argue that Lee had more culpability in the crime and that several of the jurors should have been excused from the case.

Her argument comes down to claiming she had an ineffective counsel. The argument is a common appeal in death penalty cases, according to State Attorney Bill Eddins.

Brown, Lee and Miller attacked Zimmerman in Brown's Ensley home, where they beat and stunned her with a Taser. They then put her in the trunk of a car, drove her to a wooded area, doused her in gasoline and set her on fire.

Zimmerman was able to run to a nearby home to call 911. She was transported to a burns unit in Mobile, Alabama, with burns on 60 percent of her body and died two weeks later.

Prosecutors originally also sought the death penalty for Lee, but reduced the charge after Lee agreed to testify against Brown.

Now, Brown claims if her trial counsel — John Jay Gontarek and Sharon K. Wilson — had investigated her case more thoroughly, her sentence could have been different.

Brown, who is represented by the Capital Collateral Regional Counsel in her appeal, also claims several jurors made comments during jury selection that they either supported the death penalty or would not take into account Brown’s history and life experiences in sentencing.

She further claims one juror said a close family member suffered severe burns, which Brown's appeal says should have automatically eliminated that person from the pool.

Nearly a dozen witnesses testified during Brown's week-long evidentiary hearing before Judge Gary Bergosh, who also presided over the murder trial.

The hearing is scheduled to continue through next week, and then Bergosh will decided whether Brown’s arguments are valid and her sentence should be vacated and a new trial should be scheduled.

Brown also claims Lee has made comments while incarcerated, bragging about her role in the murder, and that other witnesses could have been called during the initial trial to explain Lee, rather than Brown, had a more tense relationship with the victim..

Brown also references inconsistencies in testimony and depositions she thought should have been explored on the stand. She claims her attorneys didn't adequately investigate the mitigating factors that could have helped in the penalty phase of the trial.

Brown's appeal to the Florida Supreme Court to vacate her sentence and order a new trial was denied in 2014 after the justices unanimously upheld her conviction.

Brown's hearing is scheduled to continue Friday and possibly through Monday.
