    Girl's killer gets death penalty for second time


    LOS ANGELES — A jury on Tuesday again recommended death for a Compton man who sexually assaulted, stomped on and murdered his girlfriend's 11-year-old daughter two decades ago.

    A Superior Court jury recommended that James Heard, 58, be put to death for killing Katrina Brown and sexually assaulting her with a baseball bat after a daylong binge of alcohol and crack cocaine. His original death sentence was overturned by the California Supreme Court in 2003 because the trial judge had improperly dismissed a juror.

    The court upheld the conviction but ordered a new sentencing trial. A judge will review the jury's latest recommendation before deciding on Heard's sentence.

    During the latest trial, Deputy District Attorney Danette Meyers asked the jury to do justice for the victim, who had bitten off part of Heard's tongue during the attack. He poured a bottle of rubbing alcohol down her mouth to try to get her to regurgitate it before strangling and stomping on her.

    Heard claimed he had no recollection of attacking the girl and said he cared "greatly" for his girlfriend and her daughter and "had a lot of love in my heart for them."

    After the verdict, Meyers said the case was "most brutal crime I have seen perpetrated in my lifetime. This is one guy I hope to see executed in my lifetime. I'm hoping they expedite this."

    Stanley Perlo, Heard's attorney, said the jury's decision "was not unexpected."

    A former Compton resident who sexually assaulted and murdered his girlfriend's 11-year-old daughter nearly two decades ago was sentenced to death today.

    James Heard, 58, killed Katrina Brown in 1990 while her mother was at work. Heard said he could not remember the slaying because he had been drinking alcohol and smoking crack for more than a day.

    Los Angeles Superior Court Judge William R. Pounders, decided to accept a jury's recommendation that Heard receive the ultimate penalty.

    The jury was the second to recommend that Heard be put to death.

    His first death sentence was overturned in 2003 by the California Supreme Court, which found that the judge in Heard's first trial "conducted a seriously deficient examination of a prospective juror during the jury selection process, and in the absence of adequate justification, erroneously excused the juror for cause based upon the juror's ostensible views regarding the death penalty."

    But the state's highest court allowed Heard's conviction to stand for first-degree murder, forcible lewd act upon a child, sexual penetration by a foreign object and assault with a deadly weapon.

    In her closing argument in Heard's most recent trial, Deputy District Attorney Danette Meyers told jurors that the girl had marked her killer by biting off part of his tongue during the attack, and that he stomped on her and stuffed a bottle of rubbing alcohol down her mouth in an effort to get her to regurgitate it before strangling her. "This case cries out for the penalty of death and nothing less," Meyers told jurors. "I ask you to do justice for that little girl."

    During proceedings last year in which jurors deadlocked on whether he should be sentenced to death, Heard testified that he had been drinking alcohol and smoking crack since the morning hours the day before the girl's killing and did not remember doing anything to his girlfriend's daughter.

    "You don't remember leaving Katrina looking like that?" one of Heard's attorneys, Robin Jacob Yanes, asked his client.

    "No," the defendant responded.

    "You don't remember being in Katrina's room and causing all of this?" the attorney asked.

    "No, I don't," Heard said.

    He said he cared "greatly" for his girlfriend and her daughter and "had a lot of love in my heart for them," and had no idea what caused the attack.
