    Defense attorneys trying to keep Jonathan Douglas Richardson off death row say the alleged physical abuse of Teghan Skiba started long before the 4-year-old's death nearly four years ago and that the child's mother knew about it and approved of it.

    But jurors in the 25-year-old's capital murder trial heard Tuesday from Teghan's maternal aunt, who said the child's mother, Helen Reyes, was a kind mother who loved her daughter very much.

    "She loved Teghan. She tried to better her life for Teghan," Maira Reyes said.

    The extent to which Helen Reyes would punish her daughter, Maira Reyes said, would be time out or a pop with the hand on the child's bottom.

    Richardson's treatment, on the other hand, was quite different. She recalled of one occasion in which the crying child had been dropped off by her grandparents.

    "Jonathan grabbed her by the arms and shook her to stop crying," Maira Reyes said.

    Johnston County prosecutors say Helen Reyes was in New Mexico for Army Reserve training in July 2010 and had left Teghan in Richardson's care.

    They contend Richardson physically and sexually abused the child for 10 days inside a small shed behind his grandparents' home before taking her to a local hospital for a fatal head injury and more than five dozen bite marks on her body.

    Defense attorneys, however, say Richardson – damaged by years of abuse, uncontrolled anger and untreated mental problems – never sexually abused Teghan and that her death was an "unbelievable tragedy" that Richardson never meant to happen.

    He loved Reyes and Tegan and wanted the three of them to be the perfect family, Richardson's attorneys say, but he had no idea how to care for a little girl.

    Helen Reyes, they say, had other child care options but chose to leave Teghan with him.

    By July 2010, however, Helen Reyes' relationship with Richardson had become a source of tension for her family, Maira Reyes said, and her sister and Teghan had moved out of her mother's house following a disagreement.

    Richardson's second-cousin, Matthew Daughtry, testified Tuesday, describing Helen Reyes as being very quiet.

    "Jonathan would yell at Helen. It would escalate to cussing," he said. "I never saw anything physical – but (there was) verbal abuse."

    Richardson and Daughtry often spent time together hunting on Daughtry's property, he said, but he stopped hanging out with Richardson in spring 2010 when Richardson began drinking heavily and started using his property without permission.

    Daughtry said he was also upset by Richardson’s rude behavior toward his grandparents, especially when they would tell him to do something.

    "He would not listen. He would challenge them back. He would be very dominating over them," Daughtry said. "It came to the point where he told them to shut up. It was going to be Jonathan's way."

    Woman testifies against former boyfriend accused of killing her daughter

    The mother of a 4-year-old Johnston County girl who died from severe abuse in 2010 broke her silence Thursday, testifying in the trial against her former boyfriend, who is accused of killing the girl.

    Helen Reyes breathed heavily and dabbed her eyes as she took the stand, then broke down in tears when prosecutor Greg Butler asked why she was in court.

    “I am here for Teghan, for my baby, for justice,” she said.

    Prosecutors say Reyes went to New Mexico for Army Reserve training in July 2010 and left her daughter, Teghan Skiba, in the care of Jonathan Douglas Richardson.

    They contend Richardson physically and sexually abused the child for 10 days inside a small shed behind his grandparents' home before taking her to a local hospital for a fatal head injury and more than five dozen bite marks on her body.

    Richardson, 25, is charged with first-degree murder, felony child abuse, kidnapping and sexual offense.

    Reyes is charged with felony negligent child abuse. She said Thursday she was not testifying as part of a plea deal.

    She described her relationship with Teghan’s father, Jerry Skiba, whom she met at an Applebee's in 2005. After Teghan was born, Reyes said, Jerry Skiba became violent, and the two split.

    She said she was single until she met Richardson.

    "I cared about him," Reyes said. "I felt I was in love with him, or falling in love with him."

    She said Richardson was a father figure to Teghan and taught the girl how to hook minnows for fishing.

    At some point, Reyes had a "blowout" with her mother. She took Teghan and moved in with Richardson in the shed behind his grandparents' house.

    Reyes said she once left Teghan with Richardson, went to Walmart and returned to find the girl with a cut on her head. Richardson said she accidentally hit the corner of a stationary bicycle.

    Another time, Teghan’s eye was hurt during a trip to the beach.

    “He told me there was a wave that came and ended up hitting her eye,” said Reyes, who now works in a medical office and has an 8-month-old girl.

    Reyes also testified that she returned home once to find welts on Teghan.

    “I went inside and grabbed her and held her and told her that I loved her,” Reyes said, crying. “He told me that he had whipped her for throwing up on his chair…he had whipped her with a power cord.”

    She said she was outraged and told Richardson never to touch Teghan again.

    The couple’s tumultuous relationship continued, and Richardson tried to call it off several months before Teghan’s death. In court, Reyes read aloud part of a love letter she had written to Richardson at the time: “If I tell you I love you too much, then tell me and I’ll tone it down. You have shown me what it means to be truly loved and treated well.”

    Richardson showed no emotion as Reyes read the letter. When Butler, the prosecutor, asked Reyes why she stayed, she said, “He was stern with her at times, but he showed that he loved and cared for her.”

    Reyes said she left Teghan with Richardson during her training because he volunteered to take care of the child, saying that his grandmother would help while he was at work.

    “I trusted him, and I trusted his word,” Reyes said. “(Teghan) said she really liked him and that she wanted him to be her dad.”

    For the first time in the nearly three-week trial, Richardson reacted. His eyes reddened and he wiped them.

    Defense attorneys have said that Richardson – damaged by years of abuse, uncontrolled anger and untreated mental problems – never sexually abused Teghan and that her death was an "unbelievable tragedy" that Richardson never meant to happen.

    He loved Reyes and Teghan and wanted the three of them to be the perfect family, Richardson's attorneys say, but he had no idea how to care for a little girl.

    Before Reyes took the stand Thursday, the judge questioned jurors about their ability to remain impartial following an incident that happened Wednesday while the group dined at Golden Corral.

    At least one of the jurors reported to a deputy that they encountered a woman at the restaurant who yelled out that Richardson was guilty and they needed to convict him.

    Superior Court Judge Tom Lock asked each of the six jurors who heard the comment whether it would affect his or her ability to be fair and impartial. Each responded that it would not, and the trial resumed.

    Video of Teghan Skiba days before death leaves jurors shaken

    After 17 days of testimony, Johnston County prosecutors rested their case Tuesday afternoon in the capital murder trial of a Smithfield man accused of torturing, sexually abusing and killing his girlfriend's 4-year-old daughter nearly four years ago.

    Daylong, graphic testimony from a pediatrician who specializes in child physical and sexual abuse ended with the state showing jurors a video of Teghan Skiba, with her arms outstretched, facing a wall and repeatedly saying, "When I have to pee, I promise I will tell someone."

    Jurors also heard the sound of a man on the video that prosecutors say is Jonathan Douglas Richardson yelling for the child to speak up.

    The 37-second video, taken at 2:31 a.m. on July 10, 2010, left several jurors visibly shaken and at least one in tears. Some court personnel were crying as well.

    The state contends it was the last image of Teghan conscious and alive.

    Six days later, prosecutors say, Richardson, 25, took the child – near death – to a local emergency room, claiming she fell off a bed and hit her head. She had more than 60 bite marks, as well as cuts and bruises covering her body.

    Richardson faces charges of first-degree murder, kidnapping, felony child abuse and sexual offense with a child and could face the death penalty if convicted.

    Defense attorneys, who will begin presenting their case Wednesday, don't deny Richardson's role in her death but say it was the result of a number of factors, including his lack of parenting skills, undiagnosed mental problems and his own experiences of being abused as a child.

    They maintain, however, that he never sexually abused the child.

    Dr. Kenya McNeal-Trice, a pediatrician at UNC Hospitals in Chapel Hill, where Teghan died July 19, 2010, however, testified that there were injuries to the child's body that were consistent with sexual abuse.

    Defense expert: Suspect in 4-year-old's slaying suffered from undiagnosed mental disorders

    A forensic psychiatrist testified Thursday that several undiagnosed mental disorders could have been a factor for the alleged actions of Jonathan Douglas Richardson – on trial for the death of his girlfriend's 4-year-old daughter – nearly four years ago when prosecutors say he tormented, tortured and terrorized the child for 10 days.

    Dr. Donna Schwartz-Watts, of Anderson, S.C., said she determined after his arrest that the 25-year-old likely suffered from anxiety disorder, mood disorder and substance abuse disorder.

    At the time of the alleged crimes, she said, Richardson was a 21-year-old man with depression and a history of alcohol and drug abuse as well as improper punishment by his own father, who strictly disciplined him as a child and whipped him weekly with a belt.

    But Schwartz-Watts said she does not think Richardson was under any post-traumatic stress while Teghan was in his care in July 2010. He had been keeping the girl while her mother – an Army reservist – was in New Mexico for military training.

    "He was irritable. He was in a situation where he was punishing a child," Schwartz-Watts said. "He has no experience raising children. He's been punished in the past with affect and anger. He's punishing her for not listening to him, but in terms of his anxiety disorder, it's not related."

    Defense attorneys say it was the mental disorders, his lack of experience with children, his own experiences of being abused as a child and his inability to control his anger that led to Teghan's death on July 19, 2010.

    An autopsy determined she died of a traumatic head injury. Doctors have testified that the child had dozens of bite marks on her body and she was covered in bruises and abrasions. There were also injuries consistent with sexual assault – something Richardson's attorneys deny.

    Richardson faces charges of first-degree murder, felony child abuse, kidnapping and sexual offense with a child. If convicted, he could face the death penalty.

    The defense continues presenting its case Friday morning.

    The defense rested Friday in the capital murder case of Jonathan Douglas Richardson, who is accused of torturing and killing his former girlfriend’s 4-year-old daughter, Teghan Skiba, in July 2010.

    Closing arguments will begin at 9:30 a.m. Monday in the trial, which is now its fourth week.

    Prosecutors say Richardson, 25, tortured, tormented and sexually abused Teghan for 10 days before taking her to a hospital emergency room with a fatal head injury. Several investigators and health care workers who treated Teghan wept during their testimony as they described the girl’s injuries, including dozens of bite marks on her body, as among the worst they had ever seen.

    The girl’s mother Helen Reyes, left her daughter in Richardson’s care while she when to New Mexico for Army Reserve training. She is charged with felony negligent child abuse.

    Richardson is charged with first-degree murder, felony child abuse, kidnapping and sexual abuse. Defense attorneys have not denied the abuse happened, but they said Richardson was damaged by years of abuse, uncontrolled anger and untreated mental problems. They said he never sexually abused the girl.

    No witnesses took the stand Friday morning, and jurors spent most of that time outside the courtroom.

    Johnston County prosecutor: 'None of us are the same'

    That's what Johnston County Assistant District Attorney Paul Jackson told jurors Monday morning during closing arguments in the capital murder trial of Jonathan Douglas Richardson, accused of killing his former girlfriend's 4-year-old daughter, Teghan Skiba, nearly four years ago.

    "Ten days of continuous torment, torture and terror, and you don't want to think about it, but you have to," Jackson said. "I'm sorry that you have to think about it."

    Richardson, 25, is accused of physically and sexually abusing the child in a shed behind the Smithfield home of his grandparents while her mother was out of the state.

    He took her to a local hospital on July 16, 2010, with more than 60 bite marks covering her body, as well as bruises and abrasions that doctors testified were too many to count. The child died three days later from a fatal head injury.

    Richardson is on trial on charges of first-degree murder, felony child abuse, kidnapping and sexual abuse. Johnston County prosecutors are seeking the death penalty in the case.

    Jackson said Teghan's death was the result of "multiple and continuous sadistic acts” that he said “came from a dark place."

    "The only one who really knows how much agony and suffering Teghan went through was Teghan, at the time, and this defendant," Jackson said.

    Closing arguments culminated four weeks of emotional and disturbing testimony that included numerous witnesses, including a seasoned sheriff's deputy, breaking down on the witness stand.

    Jurors also were emotional as they saw photos of Teghan's injuries, the living conditions in which she spent the final days of her life and an upsetting 37-second video taken of her days before her death.

    "Everything about this case is so incredibly tragic," said defense attorney Jonathan Broun, who urged jurors to put aside their "natural and understandable instincts about what happened" and to apply the law to the facts in the case.

    Richardson loved Teghan and never intended to kill her, Broun said, and he never sexually abused her.

    "You all have been given a duty and responsibility to decide this case, to determine exactly what happened," Broun said. "There are hard questions that have to be answered, facts that have to be analyzed and law that has to be applied to this case."

    The defense contends it was Richardson's undiagnosed mental disorders, his lack of experience with children, his own experiences of being abused as a child and his inability to control his anger that led to Teghan's death.

    Broun said Richardson got frustrated with Teghan for picking at scabs on her body and shook her with incredible force.

    "In the course of shaking her, her head hit the door," he said.

    Jonathan Richardson was found guilty of first-degree murder, felony child abuse, kidnapping, and sexual offense with a child in the death of the 4-year-old.

    He could now face the death penalty in the next phase of the trial.

    In his closing arguments Monday, an emotional Johnston County Assistant District Attorney Paul Jackson told jurors Skiba was tortured, sexually assaulted, and beaten by her mother's boyfriend over a 10-day period while her mother, Helen Roxanne Reyes, was out-of-state for Army Reserves training in July 2010.

    Jackson said jurors will "never be the same" after listening to weeks of testimony in the case and called what Richardson allegedly did to Skiba "heinous, atrocious, cruel acts."

    "It didn't end until he beat her brains so badly that she lost consciousness," said Jackson.

    In 2010, the then-21-year-old Richardson took Skiba to Johnston Medical - claiming the girl had fallen off the bed. However, doctors found she had cuts, bruises, a head wound, and bite marks on her body. Skiba died days later from her injuries after she was transferred to UNC.

    Broun said Richardson never intended to kill Skiba. Instead, the attorney said Richardson shook the child so hard that it caused brain injuries, and then waited too long to get her medical help.

    Broun also said that despite the injuries to Skiba's genitals, there was never any sexual intent on Richardson's part.

    "That is not intended to lessen what happened, but there was no sexual intent," said Broun.

    Broun also asked jurors to consider Richardson's background and mental state. The defense claims he was abused as a child by his father and had undiagnosed mental problems.

    With the penalty phase underway in Johnston County for the man convicted of killing Teghan Skiba, the courtroom heard Friday how emotional Jonathan Richardson was when he told his mother about the 4-year-old's death.

    Richardson was found guilty earlier this week of first-degree murder, felony child abuse, kidnapping, and sexual offense with a child in the 2010 death of his then-girlfriend's daughter. He now faces a possible death sentence.

    An already graphic and horrifying trial got even worse Friday as his defense attorneys played a video of Richardson crying as he told his mother about Skiba's death - saying "I loved her to death."

    In the 2010 video, Richardson told his mom that he loved Skiba and she calls him daddy. He said it wasn't looking good for Skiba, and that she wasn't really breathing, and wanted to know if that was bad. He then told her he "didn't do it." Richardson also told his mother he wanted to go to church.

    The five now going onto six-week trial has been disturbing, and now with sentencing, family of the little girl gave their impact statements Friday.

    "There is so much sadness, anger, disbelief, heartache everyday of our lives. We try to remember the happy times we share with Teghan but are so sadden that there will be no more," said Sarah Skiba, the victim's grandmother.

    "I'm just ready for all of this to be over...I hate that this wound in my heart had to be reopened," said Maira Reyes, the victim's aunt.

    On Wednesday, a forensic pediatrician discussed in depth the torture and murder of the little girl.

    "In my opinion Teghan Skiba was a victim of child torture," Dr. Sharon Cooper said. "She had more than 144 injuries...that is an extraordinarily high number of injuries...that's a particularly harsh action and causes especially a cruel pain and suffering much more pain and suffering perhaps than the first time the person was injured at that site. So the presence of a new injury over an old injury will cause this child to have that much more pain and that would be another type of action that would strongly support sadistic gratification."

    Cooper went into great detail but what she described was so disturbing that Skiba's grandparents walked out.

    When the jury finally gets their case to decide this time around, it will only be life or death for Richardson since they already convicted him for killing Skiba.

    Psychologist testifies in Richarson trial's penalty phase

    The jury who convicted Jonathan Richardson of torturing and killing 4-year-old Teghan Skiba is continuing to hear testimony on whether he should live or die.

    The penalty phase continued Monday in Smithfield.

    A doctor was on the stand all afternoon talking about the convicted killer's upbringing. He said there's a lot of smoke pointing to one thing.

    "I concluded that he's a quite disturbed individual," said psychologist Dr. Mathew Mendel. "I concluded that there's a lot of mystery involved with Jonathan Richardson and with his family more generally, and frankly I had more difficulty finding out information."

    While Mendel says there's a lot of smoke, he couldn't pinpoint a fire -- meaning what actually was wrong with Richardson. Mendel is expected to testify Tuesday as well.

    Jailhouse reports: Richardson 'incited' inmates, threatened detention officer

    Jail documents detail numerous behavioral problems of Jonathan Douglas Richardson while he awaited trial for the murder of 4-year-old Teghan Skiba, including accusations that he incited inmates and threatened to stab a detention officer, according to a forensic psychologist's testimony Tuesday in the sentencing phase of his trial.

    Richardson could face the death penalty after a jury, last week, found him guilty of not only murdering the girl but physically and sexually abusing her during a 10-day period prior to her July 19, 2010, death.

    Defense attorneys have portrayed the 25-year-old as a mentally damaged man who was a product of child abuse and whose experiences of being improperly disciplined caused him to believe that the physical abuse he inflicted upon Teghan – whom he loved – was OK.

    Her death, the defense has said, was the result of uncontrolled anger and was not intentional.

    Defense witness Matthew Mendel, the psychologist who met with Richardson several times after his arrest, said during cross-examination Tuesday that Richardson told him that Teghan – his ex-girlfriend's daughter – called him "daddy" and that he even went as far as having her name and birthdate tattooed on his arm when he was in jail.

    "It was a life-changing event for me. I lost my daughter," Mendel quoted Richardson from a conversation they had about the girl's death.

    The state, however, has argued that Richardson knew exactly what he was doing when he tortured and terrorized the girl to fulfill his "sadistic desires."

    In cross-examining Mendel, Johnston County prosecutors also had him read from the jailhouse reports that detailed some of Richardson's misconduct.

    Despite mood-stabilizing medication and several lockdowns, one lieutenant wrote: "We do not know what to do with him. We keep locking him down, but it does no good."

    Superior Court Judge Thomas Lock, however, would not allow the jury to hear about other behavior, deeming it highly prejudicial.

    Outside the jury's presence, Mendel read that Richardson "incited other inmates to do his dirty work" and threw feces and urine.

    Sandy Penny, the longtime live-in girlfriend of Richardson's father, took the stand Tuesday to refute the defense’s claims that Richardson’ suffered abuse from a rage-filled, single father. She testified that she never saw any signs of improper discipline from Doug Richardson.

    "Jonathan had a good home. He had the best of both worlds. He had his mom every other weekend," Penny said. "He had his dad every day, and the other weekends, they went fishing all the time – all the time."

    "Was Doug a good father?" Assistant District Attorney Greg Butler asked.

    "Yes," Penny said, tearfully.

    The state is expected to call at least one more rebuttal witness before closing arguments, which could begin as early as Wednesday afternoon.
