    Michael Lee Sentenced to LWOP in 2010 AL Murder of Kyser Miree

    The suspected trigger man was named in court this morning in the Midtown murder of Kyser Miree.

    Earnest Wiggins, Bo Taylor, Jamal Lang and Michael Lee are charged with capital murder.

    An officer testified Wednesday morning three of the suspects labeled Michael Lee as the shooter.

    The officer said the suspects said they followed a friend of Miree's roommate to Miree's house from an ATM.

    He says when the friend and roommate left, the suspects forced their way into the house and forced Miree to the ground.

    The officer testified Lee shot Miree in the head while he was begging for his life.

    While being escorted out of court after the testimony, Lee punched a wall, sending sheetrock to the floor.

    All four suspects face the death penalty if found guilty.

    Mother of alleged shooter in Miree murder told witness, 'I'm going to kill you,' prosecutors say



    The mother of the alleged shooter in Christopher Kyser Miree’s slaying was arrested today on accusations that she threatened to kill a key witness in the capital murder case against her son.

    Felicia Nicole Lee, 40, was booked into Mobile County Metro Jail on 2 felony charges of intimidating a witness.

    Police have said her son, 19-year-old Michael Jerome Lee, shot and killed 23-year-old Miree in a nighttime robbery at his Macy Place home on April 16.

    Lee and three other defendants — Bo Ellis Taylor, 18; Jamal Breon Lang, 20; and Ernest Teryl Wiggins, 19 — are accused of barging into the house and demanding money shortly before Miree was shot in the head.

    The 4 men have pleaded not guilty to capital murder charges.

    According to court records, Felicia Lee approached a witness in the case after a court hearing on Wednesday at Mobile Government Plaza.

    While walking with her husband to their car, Lee allegedly told the the woman: “I’m going to kill you” and “if he don’t get bond, I’m coming to shoot your house up,” according to court records.

    Lee also reportedly said “you better watch your kids.”

    During Wednesday’s hearing, a police detective testified that the Mobile woman told investigators that she heard the 4 men talking about the shooting and making up a story that it was an accident, in case they were questioned by police.

    Another complaint filed in court says that Felicia Lee pointed a gun at the witness while driving by her house on July 25, hours after Lee's son was arrested.

    The report also says that Lee “continually calls the victim’s residence after being told to stop ... making obscene remarks to her over the telephone and this has caused her to fear for her safety."

    “This is a very important witness, as came out in the preliminary hearing,” said Mobile County District Attorney John Tyson Jr. "All witnesses are important, but in a capital murder case, you better believe this is serious. And we’re going to take every threat, every suggested threat, seriously. We’re going to investigate every one, and we’re going to bring charges where those charges are warranted.”

    Michael Lee’s attorney, James Byrd, said it was obvious that the witness is “making things up” because on the day of the arrest, nobody knew that she was involved in the case.

    “Anybody can be arrested for any false allegation,” said Byrd, who does not represent the mother.

    Miree, a Vanderbilt University graduate and Birmingham native, worked as an engineer at the Chevron Corp. refinery in Pascagoula. He lived on Macy Place with a roommate, Curtis Wright.

    Police have said on the night of the shooting, the four men were driving around, looking for people to rob. They spotted a friend of Wright at an ATM near Bel Air Mall and followed him to the Macy Place house, police said.

    Wright got into his friend’s car and they left — leaving Miree home alone — while the four men parked nearby, police said. The foursome then walked up to the porch to commit the robbery, police said.

    Felicia Lee denied bond for the fourth time in a row

    For the fourth time in a row, Felicia Lee has been denied bond. She's the mother of capital murder suspect Michael Lee, who was arrested in the Kyser Miree case.

    Felicia's family said bond being denied again isn't fair, and attorney Sid Harrell said it's unconstitutional. He plans to ask for bond a fifth time.

    Lee sat quietly as Judge Robert Smith denied her bond. Lee is accused of threatening to kill the key witness in her son's murder case.

    "This woman, they're accusing her of making threats and won't let her have bond. You have murderers who are out on the streets, walking the streets accused of murder. And they won't give her bond," said Constance Mims, Lee's aunt.

    The district attorney's office called Lee dangerous. Assistant District Attorney Jill Phillips said Lee produced a gun, and threatened to "shoot up" the witness's home. Phillips also referenced other cases of vandalism and harassment.

    "As far as intimidating this witness, just this one victim that she has the two charges for. There have been complaints by other people involved in case. The instances are all being investigated," said Phillips.

    Phillips wouldn't say who those other people are, but did say since Felicia Lee has been locked up, the complaints have stopped.

    Harrell said he isn't giving up. He believes his client's constitutional rights have been ignored. Judge Smith said Lee forfeited her rights.

    "My argument is constitutional. You're given a bond. How could she forfeit rights? They're saying she is guilty of conduct she hasn't been to trial on," said Harrell.

    The state said this isn't the first time Lee has been accused of harassment. Two decades ago, she was charged with harassing phone calls and criminal trespassing.

    Still, her family cries foul.

    "It's not in her nature, this isn't fair," said Mims.

    Lee's case has been bound over to a grand jury. Michael Lee's case has also been bound over to a grand jury.

    Michael was named the shooter in the murder Kyser Miree. Miree was found shot to death in his midtown home back in April.

    Michael Lee and three others, Bo Taylor, Earnest Wiggins and Jamal Lang, face the death penalty if convicted.

    MOBILE, Alabama -- The mother of the alleged shooter in the slaying of Christopher Kyser Miree, jailed on charges of intimidating a witness in her son’s case, has a right to bail and must be granted one, according to an Alabama Court of Criminal Appeals ruling.

    Felicia Lee, 40, has been in jail since Aug. 20, when she was arrested on accusations that she threatened to kill a key witness in the capital murder case against her son.

    Police say Michael Jerome Lee, 20, shot and killed 23-year-old Miree in a nighttime robbery at his Macy Place home April 16.

    Judges in Mobile County have repeatedly denied her lawyer’s requests to set a bail amount. Circuit Judge Sarah Stewart in an August hearing said Felicia Lee posed a danger to the community.

    “While this court is not unsympathetic to Judge Stewart’s concerns, Lee has an absolute, constitutional right to pretrial bail,” the appeals court wrote in its Dec. 20 ruling.

    The Alabama Supreme Court has found that defendants have a right to bail in all cases that don’t involve the death penalty, according to the ruling.

    Lee faces two counts of intimidating a witness, a Class C felony. In general, the Alabama Supreme Court has recommended bail between $2,500 and $15,000 for a Class C felony.

    The appeals court noted that the Mobile County Circuit Court “is not without a remedy” and can raise the bail amount and add restrictions.

    Felicia Lee’s attorney, Sid Harrell, who appealed to the higher court, said he hopes the bail will be reasonable, although he’s not certain Lee can afford to pay for her own release.

    “Alabama case law states that you are entitled to a bond on a Class C felony, and I’m glad the Court of Appeals ruled in my favor,” Harrell said Monday.

    Harrell said he hopes a bail hearing will be held this week.

    Michael Lee and three other young men — Bo Ellis Taylor, 18; Jamal Breon Lang, 20; and Ernest Teryl Wiggins, 20 — allegedly barged into Miree’s house and demanded money. Miree was shot in the head. The foursome had been driving around Mobile, looking for someone to rob, according to police.

    The four men, who face the death penalty, also are being held in jail with no bail.

    According to a complaint filed in Mobile County District Court, Felicia Lee approached a witness in the case after a court hearing at Mobile Government Plaza in August.

    The witness claimed that Lee approached her outside the courthouse and said, “I’m going to kill you” and “if he don’t get bond, I’m coming to shoot your house up,” according to the complaint.

    Another complaint contends that Felicia Lee pointed a gun and hurled threats at the witness while driving by her house July 25, hours after Lee’s son was arrested.

    Mobile County District Attorney John Tyson Jr. said prosecutors will be asking for “as high a bond as we can possibly get under these circumstances.”

    “We argued in the first place for no bond because of the seriousness and the urgency of the threats that were being made,” Tyson said. “We had good reason to make those arguments, and we have no information that would change our mind on that.”

    Miree, a Vanderbilt University graduate and Birmingham native, worked as an engineer at the Chevron Corp. refinery in Pascagoula. He lived on Macy Place with a roommate, who had left the house shortly before Miree was killed.

    Intimidating a witness carries a maximum punishment of 10 years in prison.

    Miree murder suspects denied youthful offender status

    Three men accused of killing Kyser Miree were denied youthful offender status Thursday afternoon. Jamal Lang, Bo Taylor and Michael Lee also plead not guilty to capital murder.

    The four were indicted for Miree’s murder in November 2010.

    Investigators have said the men forced their way into Miree’s home on Macy Place. Miree reportedly plead for his life before he was shot in the head.

    Lee is accused of pulling the trigger, but all four could face the death penalty.

    Lang and Taylor will be back in court August 17. Michael Lee's trial is set for December 5.

    A Mobile County circuit judge this week refused to move the capital murder trial of Michael Lee, the accused shooter in the slaying of Kyser Miree in Midtown Mobile.

    Circuit Judge John Lockett ruled against the defense's argument that widespread news coverage of the case means the trial should be moved to another area before jury selection begins.

    Lee, 21, is accused of attempting to rob Miree -- with three accomplices -- after knocking on Miree's front door on Macy Place in April 2010.

    According to prosecutors, Lee demanded money from Miree then shot him in the head.

    A few months passed with no arrests in the case, leading to widespread public interest and media coverage of the slaying.

    "After examining the totality of the facts, the court finds that the Mobile community has not been pervasively saturated with prejudicial and inflammatory publicity," Lockett wrote. "While the media coverage in this case is arguably extensive, it has not been inflammatory or sensational to a degree that supports a claim for presumptive prejudice."

    Lockett said that once questioning of potential jurors begins in June, any issues with clear prejudice among jurors will be addressed at that time.

    Lee's capital murder trial is set to begin June 5. He faces life in prison without parole or the death penalty, if convicted.

    Jury selection begins Tuesday in the capital murder trial of Michael Lee.

    Lee is accused of shooting 23-year-old Kyser Miree in the head during a robbery in 2010.

    Investigators said on April 16, 2010, four suspects watched a man remove cash from an ATM and then followed him to a home on Macy Place.

    Inside was 23-year-old Kyser Miree, a Vanderbilt graduate who worked as an engineer.

    While the four suspects parked their car, the man who used the ATM picked up Miree’s roommate and left.

    Soon after, authorities say the four men brought guns and shoved their way inside Miree’s home and demanded money.

    "The testimony is he was knocked to the floor. He's on the floor, got his hands up and he is begging for his life and they pull the trigger anyway," said Mobile County District Attorney John Tyson, Jr. in 2010.

    Miree died at a hospital from the gunshot wound to the head.

    A few months later, Mobile police made four arrests in the case: Bo Taylor, Earnest Wiggins, Jamal Lang and Michael Lee.

    They're all charged with capital murder.

    Michael Lee will be tried first and jury selection for his trial will begin Tuesday morning. If convicted, Lee could face the death penalty.

    Last month, Lee's defense attorneys asked a judge to move the trial, due to the extensive media coverage. The judge denied that request, saying a fair jury can be found in Mobile County.

    Ben Miree, Kyser's father, said, "My wife and I will be glad to get to the other side of this process so we can heal and go on."

    Kyser Miree slaying: Lawyers select 16-member jury, trial begins Monday

    A jury of 12 women and four men will hear testimony in the capital murder trial of Michael Lee, the accused killer of Kyser Miree in midtown Mobile.

    Lawyers today selected 16 people, including four alternates after an arduous jury selection process that started Tuesday. Twelve jurors will eventually deliberate the case.

    Lee, 21, is accused of shooting Miree, a Birmingham native and engineer in Pascagoula, after barging into his Macy Place house and demanding money at gunpoint on April 16, 2010.

    The prosecution and defense both said today that they believe a fair jury has been chosen.

    “It’s been a long week,” Assistant District Attorney Jill Phillips said. “It’s been a painstaking process.”

    Defense attorney Art Powell said that it’s time now to get to “the real facts of the case.”

    “We think we’ve got a very fair jury that’s very capable of listening to the evidence,” Powell said.

    About 40 remaining jurors from an original pool of 89 people reported to Circuit Judge John Lockett’s courtroom on Friday for the announcement of who was selected.

    As dozens of jurors who weren’t chosen left the courtroom, one of them discretely leaned in and whispered something to Miree’s mother, who was seated near the exit.

    The woman, Nan Jemison of west Mobile, told the Press-Register later that she has children about the same age as both Lee and Miree at the time he was killed.

    “I told her I’d be praying for her,” Jemison said.

    Opening arguments are expected to begin Monday at 9 a.m. The trial could last as long as two weeks.

    The seemingly random killing of Miree sparked concerns about crime among residents around Mobile. The trial will likely receive widespread media coverage and public interest.

    Lockett gave a long list of instructions to the jurors before releasing them for the weekend.

    He told them not to discuss the case with anyone, including spouses or close friends. He warned against using any form of social media to discuss the case, and he banned jurors from independently investigating any issues from the trial on the Internet.

    He also told jurors to stay away from newspaper or TV news reports about the trial.

    Lee faces life in prison without parole or the death penalty, if convicted.

    If the jury were to issue a guilty verdict, jurors would then hear testimony in the punishment phase of the trial. The panel would be asked to recommend a punishment for Lee, although Lockett would make the ultimate decision.

    Three alleged accomplices to Lee have also been charged with capital murder. The prosecution has indicated that the jury will hear testimony from the accomplices in Lee’s trial.
