    Attorney Questions Alleged Cop Killer’s Mental State

    A young man accused of murdering a capital city police officer makes his first court appearance.
    And his attorney is already raising questions about whether the suspect is competent to stand trial.
    During a brief court appearance late Monday morning, Latwan Smith’s attorney entered a “not guilty” plea on his behalf.
    His attorney, Public Defender Alison Kelly says Smith appeared to be delusional and paranoid in court.
    Kelly plans to request a mental evaluation to determine if Smith is competent to stand trial for the shooting death of rookie Jackson police officer Glen Agee.
    Agee died at UMC Friday night from a gun shot wound to his face.
    Agee had just joined the force in June, but he has been in law enforcement for years.
    Agee and another officer were taking Smith to the Hinds County jail in Raymond.
    Smith escaped from the patrol car by opening the back door.
    One of the officers lowered the rear window after Smith complained he couldn’t breathe.
    Smith took off running toward a wooded area behind the Sonic drive in on Highway 18 and
    County Farm Road.
    Agee ran after him.
    Investigators say both men ended up in a small drainage canal filled with five feet of water.
    Authorities tell us the officer struggled with Smith, and at some point his service revolver went off hitting him once in the face.
    Investigators have not yet found the gun.
    Smith is charged with capital murder. If convicted he could face the death penalty.

    Impound slain Jackson officer's cruiser

    An attorney for the man accused of killing Jackson police officer Glen Agee filed a motion Thursday asking that Agee's patrol cruiser be preserved as evidence.

    Latwan Smith's preliminary hearing in Hinds County Court was canceled. But his attorney, Assistant Public Defender Alison Kelly, briefly argued a couple of motions on his behalf.

    Smith, 24, is charged with capital murder in the Aug. 6 shooting of Agee.

    "We ask that the cruiser be impounded for inspection," Kelly said. "We want to keep it intact as is."

    Hinds County Assistant District Attorney Armstrong Walters told Judge William Barnett the district attorney's office had no problem with the cruiser being inspected.

    Kelly said she couldn't discuss the reason for the motion.

    Agee, 31, and two other officers were taking Smith to the Hinds County Detention Center in Raymond when he escaped. Agee and a second officer were in the vehicle with Smith, and another officer was in a trailing vehicle.

    At Mississippi 18 and County Farm Road, the handcuffed Smith reached outside the window, opened the car door and ran, police said. Agee caught up with Smith in the ravine, a struggle ensued and Agee was shot, police said.

    Agee had been on the Jackson force less than three months. He previously held law enforcement jobs with other agencies.

    The events that led to the shooting began when police responded to a domestic violence call in south Jackson involving Smith and his girlfriend, police said.

    According to an incident report obtained by The Clarion-Ledger through a public records request, Smith allegedly waved and pointed a .380-caliber pistol at a woman as they sat in her vehicle.

    Smith allegedly slapped and bit the woman's face and threatened to kill her and her family, the report said.

    A defense motion was granted Aug. 10 allowing Smith to undergo mental evaluation. Barnett also ordered Smith's mental records to be produced.

    During Smith's initial appearance, he made numerous incoherent outbursts. Police and prosecutors have said they believe Smith was pretending. Smith's family members, however, say he has been a paranoid schizophrenic all his life.

    The district attorney's office has said it will seek the death penalty.

    Agee Killed After Prisoner Escapes


    A judge has set a trial date for a man indicted on charges stemming from the August shooting death of a Jackson police officer.

    Latwan Smith, 24, was arraigned Thursday before Hinds County Circuit Judge Malcolm Harrison on charges of capital murder, being a felon in possession of a firearm and escape.

    Smith pleaded not guilty to the charges, court officials said. Harrison set Smith's trial for Sept. 5, 2011.

    The Hinds County district attorney said he plans to seek the death penalty in the case.

    Officer Glen Agee, 31, and two other Jackson police officers Smith on Aug. 6 to the Hinds County Detention Center in Raymond when he escaped from the car and ran into the woods off Highway 18 near Raymond, police said. Agee went after Smith, police said. The two men struggled and Smith is accused of shooting Agee with the officer's gun, police said.

    Smith's family members said he has a mental condition.

    District attorney says he will seek the death penalty

    The man accused of killing Jackson police officer Glen Agee will be tried Sept. 5, 2011.

    Latwan Smith, 24, of Jackson was in Hinds County Circuit Court on Thursday for his arraignment on charges of capital murder, being a felon in possession of a firearm and escape. He was recently indicted in the Aug. 6 shooting.

    Through his attorney, Assistant Public Defender Alison Kelly, Smith pleaded not guilty.

    "Not guilty" echoed out two more times on the charges of being a felon in possession of a firearm and escape.

    In most cases, defendants waive formal reading of their indictment. But Kelly asked that all the charges against Smith be read aloud. No reason was given in the nearly full courtroom.

    Also, in reading the indictment, Assistant District Attorney West Brewer noted that Smith had been previously convicted of motor vehicle theft in Hinds County and grand larceny in Rankin County.

    The arraignment lasted a few minutes.

    Circuit Judge Malcolm Harrison then set the trial date.

    Smith was remarkably calm in court compared to his initial court appearance just days after the shooting. In August, he made numerous incoherent outbursts in court. Police and prosecutors have said Smith appeared to be pretending.

    But Smith's family members have said he has been a paranoid schizophrenic all his life.

    Smith is expected to undergo a mental evaluation at the Mississippi State Hospital at Whitfield prior to trial. A defense motion for him to undergo a mental evaluation was granted Aug. 10 in Hinds County Court. But Harrison, who was assigned the case after the indictment, must sign off on ordering a mental evaluation.

    Hinds District Attorney Robert Shuler Smith has said his office will seek the death penalty in the case.

    And if Latwan Smith is convicted of capital murder, whether the prosecution can seek the death penalty depends on the outcome of either test.

    In 2002, the U.S. Supreme Court determined it is unconstitutional to execute the mentally retarded. Courts have ruled that a defendant mentally in-sane at the time of a crime cannot be put to death.

    Both the prosecution and defense support Smith undergoing a mental evaluation at the Mississippi State Hospital to determine whether he was sane when Agee was shot with his own service revolver Aug. 6, based on an order filed Friday.

    Also, the order, signed by Hinds County Circuit Judge Bill Gowan, says doctors should determine whether Smith is mentally retarded.

    Smith's family members have said he has been a paranoid schizophrenic all his life, but his intelligence level has not been a public issue. A combined IQ less than 75 places a person in the area of mental retardation.

    Smith's attorney, Assistant Public Defender Allison Kelly, said she couldn't discuss the case.

    District Attorney Robert Shuler Smith said he certainly doesn't believe Latwan Smith is mentally retarded.

    "I think it's something they are trying to run with," he said of the defense.

    The district attorney has said he intends to seek the death penalty. Latwan Smith's trial is set for September.

    "We can't pursue the death penalty based upon the law," Hinds County District Attorney Robert Shuler Smith said. "But that does not mean that a person is not competent to stand trial."

    Latwan Smith, no relationship to the district attorney, is charged with capital murder in Agee's death. His trial is set for Aug. 13.

    Latwan Smith pleaded guilty to charges of manslaughter and being a felon with a firearm. He had been facing a capital murder charge in connection with Agee's death.

    Smith was sentenced to 40 years, 10 of which were suspended.

    Smith was accused of shooting Agee with the officer's service weapon after an altercation, police said.

    Agee and his partner were transporting Smith to the Hinds County Detention Center on Aug. 6, 2010. Smith managed to slide his handcuffed hands through a cracked car window and open the car door, police said.

    Smith ran into the woods off Highway 18, and the officers followed.

    Police found Smith about 45 minutes after he escaped. His handcuffs were still on, but somehow he had gotten them to the front of his body, they said.

    Later, they found Agee with gunshot wounds to his face, police said. Agee, a Collins native, had been a Precinct 1 officer with the Jackson Police Department for only two months, authorities said.

    Smith's attorney said his client is schizophrenic and bipolar, but is on medication
