    Jury weighs death penalty for 39-year-old in double slaying


    The penalty phase for a 39-year-old Las Vegas man convicted of murder earlier this week for the slaying of two prostitutes is expected to begin today.

    It took a jury only a couple of hours Tuesday to convict Jason McCarty of 15 felonies and one gross misdemeanor, including two counts of murder with a deadly weapon, kidnapping and robbery, after a nearly monthlong trial.

    The same jury will next decide whether McCarty should be sentenced to death for the May 2006 beating deaths of Victoria Magee, 26, and Charlotte Combado, 34, who were found slain in the desert in Henderson.

    Authorities said Domonic "D-Roc" Malone was the victims' pimp and had threatened to bury them in the desert if they didn't make him money when he dropped them off at the Hard Rock.

    McCarty helped Malone with the slayings, authorities said.

    Malone's trial was delayed because of the length of McCarty's trial. Malone's trial is scheduled for June 6.

    A third co-defendant, Donald Herb, pleaded guilty in August 2006 to accessory to murder and agreed to testify against McCarty and Malone.

    A 39-year-old Las Vegas man received two death sentences Thursday for killing two prostitutes in 2006.

    The same jury last week convicted Jason McCarty of 15 felonies and one gross misdemeanor, including two counts of murder with a deadly weapon, kidnapping and robbery, after a nearly monthlong trial.

    Authorities said McCarty along with Domonic "D-Roc" Malone in May 2006 beat to death with a golf club and rocks Victoria Magee, 26, and Charlotte Combado, 34, whose bodies were found in the desert in Henderson.

    Malone had threatened to bury the two women in the desert if they didn't make him money when he dropped them off at the Hard Rock Hotel.

    Malone, who is representing himself, is scheduled to stand trial June 6.

    A third co-defendant, Donald Herb, pleaded guilty in August 2006 to accessory to murder and agreed to testify against McCarty and Malone.

    An appeal is expected as is done in all capital cases. Appeals in death penalty cases can take more than a decade.

    After a jury trial, Defendant was convicted of two counts of first-degree murder with the use of a deadly weapon, one count of conspiracy to commit murder, and related crimes. Defendant was sentenced to death for each murder. The district court denied Defendant’s motion to suppress statements he made in two interviews with police after his initial appearance before a magistrate. The Supreme Court reversed, holding (1) the district court did not err in denying Defendant’s motion to suppress, as his Sixth Amendment right to counsel attached at his initial appearance before the magistrate, but Defendant waived his right to have counsel present at the subsequent interviews; but (2) the district court clearly erred when it rejected Defendant’s objection under Batson v. Kentucky to the State’s use of a peremptory challenge to remove an African American from the venire during jury selection. Remanded.
