    Appeals Court Upholds Conviction Of Oklahoma Death Row Inmate

    A divided federal appeals court has upheld the conviction and death sentence of an Oklahoma prison inmate who killed a Department of Corrections employee.

    The 10th Circuit Court of Appeals in Denver rejected appeals of 52-year-old John Grant -- who was convicted and sentenced to die for the 1998 stabbing death of Gay Carter after Carter had removed Grant from a job in the prison kitchen.

    The three-judge panel rejected claims of faulty jury instructions, constitutional violations, improper victim impact statements and ineffective defense counsel.

    Chief Judge Mary Beth Briscoe dissented with the majority ruling that Grant's attorney was not ineffective.

    Grant was serving a 35-year term for a 1980 robbery conviction when he stabbed Carter 16 times with a home-made knife after dragging her into a small closet.

    The Oklahoma Court of Criminal Appeals has set Dec. 4 as the execution date for a death row inmate convicted of first-degree murder in the 1998 stabbing death of a Department of Corrections employee.

    The court scheduled the execution Wednesday for 53-year-old John Marion Grant. Grant was sentenced to death for the killing of corrections worker Gay Carter, who was stabbed 16 times at the Dick Connor Correctional Center in Hominy.

    Grant's execution would be the third since the state suspended executions pending an investigation into the botched April 29 execution of Clayton Lockett. Charles Warner is scheduled to die Nov. 13 for raping and killing his roommate's daughter. Richard Eugene Glossip is scheduled to be executed Nov. 20 for the 1997 death of a 54-year-old man.

    OKLAHOMA CITY — The Oklahoma Pardon and Parole Board on Monday set an execution date for Osage County killer John Marion Grant.

    Grant is set to die Dec. 4 for the 1998 murder of Gay Carter, a food service supervisor at the Dick Connor Correctional Center in Hominy, where he was serving time.

    According to court records, Grant was fired from his job in the prison kitchen for fighting with another inmate. After that, he threatened Carter.

    He pulled her into a mop closet, covered her mouth and stabbed her several times in the chest, according to court records. She had 16 stab wounds, one of which punctured her aorta, according to court records.

    Grant had prior convictions for burglary and robbery.

    His clemency hearing is set for 1 p.m. Nov. 21.

    The Pardon and Parole Board also set a 1 p.m. Oct. 24 clemency hearing for Oklahoma County killer Richard E. Glossip.

    Glossip is set to die Nov. 20 for his role in the 1997 death of Barry Van Treese, who owned the Best Budget Inn in Oklahoma City where Glossip worked.

    Justin Sneed, who did maintenance work at the motel, admitted to killing Van Treese at Glossip’s instructions, according to court records.

    Van Treese had suspected financial irregularities at the motel, according to court records.

    Oklahoma County killer Charles F. Warner is set to die Nov. 13 for the 1997 killing his roommate’s daughter, Adrianna Waller, who was 11 months old.

    He was also convicted of her rape.

    The Pardon and Parole Board earlier this year denied clemency for Warner.

    Official: Oklahoma not ready for Nov. 13 execution

    Oklahoma's attorney general is seeking to delay three upcoming executions, including two set for next month, saying the state needs more time to obtain drugs and train staff on new lethal injection protocols put in place after an execution went awry in April.

    Attorney General Scott Pruitt filed a notice late Friday seeking to delay the executions of Richard Eugene Glossip, John Marion Grant and Charles Warner until 2015. Warner had been originally scheduled to die on April 29 — the same night that inmate Clayton Lockett writhed and moaned on the gurney, prompting the state to put all executions on hold until a review was conducted.

    Warner's new execution date is Nov. 13, but Pruitt said in the court filing that Oklahoma does not have the necessary drugs or commitments from medical personnel to carry out the execution.

    "The state does not want to rush implementation of this new training program, especially so soon after revision of the execution protocol," Pruitt wrote. "The additional requested time for all three executions will allow (the Oklahoma Department of Corrections) sufficient time in which to obtain the necessary drugs and medical personnel and to fully and thoroughly train each member of the new execution team."

    The director of the Oklahoma Department of Corrections, Robert Patton, released a statement Monday saying the agency appreciated the request for a 60-day delay.

    Pruitt asked that Warner's execution be reset for no earlier than Jan. 15, with Glossip's and Grant's executions to follow.

    The three are among 21 death row inmates who have sued the state seeking to block their executions, arguing that by tinkering with the lethal injection chemicals, the state is experimenting on death row inmates and violating the U.S. Constitution's ban on cruel and unusual punishment.

    An attorney for Warner, Dale Baich, said the delay will allow more time to determine if Oklahoma's lethal injection system, including its new protocols, is constitutional.

    "The discovery process in the pending federal litigation is underway and time will be needed for court review," Baich said in a statement.

    A review from the Oklahoma Department of Public Safety blamed an improperly placed intravenous line, and not the combination of lethal drugs, for the troubles in Lockett's execution. The investigation recommended more training for the execution team and more detailed contingency plans, including a backup set of drugs.

    Prison officials last week unveiled a newly renovated execution chamber inside the Oklahoma State Penitentiary that includes more space for the executioners to operate, new audio and video equipment, and an ultrasound machine to help locate veins.

    Warner was convicted in the 1997 rape and murder of 11-month-old Adrianna Walker, his roommate's daughter.

    TULSA — The executions of three Oklahoma inmates have been delayed after courts granted the state's move for 60-day stays to allow more time to obtain the necessary drugs.

    State officials had announced changes in the execution protocols and said they would go forward as scheduled after the execution of Clayton Lockett went bad, leaving him gasping and struggling on the gurney.

    But weeks later, Attorney General Scott Pruitt filed for the delay.

    KRMG found online court records indicating the executions of three men have been pushed back.

    Charles Warner was supposed to die on November 13th, but his execution has been rescheduled for January 15th.

    He was convicted of raping and murdering an 11-month-old girl, his girlfriend's daughter, in 1997.

    Richard Glossip was also convicted for a 1997 murder, that of his boss at a motel.

    His November 20th execution has been pushed to January 29th.

    Finally, John Grant will be executed February 19th instead of December 4th.

    He murdered a fellow prisoner with a screwdriver while serving a sentence for burglary and robbery.
