    Summary of Offense:

    He was convicted in 2000 of stabbing to death prison cafeteria worker Gay Carter in 1998 at the Dick Conner Correctional Facility near Hominy. Grant had been in prison since 1980, serving various felony sentences from Oklahoma and Cleveland counties.

    Grant has been on death row since May 9, 2000.

    On January 3, 2011, Grant filed an appeal in the US Court of Appeals for the Tenth Circuit over the denial of his habeas petition in Federal District Court.

    Appeals Court Upholds Conviction Of Oklahoma Death Row Inmate

    A divided federal appeals court has upheld the conviction and death sentence of an Oklahoma prison inmate who killed a Department of Corrections employee.

    The 10th Circuit Court of Appeals in Denver rejected appeals of 52-year-old John Grant -- who was convicted and sentenced to die for the 1998 stabbing death of Gay Carter after Carter had removed Grant from a job in the prison kitchen.

    The three-judge panel rejected claims of faulty jury instructions, constitutional violations, improper victim impact statements and ineffective defense counsel.

    Chief Judge Mary Beth Briscoe dissented with the majority ruling that Grant's attorney was not ineffective.

    Grant was serving a 35-year term for a 1980 robbery conviction when he stabbed Carter 16 times with a home-made knife after dragging her into a small closet.

    Oklahoma death row inmates seek drug protocol ruling, stays

    Attorneys for four Oklahoma death row inmates are appealing to the U.S. Supreme Court to overturn a 10th Circuit Court ruling that approved the state's execution drug protocol.

    Attorneys for Charles Warner, Richard Eugene Glossip, John Marion Grant and Benjamin Robert Cole have also requested stays of their scheduled executions, pending the appeal.

    The documents filed Wednesday allege that the use of midazolam (mih-DAY'-zoh-lam) in a three-drug mixture to perform an execution is unacceptable because it cannot reliably produce "a deep, comalike unconsciousness."

    The drugs were first used in Oklahoma in the April 29 execution of Clayton Lockett, whose lethal injection went awry after an intravenous line failed.

    Warner is scheduled to die Thursday, Glossip on Jan. 29, Grant on Feb. 19, and Cole on March 5.

    Oklahoma attorney general says he'll request new execution date if alternative drugs are found

    While the U.S. Supreme Court considers the constitutionality of a sedative Oklahoma uses in lethal injections, Attorney General Scott Pruitt says he'll push to resume executions.

    Pruitt said Thursday that if the state can obtain doses of barbiturates Oklahoma has used to execute inmates in the past, he'll ask the Oklahoma Court of Criminal Appeals to set new execution dates.

    That may be difficult, though. Oklahoma switched to the current method it uses when supplies of some drugs dried up.

    The U.S. Supreme Court on Wednesday delayed three executions, including one that had been scheduled for this week. The court will decide whether the sedative midazolam appropriately renders an inmate unconscious before additional drugs are administered to shut down the lungs and heart.

    After ruling, Oklahoma prepared to carry out 3 executions

    OKLAHOMA CITY — Oklahoma officials said they are prepared to move forward with three previously scheduled executions after Monday's U.S. Supreme Court ruling upholding the use of one of the drugs the state uses in its lethal injection protocol.

    Oklahoma prison officials have access to the sedative midazolam and the other drugs needed to carry out the executions of Richard Eugene Glossip, John Marion Grant and Benjamin Robert Cole, Department of Corrections spokeswoman Terri Watkins said.

    All three inmates were plaintiffs in the case challenging the use of midazolam as the first in a three-drug lethal injection formula, but the Supreme Court justices voted 5-4 that using the drug does not violate the U.S. Constitution's prohibition against cruel and unusual punishment.

    The drug was used for the first time in Oklahoma for the execution of Clayton Lockett last year. Lockett writhed on the gurney, moaned and clenched his teeth for several minutes before prison officials tried to halt the process; he died after 43 minutes. After the Lockett execution, Oklahoma increased by five times the amount of midazolam it uses and executed Charles Warner in January. He complained of a burning sensation but showed no other obvious signs of physical distress.

    Both of Oklahoma's lethal injection protocols for using midazolam now call for the increased dosage.

    Oklahoma Attorney General Scott Pruitt's office is expected to notify the Oklahoma Court of Criminal Appeals that the three inmates have exhausted their appeals. The court then will set execution dates.

    "The families in these three cases have waited a combined 48 years for justice," Pruitt said in a statement. "Now that the legal issues have been settled, the state can proceed with ensuring that justice is served for the victims of these horrible and tragic crimes."

    Glossip, 52, was convicted of hiring a co-worker to beat his boss, Barry Alan Van Treese, to death in 1997 at a south Oklahoma City motel. Grant, 54, was sentenced to death for stabbing corrections worker Gay Carter to death in 1998 after Carter had removed Grant from a job in the prison kitchen.

    Cole, 50, was convicted of first-degree murder in Rogers County for the December 2002 beating death of his 9-month-old daughter, Brianna Cole.

    Glossip and Grant both already have been denied clemency by the Oklahoma Pardon and Parole Board. A clemency hearing for Cole will be scheduled once his execution date has been set.

    Midazolam was also used in executions that took longer than usual in Arizona and Ohio last year.

    The Oklahoma Court of Criminal Appeals has set execution dates for three death row inmates who had challenged a drug that will be used in their lethal injections.

    The court on Wednesday set execution dates of Sept. 16 for 52-year-old Richard Eugene Glossip, Oct. 7 for 50-year-old Benjamin Robert Cole, and Oct. 28 for 54-year-old John Marion Grant.

    The three inmates had argued that the sedative midazolam that the state plans to use to execute them presents an unconstitutional risk of pain and suffering because it doesn't properly render a person unconscious.

    The U.S. Supreme Court ruled last month in a 5-4 decision that the drug can be used.
