    Well that flips the 11th(one more seat is going to be open but it’ll be a republican replacement for another republican). Hear that in the background it’s every death row inmate slowly coming to the realization that their odds in federal court just dropped by at least 40%.

    As a gay Jew I don’t even get why anyone would say originalists wouldn’t have voted to end same sex marriage bans or Jim Crow. The 14th amendment is pretty clear that you can’t deny a govt offered service unfairly. It even makes sense with allowing abortion bans and allowing the execution of so called special criminals(retardation and juveniles) since the 14th only covers govt offered services(the govt doesn’t do abortions) and the 4th only applies to physical searches of ones person/property, and the 8th only covers something cruel, and unusual which only would mean you can’t execute those people if the method was always painful AND they were the only one to receive it.

    Today both nominations for the Ninth were reported out of committee. I guess we can expect confirmation in two weeks.

    Ozerden for the Fifth is still not moving, I guess it's time they sink the nomination and nominate a more solid candidate.

    Bumatay and VanDyke both seem solid enough although I'm pretty sure VanDyke cried over being called a bigot but that could just be nerves. These hearings aren't supposed to be character assassinations.

    I can see someone crying over a surprise from behind character smear, especially someone who’s originally from MT or any other mountain state people there then to take things like that pretty hard.

    Does anyone know how solid this guy is? I know he drew intense opposition from the dems but they always fervently oppose minorities that stray.

    If anything he leans libertarian. Gay and non-white; I can see why a few Dems decided to abstain.

    He’s conservative tho more a rand Paul type than Bush type. He’s opposed because he has a great resume and has future SCOTUS pick written all over him

    Trump secures 50th appellate court appointment, with another Ninth Circuit judge confirmed

    The Republican-controlled Senate on Wednesday afternoon confirmed Lawrence VanDyke to the Ninth Circuit Court of Appeals, marking President Trump's 50th successful appellate court appointment in just three years in office, and his second to the historically liberal Ninth Circuit in as many days.

    By contrast, President Barack Obama nominated a total of 55 circuit judges who were confirmed over eight years -- and Obama's nominees were, on average, approximately ten years older. The White House has dramatically transformed the Ninth Circuit, a powerful court with jurisdiction over nine states that has long been a thorn in the president's side.

    Of the 29 active seats on the Ninth Circuit, 10 have now been appointed by Trump, and 14 by Republican presidents. Only nine of the court's 19 semi-retired "senior status" judges were appointed by Democrats, with 10 by Republicans. That's a major change from early last year, when only six of the active judges on the Ninth Circuit were chosen by Republicans.

    "FIFTY CIRCUIT COURT JUDGES!" tweeted Carrie Severino, the conservative Judicial Crisis Network's chief counsel and policy director. "Despite unrelenting Democratic obstruction and smear campaigns," she wrote, Trump and his Senate allies "have answered the call of the American people."

    VanDyke's confirmation, by a 51-44 vote, came just 24 hours after Patrick Bumatay, an openly gay Filipino man, was also seated on the San Francisco-based Ninth Circuit. Both nominees were fiercely opposed by Democrats, including the senators from their home states -- Nevada Sens. Jacky Rosen and Catherine Cortez Masto for VanDyke, and California Sens. Dianne Feinstein and Kamala Harris for Bumatay.

    Senate confirms Alabama Judge Andrew Brasher for federal appeals court post

    A Montgomery federal court judge was elevated to a seat on a federal appeals court Tuesday after the U.S. Senate voted along party lines confirming Judge Andrew Brasher to the 11th U.S. Circuit Court of Appeals.

    Brasher, who quickly rose up the ranks from Alabama’s solicitor general to a federal judgeship, was confirmed in a 52-43 vote in the Senate. His nomination faced criticism from the Alabama NAACP and other groups, who contended that he would be unfair to African Americans after he supported gutting key provisions of the Voting Rights Act of 1965.

    Brasher, who was nominated by President Trump for the post in November, was rated qualified by the American Bar Association.

    Sen. Richard Shelby, R-Ala., applauded his colleagues for confirming Brasher.

    “I believe Judge Brasher has served with impartiality, integrity, and purpose as a district judge, and I am confident he will continue to do so in this new capacity,” the senator said in a statement. “I commend President Trump on his decision to nominate Judge Brasher to the Eleventh Circuit and know that his dedication to justice will contribute to the respected standards of our nation’s judicial system.”

    Shelby’s Democratic counterpart, Sen. Doug Jones, voted against confirming Brasher.

    “Sen. Jones did not support his nomination to the district court and has not seen any new information that would change his position," a Jones spokeswoman told AL.com. "That being said, Judge Brasher currently serves on the bench and Senator Jones wishes him well going forward.”

    With Brasher’s confirmation to the 11th Circuit – which has jurisdiction over federal appeals cases in Alabama, Georgia and Florida --, Trump has appointed half of the active judges on the circuit, according to Carl Tobias, a professor at the University of Richmond School of Law and an expert on federal judicial nominees.

    Alabama Attorney General Steve Marshall, who worked with Brasher for part of Brasher’s tenure as solicitor general, called the confirmation a “victory for the rule of law.”

    “Judge Brasher’s deep record of public service, combined with his impeccable legal credentials, more than qualify him for a seat on the 11th Circuit Court of Appeals,” Marshall said in a statement. “I am especially proud of his contributions as solicitor general for the state of Alabama, where he successfully argued cases before the Alabama Supreme Court, the 11th Circuit Court of Appeals and the U.S. Supreme Court. Without a doubt, Judge Brasher will bring a renewed focus to upholding the law as he assumes his new position on the federal appeals court.”
