I hope the 3rd Circuit rules NJ's may issue concealed carry law unconstitutional.

And as I've mentioned a few times, I have big concerns about democrats overriding the blue slip when they get back in power.

Although you can make an argument that bending the blue slip is inevitable and republicans might as well take advantage of it while they're in power.

Seeing how judges like Reinhardt, Pregerson, and Sotomayor got onto the courts, I think we will see more of the same, activist judges. All these rules in place didn't stop them from getting onto the bench.

That's because democrats controlled the senate and they were nominated in states with two democratic senators who returned blue slips or didn't need a blue slip on the Supreme Court.

What democrats couldn't do with the blue slip was put judges like that in states with two republican senators like the 5th circuit that republican senators could keep open for Trump to fill.

With the blue slip gone a democratic president and democratic senate could now pack the 5th or 11th circuit against the wish of the states two republican senators.

Speaking of Reinhardt and Pregerson, a hearing to fill their seats is tomorrow.

First and foremost, NJ's magazine restrictions need to be brought before an en banc court. The constitution will win, especially when Trump fills the other vacancy and the court is 8 to 6.

The democrats probably will take power in 2020, so it is essential to pack as many young conservatives as possible. Don't let the next democrat president inherit a single vacancy.

Reinhardt and Pregerson were placed on the 9th Circuit back in the late 1970's. I doubt they had blue slips back then.

The senate was using blue slips for the CCA's since the 50's.

1917 is when they were created to be exact. They just didn't become political until the 90's.
