    1975 Murder Suspect Faces Death Penalty

    A man who killed a San Marcos college student in the 1970s will soon learn his fate.

    Willie Jenkins was found guilty of capital murder last week.

    Jenkins raped and killed Sheryl Norris in 1975.

    He was arrested for the murder in 2010 thanks to DNA evidence.

    The punishment phase of Jenkins' trial is underway and expected to last through next week.

    Prosecutors are seeking the death penalty.

    Jury considers death penalty in 1975 murder case

    A Hays County jury has started deliberations to decide if Willie Roy Jenkins will receive the death penalty in the 1975 murder of Sheryl Ann Norris in San Marcos.

    Jenkins was convicted of capital murder on May 31. The punishment phase of the trial has lasted for nearly two weeks. The jury left the courtroom at 12:07 p.m.

    Attorneys for the prosecution argued that Jenkins is a continuing threat to society because of his convictions in four rapes in California and Texas that occurred before and after Norris’s rape and murder in November 1975.

    The prosecution also presented evidence of brutal assaults allegedly committed by Jenkins against inmates and staff at the Coalinga State Hospital in California, where Jenkins was indefinitely committed by the state after he was released from prison.

    The defense argued that Jenkins is a product of his upbringing. Shuttled between the homes of family members and suffering abuse, Jenkins was raised in a poor area of Houston, defense attorney Norman Lansford said.

    The defense also argued that he was the victim of a predatory sexual relationship with his ex-wife, Merle Jenkins — 15 years older than Willie Jenkins, who was a high school student when they began seeing each other.

    The defense also argued that Jenkins, 59, is old and sick and should not receive the death penalty.

    The jury will decide whether to sentence him to death or life in prison.

    "In 2010, the introduction of new DNA technology allowed workers at the Department of Public Safety crime labs extract a more complete DNA profile and submit it to a national database. A hit came back a few weeks later for Jenkins, who was being held in the Coalinga State Hospital in California, under a civil commitment order. He was convicted of four rapes in California and Texas."

    This man raped. Then raped again. Then raped again. Then raped again, a fourth time.

    Thanks to Coker vs. Georgia, 433 U.S. 584 (1977), he could not be put to death unless he also happened to kill his victim. The Supreme Court in Coker ruled that rape of an adult woman was not "serious enough" to warrant the death penalty.

    Finally, he was caught committing a crime that allowed the jury to sentence him to death. Good news.

    Coker should be reversed. There are many criminals that deserve the death penalty for the crime of rape if the facts and circumstances of their crime(s) so warrant. Juries are well equipped to deal with these cases. Much more so than "unelected and unaccountable people in black robes" that live in a cloistered environment in Washington, D.C.

    Court affirms death sentence in San Marcos murder

    The state’s highest criminal court on Wednesday affirmed the murder conviction and death sentence for Willie Roy Jenkins in the 1975 sexual assault and murder of a 20-year-old San Marcos woman.

    Jenkins was identified in 2010 when his DNA profile — uploaded to a federal database after several rape convictions in Texas and California — matched a rape kit sample collected from the body of Sheryl Ann Norris. He was convicted and sentenced to death by a Hays County jury in 2013.
