    2 face charges in girl's death

    Jones County Sheriff's deputies made two arrests Monday in connection to the August death of a 2-year-old girl.

    Justin Barratt Blakeney, 26, has been charged with capital murder in the death of Victoria Viner.

    The child's mother, Lidia Guadalupe Ruiz Viner, 34, has been charged with contributing to the neglect or delinquency of a child; felonious abuse and/or battery of a child.

    The suspects remain in the Jones County jail. Bond has been denied for both.

    Jones County District Attorney J. Ronald Parish said the two suspects were dating and living together at the time of the incident.

    According to affidavits signed by Jones County Sheriff's Investigator Nick Messersmith, he responded to South Central Regional Medical Center on Aug. 10 for a possible child abuse call, where doctors said Victoria was suffering from a brain injury.

    Victoria was unresponsive at the time and had no visible signs of body trauma.

    The victim was transported to University Medical Center in Jackson the same day. She died there Aug. 12 from her injuries.

    A state crime lab autopsy report said the cause of death was blunt force trauma to the head and listed the manner of death as homicide.

    Parish said no weapons were recovered in the investigation.

    The affidavits said investigators learned Victoria had sustained several injuries since Blakeney began baby-sitting her during the day while her mother was at work. They also stated investigators saw photographs of the child with with black eyes and large bruises on her head.

    Blakeney was alone with Victoria at the time she sustained the fatal injury, according to the affidavits.

    Blakeney faces a maximum penalty of death if convicted of capital murder, which is defined as murder committed in the course of another felony. The affidavits say Victoria died while Blakeney was engaged in "felonious abuse and battery."

    Viner faces a maximum 10 years in prison.

    Alleged Jones County child killer hoped to gain Aryan Nation membership

    JONES COUNTY, MS (WDAM) - Court documents indicate an accused child killer in Jones County tried to use a little girl's death as a way to gain membership into the ultra white supremacist group known as the Aryan Nation Brotherhood.

    Justin Blakeney is awaiting trial on capital murder charges in the August 2010 death of Victoria Viner, 2. However, a recent jailhouse shakedown and search may have uncovered a motive for the murder.

    Victoria Viner died at a Jackson Hospital August 13, 2010. An autopsy indicated the toddler died as a result of blunt force trauma to the head. The mother's boyfriend Justin Blakeney was arrested three months later but has maintained his innocence.

    A search warrant last week on Blakeney's body and jail cell, plus statements from a confidential informant may shed some new light on his guilt or innocence. A confidential informant said to be a member of the Aryan Nation told authorities that Blakeney confessed to murdering the girl as a way of gaining membership into the organization.

    According to the informant, Blakeney said he placed a telephone book on top of the little girl's head and hit it as hard as he could with his fist. According to prosecutors, the mother of the child was Mexican making the child in Aryan Nation classification "a half breed." The search warrant also uncovered Aryan Nation literature in his cell and nearly a dozen tattoos on Blakeney's body that were added since his imprisonment, which is against state law. According to the prosecution those tattoos represent Aryan Nation symbols.

    Trial delayed for suspect in child's death

    A judge has postponed the trial of Justin Barratt Blakeney, who is charged with capital murder in the 2010 death of 2-year old Victoria Viner at a Jones County home.

    Blakeney was scheduled for trial on Nov. 18 in Jones County Circuit Court. It was delayed this week. No new trial date has been announced.

    Blakeney remains in the county jail without bond.

    Court records show Blakeney told medical personnel that the child fell from a stool and hit her head. The child died later at a Jackson hospital. An autopsy showed the cause of death as blunt force trauma.

    In 2011, the child's mother, Lidia Viner, pleaded guilty to felony child abuse. She was given a five-year suspended sentence.

    Child Murder Case: Motions hearing begins in Jones County

    Motion hearings for an alleged murder in Jones County is now underway.

    Eight motions were heard Monday morning in Jones County Circuit Court in the case of Justin Blakeney, who was indicted in 2010 to face capital murder charges in the death of his then-girlfriend's 2-year-old, Victora Viner.

    The defense attorney presented motions to Judge Billy Joe Landrum that would exclude certain testimonies from being used in trial, including that of Blakeney's ex-wife and a confidential informant. He has also requested a number of records from the jail- cell assignments, credit reports, phone calls, and the prosecution said they have handed over everything.

    "I've turned over to them every piece of evidence I have, and this was a hearing about other evidence," said assistant district attorney J. Ronald Parrish

    A search warrant was conducted this summer on Blakeney and his cell after a confidential informant told authorities Blakeney admitted to murdering Viner to join the white supremacist gang Aryan Nation. When the defense asked for the judge to advise the prosecution to obtain information on the gang as well as what questions will be asked of the confidential informant when presented as a witness, the judge told him to take it into his own hands in interviewing those people.

    "The state is trying like we have from the very beginning to bring this forward as quickly as possible and get it tried," said Parrish. "We haven't asked for a single continuance while this case has been on the docket."

    The defense said that Blakeney has the First Amendment right to join a gang and that should not be relevant toward a motive for murder. However, the prosecution said that Blakeney's freedom of speech does not give him the freedom to murder.

    "It's a stressful situation to live with a nightmare when you've got a little dead baby, trying to get somebody tried," said Parrish. "I'll continue to try to see it through to the bitter end."

    Blakeney is still awaiting his trial date.

    Justin Blakeney, who was indicted in 2010 to face capital murder charges in the death of his then-girlfriend's 2-year-old daughter Victoria Viner, appeared in court again Wednesday. It was supposed to be the final motion hearing before trial, but things did not turn out as planned.

It's been almost four years since the death of the little girl, and Blakeney still awaits trial on Capital Murder charges in her death. Viner died at a Jackson hospital in August, 2010. An autopsy indicated the toddler died as a result of blunt force trauma to the head.

    "We had a motion for a continuance filed by the defendant and some other motions for subpoena duces tecum. We're going to conclude this tomorrow at 1:30," said Jones County Assistant District Attorney, J. Ronald Parrish.

    Blakeney glanced around the courtroom with an amused expression at Wednesday's hearing.

    Parrish says he can't talk about any evidence in the case, but that people "know what they know."

    "The court made certain rulings and I prepared orders, and in accordance with the rules, I signed off on them and gave them to Mr. Parrish.," said Defense Attorney William LeBarr.

    When the trial begins in February, the jury will have three options:

    "Life, life without parole, and death," said Parrish.

    Another motion hearing in this case will take place Thursday afternoon at 1:30.

    Jones County Circuit Court Judge Billy Joe Landrum has declared a mistrial in the trial of Justin Blakeney.

    Landrum said it was impossible to fill the jury with enough people to continue.

    Alleged Jones County child killer requests change of venue

    A Jones County man charged with capital murder in the August 2010 killing of his girlfriend's daughter is seeking a change of venue.

    "It's been a constant fight on behalf of the state of Mississippi to try and resolve this," said J Ronald Parrish. "I'm going to see it through, as I've said before, to the bitter end."

    Justin Blakeney, who allegedly murdered two-year-old Victoria Viner by pounding a telephone book to her head, will appear before a new jury as soon as the region of selection is determined. Blakeney's lawyer said Tuesday before Judge Billy Joe Landrum that the influence of WDAM's coverage will require the jury selection to take place outside of the station's eight-county viewing area.

    "Wehn I walk in my office every day, on the back wall, the first thing I see is a picture of this little girl," said Parrish. "I want justice in this case for her and for Mr. Blakeney."

    Prosecuting lawyer and assistant district attorney J. Ronald Parrish said he is ready to move forward with the case immediately.

    "I've been ready to go with this from day one, but there's other people involved. I have to contended with that, and it's been an ongoing nightmarish battle to deal with," said Parrish. "But I'm going to deal with it, and it's going to get over with hopefully soon."

    Judge Landrum said the trial will continue as early as May 19, 2014.

    Trial date set for Jones County man charged with capital murder

    A trial date has been set for a Jones County man charged with capital murder for killing his girlfriend's daughter.

    A hearing was held Tuesday for Justin Blakeney, who is accused of murdering two-year-old Victoria Viner by pounding a telephone book against her head in 2010.

    After granting a change of venue back in January, Judge Billy Joe Landrum set Blakeney's trial for July 7. The trial will begin with a jury selection from Greene County, where 12 jurors plus 4 to 6 alternatives will be chosen and brought back to the Jones County court room.

    “I've struggled with this for this amount of time and as I've said on every occasion I will see it through to the better end and I'm thrilled that we finally got a exact date and we know where the jurors are coming from,” said Jones County Assistant District Attorney J. Ronald Parrish.

    This was the second motion filed by prosecutor J. Ronald Parrish since the judge declared a mistrial in January.

    Jones County man to stand trial for brutal murder of 2-year-old

    JONES COUNTY, MS (WDAM) - In fewer than four weeks, a Jones County man will stand trial for allegedly killing his girlfriend's two-year-old daughter by pounding a telephone book against her head in 2010.

    On Tuesday, a motion hearing was held inside the Jones County courtroom in the Justin Blakeney case.

    The hearing began with Jones County Sheriff's Officer Don Scott taking the stand. Scott interviewed Blakeney August 12, 2010, two days after the incident, the same day Victoria Viner, 2, passed.

    The 35-minute taped interview was played in the courtroom, afterwards Judge Billy Joe Landrum ruled it as admissible.

    Second to take the stand was Mississippi Bureau of Investigation Captain James Herzog. Herzog interviewed Blakeney September 1, 2010. The 1 hour and 12 minute video along with a written statement was ruled as admissible evidence by

    Judge Landrum and will be used in the trial.

    A third video interview divided into three disks was also shown in the courtroom. The approximately 3 hour long interview was ruled as admissible as well.

    The motion hearing is expected to continue Wednesday.
