    Appeals court upholds judge's ruling in Arkansas slayings

    LITTLE ROCK, Ark. (AP) - A federal appeals court has rejected a request for a new hearing by an Oklahoma man sentenced to death for his role in killing an Arkansas family.

    The 8th U.S. Circuit Court of Appeals on Monday upheld a federal judge's ruling against Danny Lee of Yukon, Oklahoma.

    Lee was convicted in federal court Little Rock in the 1996 deaths of gun dealer William Mueller, his wife, Nancy Mueller, and their 8-year-old daughter, Sarah. Prosecutors alleged Lee and co-defendant Chevie Kehoe wanted to steal the dealer's guns to start an army and establish a white supremacist nation in the Pacific Northwest. Kehoe was also convicted and sentenced to life in prison.

    Lee's attorneys wanted Lee's case reopened so they could challenge tests presented at trial that suggested Lee was a psychopath.

    On December 14, 2015, Lee's petition for en banc rehearing was DENIED by the US Court of Appeals for the Eighth Circuit.

    I don't think so. There are plenty of other condemned federal inmates whose appeals have long been totally exhausted, unlike Lee's.

    Oklahoma man seeks new trial in white supremacist plot

    OKLAHOMA CITY (AP) — An Oklahoma man says new evidence of prosecutors withholding information should result in a new trial on his 1999 murder conviction and death penalty for killing an Arkansas family as part of a plot to set up a whites-only nation in the Pacific Northwest.

    Attorneys for Danny Lee, 45, of Yukon say in documents filed late Monday in U.S. District Court in Little Rock that prosecutors illegally failed to tell defense attorneys that a witness, who testified that Lee admitted to the murders to him, also told investigators he believed Lee was lying.

    The witness "warned authorities that Mr. Lee had a habit of falsely claiming responsibility for criminal acts in order to make himself seem like a 'tough guy,'" according to the filing, which said the man was told by prosecutors not to volunteer information while testifying.

    "He therefore did not relate to the jury that Danny Lee had a penchant for boasting about acts he had not done; that he had consistently warned authorities about that fact; and that despite appearing as a witness for the (g)overnment, he continued to discount the veracity of Mr. Lee's purported admission," the motion said.

    Lee's attorneys also said DNA tests in 2007 excluded Lee from evidence connected to the slayings and that, plus the newly revealed information should result in a new trial.

    The motion did not indicate when the information was discovered, and Lee's attorney, Morris Moon of the Federal Capital Habeas Project, did not immediately return a phone call to The Associated Press.

    The filing also said DNA testing in 2007 revealed that hair on evidence linked to the killings, and to Lee by testimony during the trial, has excluded Lee.

    Court filings do not show that a direct appeal based on DNA evidence has been filed, but an appeal claiming Lee's defense attorneys during the trial should have requested DNA testing on the hair was denied in 2008 on the grounds that not enough of the evidence existed at the time.

    Lee and Chevie Kehoe, 45, of Colville, Washington, were convicted of killing gun dealer William Mueller, his wife Nancy Mueller and her 8-year-old daughter, Sarah Powell, of Russellville in 1996 and stealing guns and cash as part of the plot to set up a whites-only nation.

    Kehoe, described by federal prosecutors at the time as the leader of the plot, was sentenced to life without parole days before Lee was sentenced.

    Prosecutors, seeking the death penalty for both men, at the time described Kehoe as the ringleader and Lee as his henchman.

    "In light of the sentencing that Chevie Kehoe received, I'm struggling to understand the verdict," said Jack Lassiter, who represented Lee at the time.

    Assistant U.S. Attorney Chris Givens in Little Rock referred questions to the U.S. Department of Justice, which also did not immediately return a phone call for comment.

    Judge denies retrial request for federal death row inmate

    An Oklahoma man's new trial request for a 1999 federal murder conviction and death sentence in Arkansas has been denied, with the judge saying he doesn't have jurisdiction while noting that evidence presented by attorneys "is reasonably likely" to have led to a different sentence.

    Danny Lee, 46, of Yukon, was convicted and sentenced to die for the 1996 deaths of gun dealer William Mueller, his wife, Nancy Mueller and her 8-year-old daughter, Sarah Powell, of Russellville and stealing guns and cash in a plot to establish a whites-only nation in the Pacific Northwest.

    Chevie Kehoe, 46, of Colville, Washington, was also convicted of murder in the case and was sentenced to life in prison, though prosecutors called Kehoe the ringleader and also sought the death penalty for him.

    Tuesday's order by U.S. District Judge Leon Holmes said that because the request is the 3rd by Lee, it requires federal appeals court authorization, which has not been requested.

    Lee's attorneys, assistant federal public defenders Morris Moon and George Kouros, did not return phone calls for comment Wednesday.

    The defense attorneys said in their September motion for a new trial that recently discovered documents show a 1990 murder charge against Lee, who was 17 at the time, was not reduced to a robbery charge, as said by prosecutors during the sentencing phase of his 1999 trial, but dismissed for a lack of evidence.

    Holmes' 20-page order notes that prosecutors, in seeking the death penalty, told jurors that Lee had received a "gift" when the murder charge in Oklahoma City was reduced.

    "Assuming that the Oklahoma state court held at a preliminary hearing that the evidence was insufficient to establish probable cause that Lee was guilty of murdering Joey Wavra, that evidence is material," Holmes wrote. "In light of the government's reliance on the Wavra murder during sentencing it is reasonably likely that ... the outcome at sentencing would have been different."

    The new trial request does not say when the documents were discovered, but includes a September 1991 request for attorney fees by Kenneth Watson, the attorney for Lee, who was known at the time as Daniel Graham.

    "Court finds crime of Murder I not established by evidence," according to the request. "Court recommends a dismissal of Murder I charges and state consider refiling on charge of Robbery I."

    Watson, now a retired state judge, did not immediately return a phone call for comment.

    Lee's cousin was later convicted of killing Wavra and sentenced to life in prison.

    Attorney General William Barr has ordered the reinstatement of the federal death penalty after a 16-year pause, the Department of Justice announced Thursday.

    Barr also directed the Federal Bureau of Prisons to schedule the executions of five death-row inmates convicted of murder, the Justice Department said in a news release.

    The executions are slated to take place in December 2019 and January 2020.

    “Congress has expressly authorized the death penalty through legislation adopted by the people’s representatives in both houses of Congress and signed by the President,” Barr said in a statement.

    "The Justice Department upholds the rule of law—and we owe it to the victims and their families to carry forward the sentence imposed by our justice system," he added.

    The last federal execution occurred in 2003.

    In 2014, President Barack Obama ordered the Justice Department to carry out a review of capital punishment and lethal injection drugs. The review led to what was effectively a moratorium on federal executions.

    There are currently 62 inmates on federal death row, according to a list compiled by the Death Penalty Information Center, a Washington, D.C., nonprofit.

    The list of current inmates includes convicted Boston Marathon bomber Dzhokhar Tsarnaev and Charleston church shooter Dylann Roof.

    The federal inmates whose executions have been scheduled are Daniel Lewis Lee, a member of a white supremacist group convicted of killing a family of three, including an 8-year-old girl; Lezmond Mitchell, convicted of stabbing to death a 63-year-old woman; Wesley Ira Purkey, convicted of raping and murdering a 16-year-old girl; Alfred Bourgeois, convicted of sexually molesting and beating to death his 2-and-a-half-year-old daughter; and Dustin Lee Honken, convicted of shooting five people to death.
