    Summary of Offense:

    On November 19, 2003, a jury recommended that Purkey be sentenced to death for the 1998 kidnapping, rape and murder of a Kansas City, Missouri teen. While serving life in prison for another 1998 murder in Kansas, Purkey confessed to the Kansas City crime in hopes of being transferred to federal prison. Prosecutors instead chose to seek the death penalty for Purkey under the 1994 federal statute.

    KANSAS CITY, Mo. (AP) - A Kansas man's effort to overturn the death sentence he received for killing a Kansas City teenager has been denied.

    U.S. District Judge Fernando Gaitan Jr. on Tuesday denied all motions from Wesley Ira Purkey, who was sentenced to death for the 1998 murder of Jennifer Long.

    The Kansas City Star reports that the 57-year-old Purkey claims included that he had an ineffective trial lawyer and that prosecutors were guilty of misconduct.

    Although he admitted that he killed Long and disposed of her remains at his home in Lansing, Purkey contended that he did not kidnap her across state lines. That factor led to his federal prosecution for kidnapping, which resulted in the death sentence.

    Purkey is also serving a life sentence for the killing of an 80-year-old woman in Kansas City, Kan.

    On November 4, 2010, Purkey filed an appeal with the US Eighth Circuit Court of Appeasls regarding the denial of his habeas petition by the District Court.

    Court: Eighth Circuit Court of Appeals

    Defendant was convicted of the interstate kidnap, rape, and murder of a sixteen-year-old. On appeal, defendant challenged the denial of his motion to vacate, set aside, or correct his sentence of death under 28 U.S.C. 2255. The court concluded that defendant's proffered evidence, taken as true, failed to establish that his trial counsel's allegedly deficient performance was prejudicial to defendant. Further, the district court did not abuse its discretion by denying defendant's request for an evidentiary hearing. Accordingly, the court affirmed the judgment of the district court.

    Theoretically, Purkey's appeals are now exhausted. Unfortunately, litigation over the federal government's lethal-injection protocol has continued to be bogged down in the District of Columbia District Court since 2006.

    Attorney General William Barr has ordered the reinstatement of the federal death penalty after a 16-year pause, the Department of Justice announced Thursday.

    Barr also directed the Federal Bureau of Prisons to schedule the executions of five death-row inmates convicted of murder, the Justice Department said in a news release.

    The executions are slated to take place in December 2019 and January 2020.

    “Congress has expressly authorized the death penalty through legislation adopted by the people’s representatives in both houses of Congress and signed by the President,” Barr said in a statement.

    "The Justice Department upholds the rule of law—and we owe it to the victims and their families to carry forward the sentence imposed by our justice system," he added.

    The last federal execution occurred in 2003.

    In 2014, President Barack Obama ordered the Justice Department to carry out a review of capital punishment and lethal injection drugs. The review led to what was effectively a moratorium on federal executions.

    There are currently 62 inmates on federal death row, according to a list compiled by the Death Penalty Information Center, a Washington, D.C., nonprofit.

    The list of current inmates includes convicted Boston Marathon bomber Dzhokhar Tsarnaev and Charleston church shooter Dylann Roof.

    The federal inmates whose executions have been scheduled are Daniel Lewis Lee, a member of a white supremacist group convicted of killing a family of three, including an 8-year-old girl; Lezmond Mitchell, convicted of stabbing to death a 63-year-old woman; Wesley Ira Purkey, convicted of raping and murdering a 16-year-old girl; Alfred Bourgeois, convicted of sexually molesting and beating to death his 2-and-a-half-year-old daughter; and Dustin Lee Honken, convicted of shooting five people to death.

    KANSAS CITY, Mo. (AP) — A federal death row inmate from Kansas who raped, killed and dismembered a 16-year-old girl and beat an 80-year-old woman to death wants the chance to present claims that his trial lawyer was ineffective.

    The Kansas City Star reports that attorneys for Wesley Ira Purkey want his execution stayed. It currently is scheduled for Dec. 13. The defense argues that his trial lawyer failed to investigate his traumatic childhood, which included sexual abuse by alcoholic family members and a Catholic priest.

    Purkey, of Lansing, killed Jennifer Long in 1998 after picking her up in Kansas City, Missouri, and dumped her remains in a Kansas septic pond. Nine months later, Purkey beat Mary Ruth Bales to death in her Kansas City, Kansas, home.

    He was sentenced to death for Long’s killing.
