    Summary of Offense:

    Brown was convicted and sentenced to death in 2003 for the November 2002 murder of Sallie Gaglia, 48, during a robbery of a post office in Fleming, Georgia. Brown had agreed to plead guilty in return for a sentence of life without parole in light of Brown's confession, but federal prosecutors sought the death sentence.

    On January 22, 2007, the United States Supreme Court upheld Brown's death sentence on direct appeal.

    On September 29, 2008, Brown's petition for post-conviction relief was denied in Federal District Court.

    On July 10, 2013, habeas relief was denied by the US Eleventh Circuit Court of Appeals.

    On September 27, 2013, Brown's petition for rehearing en banc was DENIED by the US Court of Appeals for the Eleventh Circuit.

    Theoretically, Brown's appeals are now exhausted. Unfortunately, litigation over the federal government's lethal-injection protocol has continued to be bogged down in the District of Columbia District Court since 2006.
