    Summary of Offense:

    Sentenced to death on July 17, 2004 for the murder of a fellow inmate, Luther Plant, at the Beaumont Federal Penitentiary in Texas in 2001 while Agofsky was in prison for a murder that he had committed when he was 18. The jury was shown a video of the attack, which prison officials said was gang-related.

    After Agofsky's filing of a direct appeal on April 11, 2007, the US Fifth Circuit Court of Appeals upheld Agofsky's death sentence on direct appeal on January 31, 2008.

    On July 23, 2007, Agofsky filed a petition for post-conviction relief in Federal District Court (I'm not sure why he filed this before his direct appeal had been completed).

    Okla. AG wants convicted killer's appeal dismissed

    The Oklahoma Attorney General's Office is urging a Delaware County judge to dismiss the latest appeal of a man sentenced to life in prison for the death of a Missouri banker.

    Shannon Wayne Agofsky was convicted in the death of Dan Short in October 1989. Prosecutors say Short was abducted from his northwest Arkansas home and taken to the State Bank of Noel, Mo., where he was forced to open the vault.

    Short was then driven into northeast Oklahoma, tied to a weighted chair and dumped alive into Grand Lake near Grove. His body was found five days later.

    Agofsky has filed a motion to set aside his murder conviction and life sentence. He is currently on federal death row in Terre Haute, Ind., for stomping another inmate to death.

    Man Connected To Death Of Missouri Banker In Oklahoma Dies In Prison

    A Missouri man serving time in federal prison for robbing and assisting in the Oklahoma drowning death of a Missouri banker has died.

    Bureau of Federal Prison records show Joseph Agofsky, 46, died on March 5, 2013 in a North Carolina federal prison.

    Agofsky and his brother, Shannon Agofsky, 42, were convicted in Oklahoma of kidnapping Dan Short from his home on October 6, 1989.

    After stealing more than $75,000 from Short's bank in Noel, Missouri, they drove him to Oklahoma's Grand Lake. Shannon Agofsky tied Short to a weighted chair and threw him off state Highway 10's Cowskin Bridge into the water.

    Short's body was recovered several days later.

    Both brothers were convicted of the robbery in 1992, but only Shannon was convicted of killing Short. He was sentenced to death.

    Shannon Agofsky remains on death row at the federal penitentiary at Terre Haute, Indiana.

    I personally think both brothers should’ve gotten the Oklahoma death penalty for killing Dan Short. Both would Likely be dead by now

    These articles make no sense. Was he given death for killing the banker or for killing another inmate??
