Summary of Offense:

Billie Jerome Allen and Norris Holder were convicted of the fatal shooting of a bank guard, Richard Heflin, during a robbery in St. Louis, Missouri. Allen was sentenced to death by a jury on March 10, 1998. In June 2002, the U.S. Supreme Court vacated Allen's death sentence and remanded the case back to the Eighth Circuit for reconsideration in light of the Court's ruling in Ring v. Arizona. Because his federal indictment did not include the aggravating factors necessary to support his death sentence, a three-judge Eighth Circuit panel said Allen's sentence should be reduced to life in prison. However, in September 2004, the Eighth Circuit conducted a rehearing en banc of the earlier decision and reinstated Allen's death sentence.
