    Summary of Offense:

    Johnson was convicted in 1999 of the shooting death of Randy McCullar in a church parking lot in rural Walker County on November 30, 1997. The capital murder charge involved killing a person who had been a grand jury witness. Testimony at the trial showed that Johnson was still married to McCullar when she married William Howard McIntyre Jr. in 1995 and when she married Tim Richards in 1997. McCullar testified before a grand jury and got Johnson prosecuted for bigamy. He also filed for divorce and custody of their child three weeks before he was killed. Johnson was so mad that she tried to get a former boyfriend she lived with between the McIntyre and Richards weddings to kill McCullar, but he wouldn't. Then she persuaded Richards to cut McCullar's tire while he was in a lounge. According to testimony, Richards and Johnson followed McCullar to a church parking lot, where Johnson gave Richards a loaded gun and got him to kill McCullar. In a plea deal, Richards testified against Johnson.

    With that being said, and your light interpretation of events, I see that Johnson violated 1,5, & 6 of Alabama's aggravating factors for capital punishment, and her case was reversed and remanded simply on jury instructions. By no means does that make her innocent!

    Man convicted of murdering wife's OTHER husband on the run after prison escape

    A man convicted of gunning down a love rival in a bizarre bigamy case is on the run after escaping from an Alabama prison.

    Timothy Richards apparently slipped out of State Cattle Ranch, a prison farm in Greensboro, early Sunday. He was found missing from his bunk during an inmate headcount taken at 1.30am.

    At least one local official, who fears for his own safety now, says a prison farm is no place for a convicted murderer to be housed.

    US Marshals and local police have fanned out across central Alabama where Richards, 42, disappeared but have been unable to find any trace of him yet.

    Richards pleaded guilty in 2000 to murdering Randy McCullar, one of his wife's two other husbands, as he changed a tire in the parking lot of a church in the small city of Jasper.

    The strange bigamy case centered around Shonda Nichole Johnson, who by age 28 had three husbands and two ex-husbands and went by four last names.

    Richards, Johnson's fifth husband, avoided the death penalty by testifying against his wife, providing investigators information about the plot she had hatched with Richards to kill McCullar, her third husband.

    Thanks, in part, to Richards cooperation, Johnson was convicted and sentenced to death. She is one of just four women awaiting execution in Alabama.

    Under the terms of his plea agreement Richards received a life sentence in prison, but would have been eligible for parole in May 2013 -- just 13 months away.

    In Richards' home town, Sheriff Mark Tirey told the Jasper Daily Mountain Eagle newspaper that his deputies were on 'high alert' searching for the convict.

    'We’ve been checking local addresses that would be familiar to him -- the homes of family members and places he’s been associated with in the past,' he said.

    Richards was being housed at the State Cattle Ranch, which is a farm run by the Department of Corrections that raises cows that are slaughtered for meat fed to inmates across the state.

    Walker County District Attorney Bill Adair, who prosecuted Richards, said he is worried for his staff and the family of Richards' victim, told the Daily Mountain Eagle.

    Richards is a large man, standing six-foot-four and weighing 230 pounds.

    He blasted stat budget cuts that landed Richards on a prison farm, rather than a high-security lockup.

    'The cattle ranch shouldn’t be a place where the state puts murderers,' he told the newspaper.

    Escaped murderer caught in Ohio

    Authorities believe that escaped murderer Timothy Richards received help from someone when he made his way to Alliance, Ohio, this week.

    Richards, 42, was discovered to be missing from his bunk at the minimum-security state prison ranch near Greensboro during an early morning bed check on April 8.

    Members of the U.S. Marshals Regional Fugitive Task Force learned Wednesday that Richards might be at a specific address in Alliance, said Alabama Department of Corrections spokesman Brian Corbett.

    Members of the U.S. Marshals Service in Ohio found Richards at that address at 11:45 a.m. Wednesday. He was unarmed and was taken into custody without incident, Corbett said.

    Richards will be placed in a facility with a higher security level, Corbett said. He declined to give the name of the location for security reasons until Richards is transported there.

    The Department of Corrections will sign a warrant to prosecute Richards for a criminal first-degree escape charge, Corbett said. It would be up to the Hale County district attorney to prosecute.

    “It is unknown if additional charges will be filed until he is returned and the investigation is complete,” Corbett said.

    The person who assisted Richards could face criminal charges. The case remains under investigation, Corbett said, and the department will release no further details.

    “I’d like to applaud the U.S. Marshals for their help and persistence in apprehending this inmate,” Alabama Department of Corrections Commissioner Kim Thomas said in a release issued at 4:15 p.m. Wednesday. “We have five officers assigned to this task force and this was our No. 1 priority. We are thankful that Richards was taken into custody without incident.”

    Richards was serving a life sentence after pleading guilty to the 1997 murder of Randy McCullar in Walker County, but was eligible for parole in May 2013.

    McCullar had filed bigamy charges against his wife, Shonda Johnson, for marrying him without divorcing Richards. According to court testimony, Johnson asked Richards to shoot McCullar with a hunting rifle, which he did after cutting McCullar’s tire and following him to a church parking lot.

    Richards testified against Johnson at her trial. She is now one of four women on Alabama’s death row.

    Richards met the classification to be held in a minimum security facility, Corbett said. Inmates eligible for minimum security must have a discipline-free record of at least 90 days and must be within three years of their earliest possible release date.

    Richards had not been disciplined once during the 14 years, one month and two days he had served before escaping.

    So a convicted murderer, who was sentenced to life in prison in 2000, was going to be eligible for parole in May of next year. Gotta love that life sentence. The only thing more ridiculous than that is the fact that the same convicted murderer was allowed to work on a farm part of the time, rather than being locked up, supposedly because of state budget cuts. Pathetic...
