    Judge Stays Execution of Texas Grocer's Killer

    HUNTSVILLE, Texas (UPI) — A Federal district judge today stayed the execution of a killer less than 12 hours before he was to die by injection for the shotgun slaying of a 72-year-old grocer.

    The killer, Bobby James Moore, 26, was to die before dawn Wednesday for the murder in 1980 of James McCarble in a Houston supermarket robbery.

    The judge, James De Anda, stayed the execution at the request of defense attorneys, who cited several unresolved issues in the case.

    Later today, Judge Woody Densen of Texas District Court withdrew the warrant of execution for another convicted killer who was to have died Thursday morning. The condemned man, Jeffery Allen Barney, 27, was sentenced to die for killing and raping a minister's wife in 1981.

    In Tallahassee, Fla., the State Supreme Court denied a stay of execution for Theodore Bundy, who is scheduled to die next Tuesday for the 1978 murders of two Florida State University sorority sisters. The court offered no explanation for its ruling.

    In July of 1980, appellant was convicted of capital murder, alleged to have been committed in April 1980 during a robbery, and was sentenced to death. Tex. Penal Code Ann. § 19.03(a). Appellant's conviction and sentence were originally affirmed by this Court. Moore v. State, 700 S.W.2d 193 (Tex. Crim. App. 1985), cert. denied, 474 U.S. 1113 (1986). Appellant then filed an application for writ of habeas corpus in federal court. The United States Court of Appeals for the Fifth Circuit affirmed the United States District Court's grant of habeas corpus relief, as to punishment only, based upon trial counsel's constitutionally deficient performance, which prejudiced the outcome of the punishment phase. Moore v. Johnson, 194 F.3d 586, 622 (5th Cir. 1999). In February 2001, the trial court held a new punishment hearing and, pursuant to the jury's answers to the special issues set forth in Texas Code of Criminal Procedure Article 37.0711, §§ 3(b) and 3(e), sentenced appellant to death. Art. 37.0711 § 3(g). (1) Direct appeal to this Court is automatic. Art. 37.0711, § 3(j). Appellant raises twenty-one points of error pertaining to his latest punishment hearing. (2) We affirm.

    This guy has his cert petition pending with the USSC, arguing that he's too retarded to execute and that our standards for determining whether he's retarded are outdated.

    He also tossed in a Lackey claim, which is probably the main reason why cert wasn't denied today. Justices Breyer and Kennedy have been eyeballing Lackey claims for a long time now, so watch if this petition gets granted or not.

    I wonder whether the liberal justices voted to grant cert because they have a hunch that Kennedy will vote to overturn Moore's sentence (and Buck's as well).
