    Legal battle centers on release of Alabama execution details

    ATLANTA (AP) — A federal appeals court is considering whether a lower court judge was wrong to rule that Alabama’s execution protocol should be unsealed at the request of news outlets.

    The Associated Press and other outlets intervened in the case of Alabama death row inmate Doyle Hamm, filing a motion seeking the release of records including the state’s execution protocol.

    A federal judge ruled in May that the public has “a common law right of access” to the records, including a redacted version of the protocol.

    The state appealed, arguing the judge was wrong to grant access to the execution protocol, in part because it hadn’t been filed in the case.

    A three-judge panel of the 11th U.S. Circuit Court of Appeals in Atlanta on Monday heard arguments in the appeal.

    According to the ADOC, Hamm is still on death row. He’ll never be executed though because of the private settlement

    He's still under a sentence of death technically. Not unlike William Boliek of Missouri's situation.

    On a side note when I saw a post on this thread I thought he had finally died and got my hopes up. No fair!

    Alabama death row inmate who survived botched execution dies of natural causes

    Doyle Hamm, an Alabama death row inmate who survived a "botched execution" attempt in 2018, has died, his lawyer confirmed to AL.com Sunday. He was 64 years old.

    Hamm, who was already terminally ill when his execution was scheduled, had been fighting “an extremely aggressive lymphoma” since 2014, his lawyer, Bernard Harcourt, said. Harcourt said complications from lymphoma contributed to Hamm’s death early Sunday morning.

    Hamm was sentenced to death in 1987, and served more than 33 years in prison for the murder of Patrick Cunningham, who was shot in the head while working the overnight shift at Anderson’s Motel in Cullman.

    Harcourt also said Hamm received really excellent medical care and attention from Dr. Connie Uzel, an oncologist in Mobile who treated Hamm.

    “She was an extraordinary doctor who he was really grateful for,” Harcourt said.
