    Summary of Offense:

    Was convicted of capital murder and sentenced to death in 1994 for the August 9, 1990 shooting death of Tuscaloosa County housewife Cathy Gilliam. She was kidnapped from her home in the New Lexington community just south of Fayette and shot in the stomach.

    Perkins' sentence upheld on direct appeal

    The state Supreme Court upheld the death sentence of Roy Edward Perkins, sentenced to die for the Aug. 9, 1990, abduction and killing of Cathy Gilliam in the Tuscaloosa County community of New Lexington.

    Perkins' attorneys argued that he is mentally retarded and should not be executed because of the recent U.S. Supreme Court ruling. But the Alabama Supreme Court ruled that after a careful review of the case there was no evidence that Perkins was retarded.

    "The record indicates that Perkins earned a GED certificate while he has been in prison and has completed community college courses there," the ruling said. The ruling also encourages the Alabama Legislature to "develop procedures for determining whether a capital defendant is mentally retarded and thus ineligible for execution."

    The Alabama Court of Criminal Appeals has upheld death penalty cases from Tuscaloosa and Jefferson counties.

    The court ruled 5-0 Friday against Roy Edward Perkins in his second round of appeals from his capital murder conviction in Tuscaloosa County. He was sentenced to die for the shooting death of Cathy Gilliam during a kidnapping in August 1990. The appeals court rejected his argument that there were errors in his trial, including the use of false evidence.

    The court also ruled 5-0 against Donnis George Musgrove in his second round of appeals from his capital murder conviction for the September 1986 shooting death of Coy Eugene Barron at his home in the Robinwood community near Birmingham. The court turned down Musgrove's argument that newly discovered evidence would prove him innocent.
