    Summary of Offense:

    On December 16, 1989, US Federal Appeals Court Judge Robert S. Vance was killed by a mail bomb at his Alabama home. Walter Leroy Moody Junior was later sentenced to death in 1997 for killing Vance, and received seven life terms on federal charges in that killing and the death of civil rights attorney Robert E. Robinson.

    Alabama Supreme Court refuses to hear appeal by condemned pipe bomber Walter Leroy Moody

    The Alabama Supreme Court today refused to hear the latest appeal by Walter Leroy Moody, who was sentenced to death in 1996 for the pipe-bomb murder of federal appeals judge Robert Vance.

    Moody, 77, is pursuing what is known as a Rule 32 appeal challenging his conviction and death sentence, which occurs after the initial round of direct appeals in state and federal courts.

    A Jefferson County judge rejected Moody's Rule 32 petition in 2010 and the Alabama Court of Criminal Appeals denied his appeal late last year. On Friday, the Alabama Supreme Court denied Moody's request for the state high court to hear the appeal.

    Vance was killed Dec. 16, 1989, and his wife, Helen, was seriously injured after the judge opened a package that had been sent to his home, detonating the pipe bomb. Two days later, a similar pipe bomb killed a lawyer in Atlanta. Those were followed by two other bombs that were defused, one in Georgia and one in Florida.

    Moody was linked to the crimes through a similar bomb nearly two decades earlier that had injured his wife when it exploded. His prosecution in that case led to a lingering resentment of the courts that built into the 1989 bombings.

    Moody was arrested in 1991. He was tried first in federal court, receiving seven consecutive sentences of life without parole, before his capital conviction in Jefferson County Circuit Court. Moody is held on Death Row at the Holman Correctional Facility.

    Court: Ala. judge can hear appeal in '89 killing

    A federal appeals court says an Alabama-based judge can consider the appeal of a man convicted in the 1989 mail bomb death of a federal judge in Birmingham.

    The 11th U.S. Circuit Court of Appeals in Atlanta on Friday denied a petition filed by Walter Leroy Moody Jr., who is on Alabama's death row for the slaying of U.S. Circuit Judge Robert Vance.

    The Rex, Ga., man was convicted in state court of mailing a bomb that Vance opened in his Mountain Brook home in 1989, killing him instantly.

    Moody claims U.S. District Judge Scott Coogler of Tuscaloosa shouldn't hear the case because of conflicts. He also says no member of the 11th Circuit should be involved since Vance served on the same court.

    A three-judge panel denied Moody's request.

    Federal appeals court won't reconsider Alabama death row inmate Walter Leroy Moody Jr. request for re-hearing

    Federal appeals court judges in Atlanta this week refused to reconsider a request to disqualify themselves from the appeals of Walter Leroy Moody Jr., the man on Alabama's death row for the 1989 bombing that killed U.S. Circuit Court Judge Robert Vance.

    The U.S. 11th Circuit Court of Appeals on Jan. 10 had denied Moody's request to have both the 11th Circuit and U.S. District Court Judge Scott Coogler barred from hearing his appeals. Moody then asked the 11th Circuit to consider rehearing that request.

    The appeals court denied the request on Wednesday.

    Moody had argued that because judge Vance had sat on the 11th Circuit and was from Alabama, the judges now on the 11th Circuit court and Coogler should recuse themselves from his appeals. He had argued the appeals should be heard by courts in another region. The 11th Circuit includes Alabama, Georgia, and Florida.

    The 11th Circuit, in a written opinion, denied the requests for recusal. The court stated none of the current members of the court had a personal connection or relationship with Vance and were not members of the appeals court at the time of the bombing. Coogler also was not a federal judge at the time.

    Moody, who at 78 is the oldest inmate on Alabama's death row, was arrested in 1991 for the bomb blast. He was tried first in federal court, receiving seven consecutive sentences of life without parole, before his 1996 capital murder conviction in Jefferson County Circuit Court that sent him to death row.

    Moody had faced other charges in Georgia related to bombs or bombings, including one that killed a lawyer, and threats to judges.

    In today's orders, the United States Supreme Court declined to review Moody's petition for certiorari.

    Appeals exhausted. Ruling could result in an execution date.

    This guy is 79 years old. I say we just save the pentobarbital, and just let this one wither away on DR via natural causes.
