    Trial date set for 2008 triple-homicide suspect

    A tentative date has been set for the death penalty trial of an Augusta man accused of killing three people, including a pregnant teenager.

    At a hearing Tuesday, attorneys for Adrian Tywan Hargrove, 33, and District Attorney Ashley Wright agreed to an Oct. 24 starting date for the trial.

    Judge James G. Blanchard Jr. also heard several motions from the defense to strike the death penalty, including an argument based upon the Supreme Court's decision in the 2000 Bush v. Gore case.

    Attorneys argued that this case sets a precedent of "equal dignity" for voters and, in the same vein, Georgia needed a system of standards for prosecutors to make the death penalty more uniform across various counties and among different crimes because a person's life is an even more fundamental right.

    Hargrove has pleaded not guilty to kidnapping, murder and feticide. If he is convicted of the murder charge, a jury will determine his punishment -- death or life in prison without the possibility of parole.

    He was arrested Feb. 9, 2008, in the stabbing death of Andrew Hartley Jr., 45, and Sharon Hartley, 46, and their daughter, Allyson Pederson, 18.

    The couple were found in their Bennock Mill Road home after Hargrove's wife told police that he had arrived home with blood on his clothes.

    The body of Pederson, who was several months pregnant, was found near the Lock and Dam Road, not far from the airport. It had been set on fire.( I am taking the liberty of injecting the victims name, Allyson Pederson,instead of calling her "It")

    Hargrove was released from prison in 2006 after serving seven years in prison for convictions of cruelty to children and possession of cocaine.

    The next hearing date was set for Jan. 20.

    Delay sought in murder trial

    Superior Court Judge James Blanchard will hear arguments Friday on why he should delay the death penalty trial of triple-homicide suspect Adrian Tywan Hargrove.

    Hargrove is indicted on three counts of murder in connection with the 2008 stabbing death of Andrew Hartley Jr., 45, Sharon Hartley, 46, and their daughter, Allyson Pederson, 18. He is also scheduled for trial April 24 for a charge of feticide for the death of Pederson’s unborn child.

    District Attorney Ashley Wright announced the day after Hargrove was indicted Feb. 19, 2008, that the state would be seeking the death penalty. Hargrove has pleaded not guilty to all his charges, which also include burglary, kidnapping and possession of a knife during the commission of a crime.

    The latest in the usual flurry of death penalty challenges and motions from Hargrove’s state-appointed capital defenders came March 13, which requested a continuance for trial. In the motion, Hargrove’s attorney, Teri Thompson, lists all the death penalty cases she is currently balancing as a reason to delay.

    Thompson begins with the six-week Cobb County trial of Joshua Drucker in September and a trip to New Jersey in November to interview and prepare witnesses for another defendant.

    She also has five other pending cases to prepare for in Georgia, including Hargrove, according to the motion.

    Additionally, the supervisor charged with ensuring the quality of mitigation investigation was focused on another case besides Hargrove’s after a judge denied a continuance. Felicia Sullivan, director of Mitigation Investigation, is retiring March 31, requiring a new investigator.

    “That investigator will have to learn the entirety of Mr. Hargrove’s case and learn, absorb and digest over four years of investigation of Mr. Hargrove’s life as well as the life of his family in order to be able to effectively assist counsel at trial,” the motion states.

    Thompson concludes that during weeks preceding a Newton County trial that began Feb. 6 and during trial, she worked no less than 16 hours a day and weekends preparing for and defending the suspect.

    Friday’s hearing will also address Hargrove’s mental competency.

    Judge denies slaying trial delay

    A motion to push back the trial date of a triple-homicide suspect was denied Friday by Superior Court Judge James Blanchard.

    Adrian Tywan Hargrove faces the death penalty if convicted at trial, which will continue as scheduled on April 24. Hargrove is accused of stabbing three people to death in 2008: Andrew Hartley Jr., 45; Sharon Hartley, 46; and their daughter, Allyson Pederson, 18.

    He is also indicted on a charge of feticide for the death of Pederson’s unborn child.

    His capital defenders argued Friday that a heavy caseload prevented them from adequately preparing Hargrove’s case in the allotted time.

    “In a case of this magnitude, when Mr. Hargrove’s life is literally in the balance, .... with all due respect, that April 24 date has to be continued,” attorney Teri Thompson said.

    District Attorney Ashley Wright countered that the caseload complaints and shifting personnel changes at the capital defender’s office are an internal problem and should not affect the defendant and his rights.

    “I don’t believe there’s a reason beyond convenience ... to provide yet another delay in this matter,” Wright said.

    Blanchard indicated early in the hearing that he was not inclined to continue the trial date for the requested 90 days. There will always be some issue or another case standing in the way, Blanchard said.

    Death penalty trial delayed until January

    A death penalty trial scheduled for Oct. 1 was moved on Monday to an undetermined date in late January.

    Adrian Hargrove faces execution if convicted of three counts of murder for the 2008 deaths of Andrew Hartley Jr., 45, Sharon Hartley, 46, and their daughter, Allyson Pederson, 18. He is also charged with feticide for the death of Pederson’s unborn child.

    At a hearing Monday, two state-appointed capital defenders said they had only been assigned the case two months ago. District Attorney Ashley Wright made no objection to their request for a continuance, stating that the case is finally moving forward.

    “We’re trying to do the work now that has been lacking and it’s been difficult,” Wright said. “I am appreciative of efforts to get this case up to speed.”

    Wright said she was recently presented with nearly 10,000 pages of discovery from the defense. Hargrove’s attorneys have also presented a new mental retardation defense.

    Superior Court Judge James Blanchard granted the continuance.

    Augusta death penalty trial reset for Jan. 6 for Adrian Hargrove

    The death penalty trial for the suspect in a 2008 Augusta triple homicide is now scheduled to begin Jan. 6.

    Adrian Hargrove, 36, has pleaded not guilty in Richmond County Superior Court to charges that include murder, feticide, and kidnapping.

    He is accused of committing the Feb. 9, 2008, slayings of Andrew Hartley Jr., 45, his wife, Sharon Hartley, 46, and her daughter, Allyson Pederson, 18.

    On Wednesday, Hargrove’s defense team asked Judge James G. Blanchard Jr. to reconsider a ruling he made earlier or allow the defense to take the issue to the Georgia Supreme Court before any trial begins.

    Blanchard denied both requests.

    Newell Hamilton and April Herbert of the Capital Defender’s Office sought to keep out any evidence regarding a 1998 cruelty to children conviction.

    While Blanchard agreed that Hargrove’s plea couldn’t withstand a constitutional challenge and the conviction itself cannot be presented to the jury in the death penalty case, the judge ruled prosecutors can introduce evidence from the case.

    The 1998 case against Hargrove began as a charge of child molestation. He was arrested after a 3-year-old girl in Franklin County, where he was living at the time, was diagnosed with a sexually transmitted disease.

    District Attorney Ashley Wright argued that the judge’s prior ruling in the case should stand. Although the videotaped interview with the child in 1998 has been lost, the social worker assigned to the case still remembers the details and has notes in her case file, Wright said.

    If a jury finds Hargrove guilty of the murder charges, the jury will be asked to set the punishment at life in prison with or without the possibility of parole, or death.

    The Hartleys were found stabbed to death in the bedroom of the Bennock Mill Road home. Pederson’s body was found set on fire off Lock and Dam Road near the Augusta Regional Airport. Pederson, according to earlier reports in The Augusta Chronicle, was five months pregnant at the time.

    A jury found Adrian Hargrove mentally competent to stand trial on capital murder charges Tuesday.

    His death penalty trial is set to begin Monday with jury selection.

    At the conclusion of Hargrove’s two-day trial in Richmond County Superior Court to determine his competency, the jury heard conflicting opinions about the triple homicide suspect from mental health professionals.

    Lead defense attorney Newell Hamilton argued to the jury in closing that Hargrove wasn’t trying to escape justice. He only wanted the mental health treatment he needs to enable him to assist his attorneys in his defense.

    “It’s about fundamental fairness,” Hamilton said.

    Hargrove, 36, has pleaded not guilty in the Feb. 9, 2008, slayings of Andrew and Sharon Hartley and their pregnant 18-year-old daughter, Allyson Pederson.

    District Attorney Ashley Wright argued to the jury in closing that Hargrove’s vague claims of hearing voices, seeing horned beasts, smelling things not there, tasting things not there and feeling imaginary touches was not believeable.

    Doctors testified this week that such hallucinations are extremely rare and only seen in people with brain injuries, Wright said. A defense expert – a neurologist and psychiatrist – testified he examined Hargrove for brain damage and found none.

    Jury selection in the Adrian Hargrove capital murder trial resumes Monday.

    Judge James G. Blanchard Jr., who is presiding over the trial, said Friday morning that the questioning of potential jurors assigned to Panel 2 will begin at 9 a.m. Monday. Panel 3 jurors are to report at 2 p.m. Monday.

    Hargrove, 36, is accused of the Feb. 9, 2008, slayings of Andrew Hartley Jr., 45, his wife, Sharon Hartley, 46, and her pregnant daughter, 18-year-old Allyson Pederson.

    Augusta murder trial begins in 2008 triple homicide

    As everyone in the household screamed and cried after Adrian Hargrove came home covered in blood and announced he had killed three people, Hargrove remained nonchalant, his mother-in-law testified Monday.

    After a monthlong jury selection process, witnesses began testifying Monday in the death penalty trial.

    Hargrove has pleaded not guilty, but in his opening statement Monday lead defense attorney Newell Hamilton told the jury there was no dispute Hargrove killed three people Feb. 9, 2008.

    Hargrove was arrested after the burning body of 18-year-old Allyson Pederson was found near the Lock and Dam and the bodies of her mother and stepfather, Sharon and Andrew Hartley, were found in their Bennock Mill Road home.

    Delores Mobley testified Monday she rushed to the Hargrove home after a frantic call from her grandson. When she got there, her grandson told her what Hargrove had said and showed her bloody clothes and blood-splattered shoes. She also saw a bloody butcher knife and gloves in the trash can.

    Her daughter and grandchildren were extremely upset but Hargrove was calm, drinking a beer.

    “He said he hadn’t done anything,” Mobley said. She called 911.

    The physical evidence Hargrove left in his house ties him to the slayings, Assistant District Attorney Hank Syms told the jury in his opening statement. DNA matched blood found on the items to Pederson and her stepfather. All three victims had been beaten and repeatedly stabbed, Syms said.

    Pederson’s boyfriend, Devon Jackson, who lived a short distance from the Hartley home, testified Monday that Pederson called him about 8:30 a.m. and told him that she was going with Hargrove to help him tow a car. Jackson testified that he stepped outside and watched as the two drove off in Hargrove’s car.

    Jackson was upset and called Pederson’s home, her siblings and Hargrove’s wife. Pederson was pregnant and a couple of friends had told him that Hargrove was the father.

    In a second call to Hargrove’s wife, she got her husband on the phone but didn’t tell him that Jackson was also on the line. “(Hargrove said) he’d just killed three people,” Jackson testified.

    Hargrove’s attorney asked the jury to keep an open mind about the case in which it will have to determine punishment – life in prison with or without the possibility of parole, or death – if Hargrove is convicted of murder.

    Hamilton said the defense team will seek a verdict of guilty but mentally ill. They will present witnesses to tell the jury how growing up in an extremely violent home left Hargrove with post traumatic stress disorder and schizoaffective disorder.

    Psychiatrist testifies in capital murder trial

    A psychiatrist testified Monday that Adrian Hargrove told him that he didn’t know how or why he killed a pregnant teen and her parents six years ago.

    Hargrove, 36, is on trial for the Feb. 9, 2008, killings of 18-year-old Allyson Pederson and Sharon and Andrew Hartley.

    Pederson’s body was found set on fire at the Lock and Dam Road around noon that day, about the same time as the Hartleys were discovered in the blood-soaked master bedroom of their Bennock Mill Road home. Each had been beaten and repeatedly stabbed.

    Dr. Richard Dudley, a forensic psychiatrist, testified in Richmond County Superior Court that Hargrove has had post traumatic stress disorder since childhood.

    Hargrove’s childhood was chaotic and traumatic with repeated exposure to violence and drug abuse, Dudley testified. Hargrove also has a delusion disorder and depressive disorder.

    In Dudley’s opinion, Hargrove meets the criteria for a finding of guilty but mentally ill.

    In cross examination, Assistant District Attorney Hank Syms questioned the validity of Dudley’s diagnosis if the information he was given was incorrect. For example, Hargrove told Dudley he was afraid of knives but he regularly carried one.

    Hargrove has spent most of his adult life in prison. He was arrested at age 13 with a stolen car; at 14 for shooting up a laundry mat with a BB gun and taking a gun to school; and at 17 and 19 for possession and selling drugs. Hargrove also did time for child molestation.

    If Hargrove is convicted of murder, the jury will be asked to determine punishment — life in prison with or without the possibility of parole or death.
