    Kim Raymond Kopatz - California Death Row

    Facts of the Crime:

    Sentenced to death on March 21, 2001 in Riverside County for the April 22, 1999 strangulation slayings of his wife and three-year-old daughter for insurance money. The verdicts brought sobs from the audience. Kopatz's immediate family and his wife's relatives were at opposite sides of the courtroom. Kopatz slowly shook his head and talked to his lawyer. Prosecutor William Mitchell used mostly circumstantial evidence to prove that Kopatz used an electrical cord to strangle his wife Mary, 35, and daughter, Carley, and then tried to make the murders appear to be random attacks by a robber, rapist or some other vicious stranger.

    Kopatz's case has been fully briefed on direct appeal before the California Supreme Court since January 14, 2013.

    People v. Kopatz

    Opinion Date: April 30, 2015

    Court: California Supreme Court

    After a jury trial, Defendant was convicted of the first degree murders of Mary Kopatz and Carley Kopatz. The jury returned a verdict of death, and the trial court imposed that sentence. The Supreme Court affirmed, holding (1) the trial court did not err in denying Defendant’s motion to suppress evidence of his videotaped interview with the police; (2) the trial court did not err in admitting a deceased witness’s prior consistent statement; (3) the victim impact evidence was neither unduly prejudicial nor so inflammatory that it invited the jury to make its penalty determination on a purely irrational basis; (4) Defendant was not prejudiced by a multiple-murder special-circumstance instruction and attendant verdict forms; and (5) Defendant’s challenges to the death penalty law failed.

    On August 25, 2015, Kopatz filed a habeas petition before the California Supreme Court.
