    The thing is,though,Michael, justicedenied (a website/magazine which looks over cases like this in good detail) has good reason to believe that Mr. Arthur here has been wrongly held on Alabama death row for 29 years! Also, unjust appellate laws in the state of Alabama make capital convictions harder to challenge, even compared to Texas! By the time Mr. Arthur could find a pro bono lawyer for post-conviction relief, the time to file a habeas petition first time had run out due to the controversial Anti-Terrorism and Effective Death Penalty Act limits. (Egregious Unfair Death Penalty Act,more like!)

    In my opinion enough US judicial sets of eyes have thoroughly viewed this case and opined for this execution to proceed.

    Man on Alabama death row makes appeal for new DNA test

    Lawyers for a convicted murderer who has spent the last 30 years on Alabama's death row and is due to be executed on March 29 are asking for a new DNA test to prove his innocence.

    Thomas Douglas "Tommy" Arthur, 70, has spent nearly half his life on death row for his role in the 1982 contract killing of Muscle Shoals businessman Troy Wicker Jr. Arthur's lawyers say no physical evidence linked him to the crime. "We do believe that reasonable doubt exists here, and advanced DNA testing could resolve any doubt," Arthur's lead attorney, Suhana Han, said in an email statement.

    The state plans to go ahead with the lethal injection barring a last-minute reprieve by the courts. Arthur's argument for the testing is based on testimony already found by a court to be untrue and has no bearing on the death row inmate's pending execution, said Assistant Attorney General Clay Crenshaw.

    I hope he wins that appeal for the DNA test, and seriously hope it exonerates him after all this time...or will it just confirm his guilt like it did in the posthumous investigation of the crimes committed by Roger Keith Coleman of Virginia and the Texas cases of Domingo Cantu (executed in 1999) and Ricky McGinn (executed in 2000)?

    Inmate to challenge execution changes

    An attorney for death-row inmate Tommy Arthur on Monday said she wants a chance to argue in court that the procedure the state plans to use this month to execute her client may be unconstitutional.

    Pro bono attorney Suhana Han argued in federal appeals court that an April 2011 change in Alabama’s execution procedure should have been significant enough to trigger an appeals process.

    The change was a switch in the first of three drugs administered during the lethal injection process. The state switched to the drug pentobarbital in 2011, when supplies for sodium thiopental ran low.

    Han argued Monday that pentobarbital, which causes unconsciousness, takes longer to act than sodium thiopental did and may not be as effective. It is a possible violation of the Eighth Amendment, which protects against cruel and unusual punishment, Han said.

    The second injection in the trio causes paralysis, so even if an inmate were still conscious, they may not be able to communicate that they can feel pain, Han said.

    “We want to test the state’s claim that (the procedure) is constitutional,” Han said.

    Assistant Attorney General Clay Crenshaw argued Monday that the switch in drugs was not a significant change to the state’s lethal injection procedure and that safeguards are taken to ensure an inmate is unconscious.

    Those safeguards include saying his name, waving a hand close to his eyes and pinching him.

    Monday’s hearing lasted almost two hours. Crenshaw said he expects the three-judge panel to make a decision later in the week or early next week.

    Arthur, who was sentenced to death for the Feb. 1, 1982, contract killing and robbery of Troy Wicker Jr. in Muscle Shoals.

    On the day of the murder, Arthur is said to have walked away from a work release program in Decatur and drove to Muscle Shoals.

    He is scheduled to die March 29. This is the fifth execution date set for Arthur.

    I bet he will get a stay just like that guy in Texas last year.

    Arthur already got a stay and had dna testing. It was negative for the guy they alleged confessed to the crime. Why would he get another stay?
