    Kharon Davis Sentenced to Life with the Chance of Parole in 2007 AL Slaying of Pete Reaves

    Jury selection starts nearly four-year-old capital murder case

    Lawyers expect to start selecting jurors in the capital murder case filed against a 27-year-old Dothan man today.

    Dothan police investigators arrested Kevin McCloud on June 12, 2007, three days after the murder of Pete Reaves. Police charged McCloud with capital murder robbery.

    Lawyers expect to start the trial today in front of Circuit Court Judge Butch Binford.

    McCloud became one of three people Dothan police charged with capital murder in the shooting death of Reaves at his Rolling Hills apartment on June 9, 2007. Lorenzo Stacey already went to trial for his capital murder charge and a jury found him not guilty. But the capital murder charge filed against Kharon Davis remains pending.

    The murder happened during a scuffle at an apartment where the three men allegedly went to buy drugs, police said, according to a previous Dothan Eagle report. McCloud suffered a gunshot wound to the neck.

    If convicted of the capital murder charge McCloud faces the death penalty or life in prison without the opportunity for parole.

    Houston County District Attorney Doug Valeska will prosecute the case for the state of Alabama. Lawyers Tom Brantley and T.J. Haywood will defend McCloud at trial.

    Davis’ capital murder case is scheduled for trial next month in front of Circuit Court Judge Kevin Moulton.

    Man pleads guilty in 2007 murder

    Kevin McCloud apologized Tuesday to more than a dozen people for the 2007 slaying of 29-year-old Pete Reaves.

    But Betty Reaves, Pete's mother, said afterward that the apology was hard to accept because it won't bring her son back.

    McCloud, 27, pleaded guilty to a murder charge, reduced down from the original capital murder charge. Circuit Court Judge Butch Binford sentenced McCloud to a 99-year prison term as part of the plea agreement between the prosecution and defense lawyers Tom Brantley and T.J. Haywood.

    “I got a little bit of closure,” Betty Reaves said. “We had to have a little bit of closure because we didn’t get nothing for the first one.”

    McCloud was one of three people charged with capital murder in the shooting death of Reaves at his Rolling Hills apartment on June 9, 2007. One of the other suspects, Lorenzo Stacey, already went to trial and a jury found him not guilty.

    As part of the plea agreement, District Attorney Doug Valeska said McCloud will testify against Kharon Davis, who is believed to have been the trigger man in the murder. His capital murder charge remains pending, and is set for trial next month. Valeska also agreed not to protest at McCloud’s parole hearing after it came up for a fourth time.

    “I just want to apologize to the Reaves family,” McCloud said during court. “I’m sorry for your loss. I’m sorry.”

    Valeska said the evidence included how the men went to the victim’s home to purchase marijuana, and that a stolen 9 mm handgun was used in the commission of a robbery. He said $700 cash was believed to have been kept in Reaves’ cabinets at the time of the murder.

    Valeska also said the evidence against McCloud included how Davis actually pulled the trigger during the shooting, which left McCloud with a gunshot wound to the neck. Valeska said the gunfire erupted as a fight broke out between the men in the apartment. He said Reaves suffered two gunshot wounds, including one to the chest.

    Homer Reaves, Pete’s father, said regardless of what his son “got caught up in” he didn’t deserve what happened to him in his own home.

    “They didn’t have to kill him. I just want people to understand that’s not who he was. To us he was a Robin Hood,” Homer Reaves said. “We got some justice, and some closure for him.”

    Attorney removed from capital murder case

    A Houston County judge removed the defense attorney Tuesday for a Dothan man charged with capital murder in a 2007 slaying.

    Circuit Court Judge Kevin Moulton removed attorney Ben Meredith from serving as the lead counsel for Kharon Davis.

    Davis, 27, faces the death penalty if convicted in the shooting death of 29-year-old Pete Reaves. Davis was one of three people arrested by Dothan police investigators in the shooting death of Reaves at his Rolling Hills apartment on June 9, 2007. One of the other suspects, Lorenzo Stacey, already went to trial and a jury found him not guilty.

    The third man, Kevin McCloud, received a 99-year prison sentence after he pleaded guilty to a lesser murder charge.

    As part of McCloud’s plea agreement, District Attorney Doug Valeska said McCloud will testify against Davis, who is believed to have been the trigger man in the murder.

    Moulton removed Meredith from serving as Davis’ defense attorney due to a conflict of interest in the case. Moulton removed Meredith to prevent a show of impropriety since Meredith’s son, Frank, was a planned witness for the prosecution. He is a former Dothan police detective who worked the murder.

    “I’m not willing to set this up for reversal, and allow Mr. Meredith to continue,” Moulton said. “It is an issue, and I’ve consulted with the state bar. I don’t want to create any kind of reversal issue.”

    Attorney Allen Mitchell, who also represents Davis, suggested he could handle all matters at trial involving former police Investigator Frank Meredith.

    Meredith also asked the court to allow him to continue to serve if his client approved it and waived any objections.

    Moulton denied the requests.

    “It’s nothing personal against you, and I understand your desires,” Moulton said. “I’m going to appoint someone who is experienced.”

    Mitchell said the defense objected to the court’s ruling.

    A tentative trial date for Davis has been set for January 2012.

    Lawyers in 8-year-old pending capital murder case allowed to withdraw

    A judge has granted a request by two lawyers to withdraw from representing a Dothan man who has been in jail for eight years waiting for his trial for the capital murder charge filed against him.

    Attorney Derek Yarbrough said Circuit Court Judge Kevin Moulton granted his request in open court Tuesday morning to withdraw from serving as a defense attorney for 31-year-old Kharon Torchec Davis. Yarbrough said the court also granted a similar request to withdraw made by his co-counsel, attorney Allen Mitchell.

    The request to withdraw made by defense counsel Tuesday became the second made before the court. The court denied an earlier request made in September 2014.

    “Basically it’s the strained relationship between the attorneys and the client,” Yarbrough said. “Basically it’s the personal attacks by the family and then attacks by Jon Carroll and his website making false claims and personal attacks.”

    Jon Carroll runs an Internet blog, on which he has made several posts about Davis’ pending capital murder case. Yarbrough said the posts involved defense counsel and how they’ve handled the Davis case.

    Yarbrough said the court will now appoint two completely new lawyers to handle Davis’ pending capital murder case.

    Yarbrough and Mitchell made their second request to withdraw Tuesday morning during what’s called an Ex Parte court hearing, which is typically only between the court and the defense counsel, and closed to the public.

    Davis was one of three men charged with capital murder in the shooting death of Pete Reaves on June 6, 2007.

    Davis’ capital murder–robbery case was scheduled for trial in August 2014, but was delayed after Davis’ lawyers asked for more time to obtain an expert defense witness to testify about physical evidence recently discovered by the defense team.

    After the delay the court set a new trial date of April 18, 2016.

    One of the other three suspects charged with capital murder, 32-year-old Kevin Bernard McCloud, pleaded guilty to felony murder. He received a 99-year prison sentence.

    Dothan police arrested Davis, McCloud and 44-year-old Lorenzo Stacey, charging them all with capital murder-robbery in the shooting death of Reaves at his Rolling Hills apartment.

    Stacey went to trial less than two years after the murder. He was acquitted of capital murder on Feb. 26, 2009.

    Davis remains held at the Houston County Jail without bail.

    Three new lawyers appointed in 9-year-old Dothan murder case

    A Houston County judge recently appointed three new lawyers to represent a Dothan man charged with capital murder.

    Court records show Circuit Court Judge Kevin Moulton issued an order this week appointing three lawyers to represent 31-year-old Kharon Torchec Davis. Records revealed details about Davis’ pending capital murder case, which will be nine years old this year.

    Davis’ attorneys of record for the last several years, Derek Yarbrough and Allen Mitchell, were recently allowed to withdraw from representing Davis.

    The court ordered attorney Chris Capps to serve as the new lead counsel for Davis with attorney Dustin Fowler serving as the co-counsel. With the permission of Alabama Office of Indigent Defense Services the court also appointed a third attorney, Christopher Williams. The court cited the case’s age as the reason for appointing a third attorney.

    Dothan police arrested Davis along with two other men on June 6, 2007, in the shooting death of Pete Reaves at his Rolling Hills apartment.

    Yarbrough and Mitchell had made two requests in the last couple of months to withdraw based on a number of reasons. The court issued a detailed four-page order when it granted the request to withdraw made by Yarbrough and Mitchell.

    Before allowing the former defense counsel to withdraw and appointing new lawyers the court gave Davis the choice to go forward with Yarbrough and Mitchell and have his trial in April 2016, or he could have new lawyers. The court explained to Davis that if he were appointed new lawyers it would likely delay his trial date another two to three years because he would have new defense counsel and there will also be a new Houston County district attorney elected who will have to acclimate himself with the case. Davis chose to receive new appointed lawyers.

    The grounds for requesting the removal of his lawyers by Davis started in August 2015 when he wrote a letter to the court formalizing his request. That first request was denied by the court in September.

    Shortly thereafter both Yarbrough and Mitchell submitted formal requests to withdraw, and during a September court hearing both defense counsel and the defendant spoke of issues that had arisen between them. The court did not find the defense counsel had been deficient as Davis had believed, and found no basis for granting the requests to withdraw.

    Both Yarbrough and Mitchell filed a second request to withdraw last month, citing further deterioration of the attorney-client relationship because of actions of the defendant and others, which included posts to internet websites and an interview by the defendant’s mother on a radio talk show about the case.

    At another court hearing earlier this month, Yarbrough and Mitchell informed the court their attorney-client relationship actually started deteriorating in early 2015, which included one visit to the Houston County Jail when the defendant had informed them his family had hired another attorney and he did not know they were still his lawyers. At that time, Yarbrough and Mitchell continued their representation of Davis because the court had not informed them of any change.

    The court’s order also cited how Davis apparently refused to see one of his defense lawyers, Mitchell, on at least two occasions during 2015, most recently in late November.

    After the court granted Davis’ request to have new lawyers appointed it delayed any new potential trial date.

    A Houston County judge recently appointed another new attorney to represent a Dothan man charged with capital murder who has been awaiting trial more than nine years.

    Court records show Circuit Court Judge Kevin Moulton recently issued an order allowing attorney Chris Capps to withdraw from representing 31-year-old Kharon Torchec Davis.

    Capps and two other lawyers were just appointed to the case earlier this year. Records show Capps was allowed to withdraw after he consulted the state Bar Association about a conflict of interest he discovered in his representation of Davis.

    A Dothan man jailed for over nine years on a pending capital murder charge hopes to get released from custody after a bail hearing on Friday.

    Lawyers for 31-year-old Kharon Davis recently filed a request for bail to be set by the court. Circuit Court Judge Kevin Moulton will hear arguments Friday on the bail request made by attorney Dustin Fowler, one of three lawyers representing Davis on his pending capital murder charge. Montgomery attorney Thomas Goggans and another Dothan attorney, Christopher Williams, also represent Davis.

    Moulton will also hold a scheduling and status conference for the Davis capital murder case on Friday. Goggans was appointed to Davis’ legal team earlier this summer.

    Dothan police arrested Davis, along with two other men, on June 6, 2007, in the shooting death of Pete Reaves at his Rolling Hills apartment.

    Fowler suggested in the request filed with the court for bail that his client has no problem wearing an ankle monitor if reasonable bail is granted by the court.

    The court allowed Davis’ previous lawyers, Derek Yarbrough and Allen Mitchell, to withdraw earlier this year based upon their own requests and requests made by Davis.

    Before allowing the former defense counsel to withdraw and appointing new lawyers, the court gave Davis the choice to go forward with Yarbrough and Mitchell and have his trial in April 2016, or he could choose new lawyers and delay the case further.

    Hearing delayed for man still awaiting trial in 2007 Dothan capital murder case

    A Dothan man awaiting trial on capital murder charges since 2007 has had a hearing scheduled for this week delayed, at the request of his attorney.

    Thomas Goggans, one of the attorneys representing Kharon Torchec Davis, requested and received a continuance for a motion hearing originally scheduled for Thursday, Oct. 13. The new hearing date is Nov. 9.

    Goggans, who practices law in Montgomery, requested the delay late last week because he was scheduled for surgery this week and doctors did not want him driving for seven days.

    Dothan police arrested Davis, along with two other men, on June 6, 2007, in the shooting death of Pete Reaves at his Rolling Hills apartment. Since then, the trial has been delayed repeatedly, with multiple continuances granted after requests from both the prosecution and defense.

    The continuance is not expected to change the trial date, currently set for September of 2017. The trial date was most recently delayed earlier this year after Davis fired his previous lawyers. Goggans was appointed in July of this year and told Circuit Court Judge Kevin Moulton he would need considerable time to become familiar with the case.

    Thursday’s motion hearing was scheduled to deal with a request from the Davis defense to require the prosecution to reveal the identities of any confidential informants, and/or whether any threats or inducements were made to any witness or informant.

    Dothan attorneys Dustin Fowler and Christopher Williams are also assisting with the Davis defense.

    As 10 years in jail awaiting trial approaches, Kharon Davis capital murder case moving forward

    A potential change in prosecutors won’t delay the scheduled trial of a man awaiting his day in court for more than nine years.

    District Attorney Doug Valeska did not seek re-election this year and will be replaced by DA-elect Pat Jones in January. Kharon Davis, charged with murder in the 2007 killing of Pete Reaves at his Rolling Hills apartment on Denton Road, has yet to go on trial.

    His trial is scheduled for September of 2017 and Circuit Judge Kevin Moulton said nothing will delay the scheduled trial date.

    “It’s going to happen in September,” Moulton said during a motion hearing in the case on Wednesday. “It’s going to happen.”

    Jones has said earlier that he may not be able to serve as prosecutor due to a conflict. Jones said he served as defense attorney for one of the former co-defendants in the case.

    That means the Alabama Attorney General’s office will appoint a prosecutor to the case. It could be a current assistant attorney general or a supernumerary district attorney. The office could appoint Valeska, who has served as the case prosecutor since Davis’ arrest.

    Valeska said Wednesday he will be in contact with the Attorney General’s Office of Prosecutorial Services this week to encourage the office to make an appointment.

    “I know you want a trial, judge,” Valeska said Wednesday. “The state’s position is to move it up sooner to April or something.”

    The case was set for September of next year in order to allow Davis’ new attorneys to prepare for trial. Thomas Goggans of Montgomery was recently appointed and will represent Davis along with local attorneys Christopher Williams and Dustin Fowler.

    “I would like for a prosecutor to be on the case, certainly, by the end of the year,” Moulton said. “I’d really like to see one by the end of the month.”

    Wednesday’s hearing dealt with a defense request for the prosecution to disclose any inducements that may have been offered to any witnesses expected to testify at trial.

    Davis has been at the Houston County jail for 9.5 years awaiting trial. It has been continued numerous times, most recently when Davis sought to fire previous attorneys.
