    Accused killer Clem Beauchamp gets new lawyers

    Accused killer Clem Beauchamp received two new attorneys this morning to fight first-degree murder charges in the deaths eight months apart of his ex-girlfriend and her two children.

    Circuit Judge Richard Oftedal appointed defense attorneys Michael Maher and Ron Chapman to represent Beauchamp during a hearing in the death penalty case this morning.

    Beauchamp, 35, was indicted on first degree murder charges in September in connection with the deaths of 25-year-old Felicia Brown and her two children.

    Brown's badly decomposed body was discovered at a West Palm Beach landfill in August 2010. The bodies of her 10-year-old son, Jermaine McNeil, and 6-year-old daughter, Ju'Tyra Allen, were discovered in March stuffed in pieces of luggage found floating in a Delray Beach canal.

    Beauchamp's case was originally assigned to the public defender's office, which withdrew from the case. Beauchamp then had an attorney from the Criminal Conflict and Civil Regional Counsel Office, which handles cases when a public defender's office has a conflict, but attorneys from that office withdrew as well this morning.

    Oftedal set another hearing in Beauchamp's case for May 7. Beauchamp last year was sentenced to 10 years in prison on a federal gun charge. Prosecutors have said that Brown was expected to be a witness against him in that case when she disappeared.

    Lengthy investigation pushes trial of man accused in deaths of Delray mom, kids to 2014

    It’s been two years since authorities announced the arrest of Clem Beauchamp in the separate murders of his girlfriend and her two children, but lawyers in the case still have a long way to go before the case is ready for trial.

    In a hearing in Beauchamp’s case this week, prosecutors and his defense attorneys said although they have already conducted multiple witness interviews in the case, they still have far to go — so far that they won’t even appear in court to discuss the case again this year. Circuit Judge Richard Oftedal set the next hearing in the case for February 11.

    Documents: Clem Beauchamp used son to help dump children's bodies in Delray Beach canal

    WEST PALM BEACH — The bags were dark and heavy as the boy and his father hauled them from the family's blue Oldsmobile Cutlass. Together, they grunted and strained - "a good workout," his father had called it - until the pair had muscled the bags up and into the canal.

    Demetrius Beauchamp, then 15, never questioned the strange chore he did with his father, Clem Beauchamp, the boy said later in a statement to investigators. Nor did he suspect it was connected to the disappearance of his stepbrother and stepsister in February 2011.

    Days later, the bodies of Demetrius' playmates, Jermaine McNeil, 10, and Ju'Tyra Allen, 6, bobbed to the surface of the C-15 canal between Delray Beach and Boca Raton, shrouded in oversized luggage and loaded down with 35-pound barbell weights.

    Soon after, police announced that the children's mother had been identified as the nameless woman whose body was discovered at a county garbage dump months earlier.

    The teen's chilling account was part of more than 1,000 pages of documents made public today in the state's first-degree murder case against Clem Beauchamp, a case in which prosecutors are seeking the death penalty.

    Among the new details:

    - The children's mother, Felicia Brown, likely was murdered by asphyxiation, though the poor condition of her body made it impossible to say for sure, the medical examiner's office concluded.
    Jermaine, who died by blunt force trauma, had his jaw broken in at least two places and a tooth cracked. Ju'Tyra had likely had duct tape wrapped tightly around her mouth when her body was tossed into the water.

    - A key part of the prosecution's case against Beauchamp hinges on statements made by a felon, Arthur Lee Harmon II, 33, who shared a jail cell with Beauchamp in March 2011 and who was facing prosecution for federal gun charges. Prosecutors later asked a judge for leniency during Harmon's sentencing hearing, citing his cooperation.

    - Beauchamp insisted to detectives that a man named Mike, Felicia Brown's new boyfriend, had taken custody of the children, although investigators quickly poked holes in the story.

    The investigation that led to Beauchamp's arrest began March 2, 2011, when the bodies of two small children were found wrapped in luggage and discarded in the south county canal. A day later, Beauchamp went to Delray

    Beach police and told them that the murdered kids might belong to Brown, his ex-fiancee. He was taken into custody that night on an unrelated federal gun charge, giving detectives more time to build a case against him.

    Beauchamp shared a jail cell with Harmon, who previously had been convicted of crimes ranging from grand theft auto to aggravated assault with a weapon. He now was facing federal gun charges.

    Harmon told investigators Beauchamp confessed to the killings, saying Brown "deserved to die, but the kids, you know I don't know why I did that to the kids."

    Harmon said Beauchamp told him he "squeezed the baby" - Ju'Tyra - in his arms until she died.

    Harmon would plead guilty in his federal gun case, and the prosecutor - the same assistant state attorney who handled Beauchamp's gun charge - recommended Harmon receive a reduced sentence in exchange for his cooperation. He got two years in prison.

    Convicted in his federal gun case, Beauchamp was sentenced to 15 years last year. He's now appealing.

    The documents also raised questions about Michelle Dent, who was living with Beauchamp when the children were murdered. Investigators learned that a woman matching her description applied for and received a tax refund of more than $7,000 in Brown's name.

    The Florida Department of Children and Families said Dent had posed as Brown in August 2010 and requested that Brown's state subsidy checks be sent to a different address. Since then, five of Brown's checks totaling $2,000 were cashed.

    Dent failed key parts of a lie detector test, according to an examiner, including when asked whether she killed Felicia Brown, coached her kids for police interviews and knew who had murdered Brown, Jermaine and Ju'Tyra.

    Police have said Dent never was a suspect in the killings, although a DCF investigator called her a person of interest in a 2011 hearing. Dent hasn't been charged with a crime.

    The documents also described strange behavior by Beauchamp after the children disappeared. A friend of Beauchamp and Dent said she was with the couple when news first spread that children's bodies had been found.

    She said Beauchamp vomited and rolled on the ground, acting hysterical.

    On March 3, the day Beauchamp was arrested, he and Dent went to Jermaine and Ju'Tyra's school to answer questions about the children's absence. A school official asked Beauchamp where the children were. She told police he didn't respond immediately. She said he stared blankly, looking at no one in particular, and mumbled something she recalled more than a month later:

    "They're with her mother," Beauchamp said.

    Witnesses still being interviewed in 2011 triple murder case against Delray man

    WEST PALM BEACH — Attorneys in the death penalty first-degree triple murder case of Clem Beauchamp are still interviewing witnesses surrounding the murders eight months apart of his girlfriend and her two children, they told a judge Tuesday.

    At a status hearing for Beauchamp Tuesday, Palm Beach County Circuit Judge Richard Oftedal scheduled the case for another hearing on May 7 to determine how close the attorneys are to being ready for a trial.

    Beauchamp, of Delray Beach, was arrested in September 2011 for the murders of his 25-year-old girlfriend Felicia Brown and her two children, 10-year-old Jermaine McNeil, and 6-year-old Ju’Tyra Allen.

    Brown’s body was found in a Palm Beach County landfill in August 2010, but she wasn’t identified until after her children’s bodies were found stuffed in suitcases floating in a Delray Beach canal the next March. Brown’s children had been living with Beauchamp since their mother’s disappearance.

    Prosecutors after Beauchamp’s arrest announced they would be seeking the death penalty against him if he’s convicted. He was also sentenced to 10 years in prison in 2011 on a federal gun charge. Federal prosecutors say Brown was set to testify against him in that case when she disappeared.

    Clem Beauchamp, the man who faces the death sentence if convicted in the murders of his girlfriend and her two children, accepted a plea deal in court this morning on an unrelated marijuana sales charge.

    Circuit Judge John Kastrenakes sentenced Beauchamp to a three-year sentence for marijuana possession but gave him credit for the time served since he was arrested on three murder charges in 2011, meaning he’ll serve no additional time behind bars for that charge.

    Beauchamp, 37, of Delray Beach, was arrested in September 2011 in the murders of his 25-year-old girlfriend Felicia Brown and her two children, 10-year-old Jermaine McNeil, and 6-year-old Ju’Tyra Allen.

    Brown’s body was found in a Palm Beach County landfill in August 2010, but she wasn’t identified until after her children’s bodies were found stuffed in suitcases floating in a Delray Beach canal the next March. Brown’s children had been living with Beauchamp since their mother’s disappearance.

    According to court records, Beauchamp’s arrest on the marijuana charge came more than a year before prosecutors charged him in the deaths of Brown and her children. The April 2010 arrest is for marijuana possession with the intent to sell within 1,000 feet of a church.

    Prosecutors said members of a Delray Beach Police SWAT team raided Beauchamp’s home and found more than 25 grams of marijuana and some plastic packaging bags along with extinguished marijuana cigarettes in Beauchamp’s bedroom.

    Beauchamp, who is at the Palm Beach County jail awaiting trial, is also serving a 10-year federal prison sentence on a weapons charge. Federal prosecutors say Brown was set to testify against him in that case when she disappeared.

    The next hearing on Beauchamp’s murder case is scheduled for Jan. 16.

    Delray man accused of killing mom, 2 kids, to stand trial in October

    A trial for a Delray Beach felon accused of three murders, including the deaths of two children, is coming this fall.

    Palm Beach County
    Circuit Judge John Kastrenakes on Friday scheduled a Sept. 22 court date to determine precisely when to begin jury selection in the high-profile case against Clem Beauchamp, 38.

    The State Attorney's Office is seeking the death penalty against Beauchamp for the killings of Jermaine McNeil, 10, Ju'Tyra Allen, 6, and their mother, Felicia Brown, 25.

    "I expect everybody ready to go," Kastrenakes told prosecutors and defense attorneys, as Beauchamp sat nearby in the courtroom. "We'll be in trial most of the month of October on this case."

    Prosecutors Terri Skiles and Reid Scott estimate it will take about five weeks, if the jury convicts Beauchamp and then considers whether to recommend death or sentences of life in prison.

    The last time Beauchamp appeared in court before Friday was Dec. 16, when he pleaded guilty to two unrelated drug crimes from April 2010 and received a three-year prison sentence.

    Represented by attorneys Ronald Chapman and Michael Maher, the defendant continues to serve a 10-year federal prison term he received in 2011 for possessing an illegal handgun silencer.

    Also in 2011, a Palm Beach County grand jury indicted Beauchamp with three counts of first-degree murder.

    The body of Brown, who was Beauchamp's on-and-off girlfriend, was found at a West Palm Beach trash-processing facility in August 2010 and went unidentified until the deaths of her children. Brown had their names tattooed on her leg, leading to her identification.

    In March 2011, the decomposing bodies of Jermaine and Ju'Tyra were found, stuffed into luggage, in the canal that divides Delray Beach and Boca Raton. The kids had been living with Beauchamp in his Delray Beach home after Brown's disappearance the previous summer.

    During an interrogation by Delray Beach police detectives, Beauchamp insisted he loved the boy and girl as if they were his own kids, according to court records.

    "I wouldn't do nothin' like that," Beauchamp said, after he was shown photographs of the children.

    Records show Ju'Tyra died of asphyxiation; her face was wrapped in tape. Jermaine died of blunt trauma to his head. According to the indictment, Beauchamp killed Brown by "unspecified means."

    Federal prosecutors have alleged Beauchamp may have been motivated to kill Brown because she was a key witness against him in the gun case.

    The firearms charge against Beauchamp arose when Brown's car was repossessed from his Delray Beach home in 2009. A tow-yard employee found a black bag containing a .22-caliber revolver and a homemade silencer, and 12 rounds of ammunition.

    Brown later told a tow-yard employee the bag was her boyfriend's, according to prosecutors.

    Plea deal would spare Delray felon from possible death sentence in murders of ex-girlfriend, two kids

    Rather than stand trial next week and face a possible death penalty, Clem Beauchamp is expected Friday to plead guilty to the murders of a Delray Beach mother and her two young children.

    A tentative plea deal calls for Beauchamp, 38, to take responsibility for the heinous slayings of Felicia Brown, 25, Jermaine McNeil, 10, and Ju'Tyra Allen, 6, in exchange for three consecutive life sentences.

    If Palm Beach County Circuit Judge Charles Burton accepts the proposed terms, it would resolve a case that was first reported after the March 2011 discovery of the children's decomposing bodies inside luggage dumped in the canal separating Delray Beach and Boca Raton.

    Their murders enabled detectives to identify Brown, whose body was found at a West Palm Beach trash-processing facility in August 2010. The woman had the names Jermaine and Ju'Tyra tattooed on her leg. Another breakthrough in the case later allegedly tied Beauchamp to dumping the bags with the kids' remains.

    A hearing on the plea deal is scheduled for 8:30 a.m., according to court records. Defense attorney Ronald Chapman could not be reached Thursday despite a call to his office, while defense attorney Michael Maher answered a call but quickly said he had to go.

    Beauchamp's pending guilty pleas angered Yves A. Gissome, brother to Brown and uncle to the children; he said he was shocked to get the news from Assistant State Attorney Terri Skiles.

    Gissome told the Sun Sentinel he had long hoped a trial would not only provide justice for his family, but also help expose weaknesses in the criminal justice and social services systems. Jury selection for a monthlong trial had been set to begin Monday.

    "I can't fight the situation and I have to be diplomatic," Gissome said Thursday when asked if he was disappointed the death penalty appeared to be off the table. "Those kids should have been alive."

    The kids had been living with Beauchamp for about six months after Brown, his on-again, off-again girlfriend, vanished the previous summer, according to court files. Brown was gone with "no warning and no goodbyes" because Beauchamp had killed her, Skiles wrote in a September pleading in the case.

    Beauchamp, in one interview with detectives, insisted he had loved the boy and girl as if they were his own kids, records show. He said he taught Ju'Tyra how to swim and ride a bike, and played football with Jermaine.

    "Ju'Tyra calls me Dad," he said. "Jermaine...he's like a son."

    At one point during the interrogation, Beauchamp looked at photographs of the dead children.

    "I wouldn't do nothin' like that," Beauchamp said, before he asked for a lawyer. "I wouldn't help nobody do nothing like that."

    Beauchamp repeatedly said he walked the children to their school bus stop on Feb. 22, 2011, and that they were going to be picked up after school by Brown's fiancé. He did not see them after that morning, he told detectives.

    Autopsies showed Jermaine McNeil died from a hit on the head, while Ju'Tyra died from a lack of oxygen — her face was wrapped in tape.

    Last month, Beauchamp's attorneys said they planned to argue Beauchamp's life should be spared, partly because he was extremely mentally disturbed at the time of the killings. The defense listed as experts two doctors to testify Beauchamp has substantial brain damage, wrote lawyers Chapman and Maher.

    Prosecutor Skiles had written Beauchamp deserves death for a variety of reasons, including the ages of the young victims, and that the crimes were "especially heinous, atrocious, or cruel" and committed in a "cold, calculated and premeditated manner."

    Beauchamp already is a convicted felon, currently serving a 10-year federal prison term he received in 2011 for possessing an illegal handgun silencer. In December 2014, he also pleaded guilty to two unrelated drug crimes from April 2010 and received a three-year prison sentence.

    Delray felon pleads guilty, gets 3 life sentences for murders of ex-girlfriend, children

    n a crowded, hushed courtroom Friday, Barbara Flint took several steps toward the man who had just pleaded guilty to killing her granddaughter and two of her great-grandchildren in exchange for three life sentences.

    The 77-year-old Boynton Beach woman cried and waved a fan on her face as she told Clem Beauchamp she had forgiven him for the pain he caused her and her extended family over the past five years.

    "I can't," the matriarch said softly as the killer from Delray Beach only once looked her way, "bring them back."

    By taking a plea deal on the eve of his trial, Beauchamp, 38, avoided a potential death sentence for the murders of Felicia Brown, 25, Jermaine McNeil, 10, and Ju'Tyra Allen, 6.

    The case first made headlines in March 2011, after the decomposing bodies of the children were found stuffed inside luggage dumped in the canal dividing Delray Beach and Boca Raton.

    Defense attorneys Ronald Chapman and Michael Maher called prosecutor Terri Skiles on Thursday to say their client was ready to "plead guilty in his best interest" to the three first-degree murder charges.
