A trial date has been set for a Pulaski man accused of killing his former landlord and burning her home on Jan. 19, 2010.
Circuit Court Judge Jim T. Hamilton scheduled jury selection to begin Monday, Aug. 8, with the trial to follow immediately for 42 year old Robert Wayne Garner, who is accused of causing the intentional death of Brenda Wilburn, whose body was found by emergency responders in a closet area in the remains of her burned home. He is charged with first degree murder, felony murder, aggravated arson and theft or burglary of $10,000 or more.
Although no notice to seek the death penalty has been filed by the District Attorney’s Office, the judge did tell Garners attorney, Stan Pierchoski, who is a death penalty qualified attorney, he would appoint a second counsel if a notice to seek the death penalty is filed.
Pierchoski said a motion for change of venue is being considered by the defense.
Garner also has been formally charged with aggravated burglary and theft of more than $1,000 in personal property for a crime that occurred in November 2009. A second trial date for these latter charges has not yet been set.
