    In today's orders, the United States Supreme Court declined to review Dixon's petition for certiorari.

    Appeals exhausted. Ruling could result in an execution date.

    Lucas County prosecutor seeks dates for executions

    The Lucas County prosecutor's office asked the Ohio Supreme Court on Tuesday to set execution dates for 2 former Toledo men convicted of burying a man alive in 1993 and leaving him to die.

    Archie J. Dixon, 41, and Timothy Hoffner, 42, are both on death row at Chillicothe Correctional Institution for aggravated murder. They were also convicted of kidnapping, aggravated robbery, and forgery.

    "Since his conviction and sentence, Hoffner and his attorneys have pursued all available avenues of appeal afforded under both Ohio and federal law," reads a motion filed with the high court on behalf of Prosecutor Julia Bates. "Every court that has examined Hoffner's claims has upheld his murder conviction and his death sentence."

    A similar motion was filed in Dixon's case.

    The U.S. Supreme Court last year reinstated Dixon's conviction and death sentence after the Cincinnati-based 6th U.S. Circuit Court of Appeals overturned them on the grounds that his conviction had been tainted.

    The body of Christopher Hammer, 22, was found in a shallow Sylvania Township grave. Hoffner, Dixon's accomplice, had led police to the body. Hoffner and Dixon reportedly led Mr. Hammer to the wooded area, let him smoke a cigarette and say a prayer, and then buried him alive.

    Kristen Wilkerson, Dixon's girlfriend, was convicted of kidnapping but was released from prison after she cooperated with police.

    A federal judge has issued a moratorium against carrying out Ohio's death penalty as he explores changes the state has made in its process after problems experienced in an execution early this year. The moratorium is set to expire in February.

    Should the state Supreme Court grant the motions, the executions will likely not occur for 2 more years.

    The court already has set dates for executions through Sept. 21, 2016.

    Today, the Ohio Supreme Court set March 20, 2019 as Dixon's execution date.

    Dixon's execution date has been changed to June 23, 2021.

    Gov. Mike DeWine pushes back execution dates of three convicted murderers

    COLUMBUS, Ohio—Gov. Mike DeWine on Friday announced he has again postponed scheduled execution dates for three convicted murderers, including one from Cuyahoga County.

    The reprieves, issued to Gregory Lott, Archie Dixon, and John Stojetz, are the latest in a series of execution delays ordered by DeWine since he took office in 2019, citing ongoing issues with the state’s ability to obtain lethal-injection drugs.

    Dixon, who has also had his execution date pushed back before, was scheduled to die on April 17, 2024. DeWine moved that date back to June 16, 2027. Dixon, of Sylvania Township near Toledo, was one of two men who buried 22-year-old Christopher Hammer alive in a two-foot grave in 1993 after they stole his car, tied him up and gagged him.

    Ohio hasn’t put anyone to death since Robert Van Hook in July 2018. That’s because, like other death penalty states, Ohio has had problems for years acquiring lethal-injection drugs, as pharmaceutical companies have increasingly been unwilling to sell drugs to be used in executions.

    DeWine has repeatedly expressed his concern that if companies find that Ohio used its drugs to put people to death, they will refuse to sell any of its drugs - not just the ones used in executions - to the state. That would endanger the ability of thousands of Ohioans – such as Medicaid recipients, state troopers, and prison inmates – to get drugs through state programs.

    As a result, DeWine said in 2020 that there would be no more executions in Ohio unless state lawmakers pick an alternative execution method -- a step the legislature has so far shown no interest in taking.

    The next Ohio death row inmate scheduled to be put to death is Cleveland murderer Keith Lamar on Nov. 16, according to the state’s prison agency.
