    MOBILE, Ala. (AP) -- Garrett Dotch has been found guilty of murder for the shooting death of his ex-girlfriend outside a Subway Restaurant where she worked on Old Shell Road in July of 2006. The jury is now deciding whether Dotch should spend life in prison without parole or be given the death penalty.

    Timarla Taldon had just left work and was sitting inside her car in the store's parking lot when Dotch came up to the car and fired a weapon at his former girlfriend. Some of the other workers at the restaurant tried to give her CPR until Emergency Medical personnel could arrive, but their efforts were unsuccessful.

    During his murder trial, prosecutors told the jury Dotch was a cold-blooded murderer who had been planning the crime for two years before actually carrying it out. A defense attorney for Dotch claimed his client was not guilty by reason of insanity.

    Shortly after closing arguments Tuesday morning, a Mobile County Circuit Court jury went into deliberations. After a break for lunch, the jurors returned to the courtroom a little later to announce their verdict of guilty.

    Now, that same jury has gone back into deliberations to decide whether to recommend Dotch be given a life in prison without parole sentence, or whether he should be given death by lethal injection.

    It will be up to the judge hearing the case to decide whether to accept the jury's recommendation, or pronounce his own sentence. Should the judge rule Dotch is to receive the death penalty, the case will be automatically appealed.

    MOBILE, Ala. (AP) -- After deliberating for nearly two days, a Mobile jury has recommended the judge sentence Garrett Dotch to death by lethal injection. Tuesday, that same jury found Dotch guilty of the shooting death of his ex-girlkfriend, Timarla Taldon.

    Back in 2006, Timarla Taldon was gunned down outside her workplace, a Subway Restaurant on Old Shell Road near University Boulevard in Mobile. Tuesday, a Mobile County Circuit Court Jury found Dotch guilty of capital murder.

    The jury spent part of Tuesday and all day Wednesday trying to decide whether they would recommend Dotch spend the rest of his natural life behind bars, or that he should be given the death penalty.

    Waiting for the jury’s decision wasn’t easy on either of the families touched by this tragedy. It also was a long week for the jury as they listened to emotional testimony during the trial.

    NBC15 News spoke with Tamarla Taldon’s father who said it’s now time to move on and forgive.

    Now, it's up to Mobile County Circuit Judge Rick Stout to decide between life without parole or death by lethal injection for Dotch.

    MONTGOMERY, Ala. (AP) - A state appeals court has upheld the death sentence given to a Mobile man in the 2006 shooting death of his ex-girlfriend after she finished work at a Subway restaurant.

    The Alabama Court of Criminal Appeals rejected defense arguments Friday as it affirmed the death sentence given to Garrett Dotch for the killing of Timarla Taldon, 24.

    Dotch, also 24 at the time of the killing, was accused of shooting Taldon to death after she got in her car and prepared to pull out. According to testimony, he became abusive after their breakup and had called her cell phone 51 times the day before she was killed.

    The appeals court rejected claims that the procedure used for witnesses to identify the accused were flawed and that the judge wrongly excluded evidence of his 2003 commitment to a mental health facility.

    Death row inmate in Mobile for court hearing

    A Mobile man on death row for murdering his ex-girlfriend is back in Mobile Metro Jail.

    Garrett Dotch was booked into the jail Friday night, July 25. He's expected to have a court hearing Monday, July 28.

    He was sentenced to death in July 2008.

    Dotch was convicted of capital murder in 2008 of killing 24-year-old Timarla Taldon. Prosecutors said Dotch shot Taldon 4 times outside the Subway restaurant on Old Shell Road.

    Testimony during the trial showed Dotch became abusive after they broke up. he had been convicted in 2004 of burglarizing her home and assaulting her, and had been ordered to stay away from her.

    Family members told FOX10 in 2006 Taldon has bought a gun just before she died, because she was afraid of Dotch.

    The day Taldon was killed, cell phone records show Dotch called her 51 times.

    10 or more of the 12 jurors must vote for the death penalty in order to recommend a death sentence.

    The Alabama Appeals Court upheld the death sentence in 2010.
