    Jury begins deliberations in Hulsey penalty phase

    PHOENIX (AP) -- A jury has begun deliberating on a sentence for a man convicted of murder in the 2007 shooting of a Glendale police officer.

    Jurors deliberated for a short time Monday before leaving for the day. They're scheduled to resume Tuesday.

    Bryan Wayne Hulsey was convicted last month of first-degree murder in the killing of 24-year-old Anthony Holly.

    Jurors now are considering whether to sentence Hulsey to death or life in prison.

    The 40-year-old Hulsey was a passenger in the vehicle pulled over for speeding and not having a license plate. He was serving as backup to another officer who made the stop.

    Prosecutors say Hulsey got out and fired two shots, one of which hit Holly.

    Defense attorneys argued Holly was unintentionally shot by the officer who made the stop.

    PHOENIX (CBS5/AP) - A jury still hasn't decided on a sentence for a man convicted of murder in the 2007 shooting of a Glendale police officer.

    Jurors deliberated for a second day Tuesday before leaving for the evening. They're scheduled to resume at 10 a.m. Wednesday.

    On July 31, a jury found aggravating circumstances existed in the trial, making Bryan Hulsey eligible for the death penalty, court officials said.

    The jury found two aggravating factors, according to Maricopa County Superior Court officials.

    Jury Sentences Bryan Hulsey to Death

    A Superior Court jury sentenced Bryan Hulsey to death for the murder of a Glendale police officer in 2007.

    The jury was unanimous in reaching the verdict and Hulsey stood and applauded when the verdict was read and said, "Good job," twice, CBS 5 News' Jonathan Lowe tweeted.

    Judge Joseph Kreamer, who thanked the jury, also sentenced Hulsey to nine years in prison on one count of attempted murder.

    The Maricopa County Superior Court jury began a fourth day of deliberations Thursday morning and announced they had a verdict just before 11 a.m. The verdict was read shortly after noon.

    The jury on July 31 found aggravating circumstances existed in the trial, making Hulsey eligible for the death penalty, court officials said.

    The jury found two aggravating factors, according to Maricopa County Superior Court officials.

    On July 28, the same jury found 40-year-old Hulsey guilty of first-degree murder in the shooting death of 24-year-old Glendale police Officer Anthony "Tony" Holly during a 2007 traffic stop.

    Hulsey was also convicted of attempted first-degree murder.

    Glendale Police Chief Debora Black issued the following statement in the wake of the verdict:

    "Seven years, five months and nine days ago Glendale Police Officer Tony Holly was killed in the line of duty. Today, a jury has confirmed that Brian Wayne Hulsey is guilty of murdering Tony as well as the attempted murder of Officer David Goitia.

    "While the decision today cannot relieve the pain of losing Tony, we are hopeful that it provides some comfort for his family, our department and our community. We continue to remain steadfast in our assertion that justice for Tony and his family will prevail as we enter the penalty phase of the trial."

    Hulsey was a passenger in a vehicle that had been pulled over for speeding and not having a license plate.

    Holly was there to serve as backup to another officer who made the stop.

    His attorneys have denied he killed Holly and instead suggested that Holly was unintentionally shot by the officer who pulled over the vehicle.

    Cop Killer Applauds His Own Death Sentence

    PHOENIX (KSAZ) - After 7 years of delays, there is finally closure for the family of slain Glendale Police Officer Anthony Holly.

    The man who shot and killed him was sentenced to death. Bryan Hulsey fired several attorneys in order to delay his trial, and he was again defiant in court as the verdict was read.

    Holly's family said they walked out of court without any sense of happiness. They say they will never feel happy, but what they do feel today is relief.

    The family of murdered Glendale Police Officer Anthony Holly have a verdict in the case.

    The defendant, Bryan Hulsey was sentenced to death for the traffic stop shooting that left Holly dead.

    "We feel a sense of relief that Tony's killer will never see a free day, and will never hurt anyone again," said Nancy Bonner.

    "Relief because this trial is behind us because it is no longer hanging over our head," said Bernie Holly.

    Hulsey's attorneys argued Holly died from the friendly fire of another office present. Hulsey's family maintains their son is innocent.

    "It's not justice, it's not the truth coming out," said BJ Hulsey.

    "In this trial, there was no evidence at all, and it was reasonable doubt left and right and that jury had their minds made up from the moment they went in there," said Rondyl Hulsey.

    One family's quest for justice now over, but the loss of the 24-year-old Glendale Police Officer will be with them forever.

    "As significant a conclusion of this trial is, and how just the verdict and sentence are, it does not begin to touch the pain for what was taken February 19th, 2007," said Glendale Police Chief Debora Black.

    "Our wonderful Tony is not coming home, this court trial does not change that, we all continue to miss Tony with every breath," said Bonner.

    Hulsey has 20 days to appeal the verdict; the judge said Hulsey will die by lethal injection.

    AZ Death Penalty: State Supreme Court Throws Out Fourth Verdict

    For the fourth time in nearly two years, the court tossed a verdict from Maricopa County because of judicial error.

    PHOENIX, AZ – Another death penalty verdict out of Maricopa County has been tossed by the state's Supreme Court. It was the fourth time in 18 months that the justices on the state's highest court overturned a Superior Court judge had failed to let jurors know that there was no way the defendant would ever walk out jail.

    The justices threw out the death penalty for Bryan Hulsey who had been convicted of murdering Glendale police officer Anthony during a routine traffic stop in 2007.

    The court found that by not telling jurors that Hulsey was ineligible for parole – the state abolished parole in 1993 – was error and not harmless."

    Because of that, the justices have ordered the Superior Court judge to hold a new sentencing trial.

    In each of the death penalty cases where the verdict was thrown out, prosecutors were allowed to leave jurors with the impression that the defendant could theoretically pose a danger down the road.

    Two of the cases were prosecuted by the same Deputy Maricopa County Attorney.

    In other case, the appeals went all the way to the Supreme Court of the United States, which overturned the death penalty verdict.

    A new trial date for the penalty phase has not yet been set.

    What makes me mad about these is that the 'never walk out of prison' argument isn't true, even when a state has no parole system. Laws may very well change in the future, as we have seen on this list any number of times, where it was stated a prisoner would never get out of prison and then laws changed and they got parole.

    Man convicted of killing Glendale police officer no longer faces death penalty

    The Maricopa County Attorney's Office has decided to no longer seek the death penalty for a man convicted of killing a Glendale police officer.

    The decision comes after the Arizona Supreme Court vacated the original sentence for Bryan Hulsey, 46, who was convicted in 2014 of first-degree murder for the killing of Officer Anthony Holly and attempted first-degree murder involving a second officer, David Goitia.

    The Arizona Supreme Court vacated Hulsey's death sentence in 2018 following a U.S. Supreme Court ruling concerning another Arizona man on death row.

    Maricopa County Attorney Allister Adel told The Arizona Republic the office looks at a number of factors when deciding to seek the death penalty.

    "In this case, it was determined that moving forward with capital litigation would not result in the desired outcome," she said in a statement on Thursday.

    Hulsey's resentencing is set for October.
