Overall, if you're pro-capital punishment, then they're often a tremendous pain. However, if a three-member panel decision ends up actually going against a condemned inmate, it seems that the Ninth Circuit sitting en banc doesn't normally overrule the panel. There's also another thing I've noticed but that I don't have the statistics at my fingertips to back up: it appears that the Ninth Circuit much more frequently upholds Arizona death sentences than California death sentences. I'm not exactly sure why this is. Perhaps the quality of California capital representation has actually been, on the whole, lower than Arizona's.

On the Ninth, Republican appointees are likelier than Democratic appointees to uphold death sentences. Among Democratic appointees, the Carter appointees still active on the Ninth almost never uphold death sentences, whereas quite a few of the Clinton appointees often do.

It may well happen in a few years if Governor Brown doesn't commute all the state's death row inmates as two governors in Illinois have done. One problem, among many, that will further delay executions is that California's protocol provides for the use of sodium thiopental. Since it seems impossible to find a DEA-approved supply of it, California will have to switch over to another drug. To do so, under California law, will involve a lengthy regulation-approval process.

At least the people of California and especially the people of the nation are strongly in favor of the death penalty.

You guys talk about executions like their some kind of a joke. Are you guys really that bloodthirsty? I'm also pro-death penalty but when you're talking about the state executing people, it's a very serious matter.
