    Clemency denied for Telfair Co. killer

    The state's pardons and parole board denied clemency late Wednesday afternoon for John Wayne Conner.

    He's the man sentenced to die Thursday night for a 1982 murder in Telfair County.

    That comes after a hearing in Atlanta today where lawyers argued that he was a victim of childhood sexual abuse and was mentally disabled.

    His execution is scheduled for 7 p.m. at the state prison in Jackson.

    That mental and sexual abuse is becoming the norm in execution appeals and pleas. Now tomorrow his attorney's will argue about crule unusual punishment. Complain about the drugs used in executions. But overall he's finished. I think the Georgia will surpass Texas this year, making it number 1. I think there will probably be two more in Georgia before the end of the year.

    In a 5-2 ruling the Georgia Supreme Court denied a request for a stay of execution. The 11th Circuit and SCOTUS usually follows. This one is over his lawyers will file late appeals to hold up his execution.

    The Latest: Lawyers File Federal Challenge to Execution

    The Latest on the scheduled execution of Georgia death row inmate John Conner (all times local):

    1 p.m.

    Lawyers for a Georgia inmate scheduled to die have filed a challenge in federal court saying his execution would be unconstitutional.

    Lawyers for John Wayne Conner argued in their challenge Thursday that executing him after he's spent 34 years on death row would be unconstitutional cruel and unusual punishment and would amount to double jeopardy.

    Conner is scheduled to be put to death Thursday evening by injection of the barbiturate pentobarbital at the state prison in Jackson.

    He was convicted of fatally beating his friend J.T. White during an argument after a night of drinking and smoking marijuana in January 1982.

    He made similar arguments, as well as others, in a state court challenge that was rejected. The Georgia Supreme Court declined to overturn that ruling, and Conner's attorneys have appealed to the U.S. Supreme Court.

    Killer waits on Ga. death row as slated execution hour passes

    JACKSON — Death row inmate John Wayne Conner continues to wait for word from the federal courts about whether he’ll be executed tonight by lethal injection for the 1982 murder of J.T. White during a drunken fight over Conner’s girlfriend.

    His lethal injection was scheduled for 7 p.m., but Georgia does not proceed with any execution until there are no more “legal impediments,” or appeals pending.

    Conner ate his last meal of fried fish, hush puppies and two deluxe hamburgers after spending several hours earlier in the day with three relatives, three friends, two members of the clergy and four from his legal team. At 3 p.m. he was given a physical and then his wait began.

    On Wednesday the State Board of Pardons and Paroles denied Conner’s plea for clemency, and this morning the Georgia Supreme Court rejected his appeal of his death sentence.

    If the execution is carried out as planned, it will come 34 years to the day that Conner was convicted in Telfair County, and it will make him the sixth murderer Georgia has put to death this year — a record for the four decades the current death penalty law has been in place.

    Conner, then 25, and White, 29, had spent the evening of Jan. 9, 1982, at a party but wanted to keep drinking once they returned to Conner’s house in Milan.

    They walked to a neighbor’s house in search of a ride to the liquor store, but the neighbor refused.

    Walking back to Conner’s house, the two got into a fight because White said he wanted to have sex with Conner’s girlfriend, Beverly Bates. Conner beat White with a quart bottle and an oak tree branch.

    Conner quickly went home to get Bates so they could leave town. Planning to go to Gainesville, Conner and Bates stopped at the ditch where he had left White just to make sure he was dead. Conner beat him with a tree limb and then stabbed him with a stick.

    Conner and Bates were arrested the next day in Butts County.

    Conner’s lawyers told the Parole Board on Wednesday and wrote in appeals to the court that Conner had learned to be violent from his father. Based on that they asked for mercy, arguing that evidence about his upbringing was not presented to the jury that sentenced him to death. They said Conner grew up in a household where there were stabbings, shootings, alcohol and drug use, and some sexual abuse. In the years since, they said, he has done well in prison and is reformed.

    District Attorney Timothy Vaughn, the head prosecutor in Telfair County, reminded the board, however, that Conner had killed three people in 10 years, though he was sentenced to die for only one of them. At 15, Conner was convicted of manslaughter for fatally shooting another teenager, Randy Smith. Conner also was convicted of murdering another friend just months before he killed White; he was sentenced to life in prison for killing Jesse Smyth.
