    Michael Wayne Norris - Texas




    Facts of the Crime:

    Norris was convicted for the November 12, 1986 shooting deaths of Georgia Rollins, 38, and her two-year-old son, Keith Emmanuel Rollins. The child was shot twice in the head, once in the chest and once in the leg. Rollins was shot in the chest and face. Rollins had been trying to break off a relationship with Norris, then 28, who had suspected her of seeing other men.

    Norris had been paroled from the Texas Department of Corrections in May 1986 after serving 15 months of an eight-year sentence for murdering Hubert Huey Ardis, Jr. during a squabble over a traffic collision.

    Norris was sentenced to death in Harris County in June 1987.

    In today's Texas Court of Criminal Appeals orders, Norris' application for writ of habeas corpus was DENIED.

    On December 14, 2012, Norris filed a habeas petition in Federal District Court.

    I don't agree with the district court on this one. His 'emotional state' at the time of his crime is irrelevant, seeing that all murders are heinous and violent at the time of offense. As for the mitigating evidence, it's extremely weak. Relief shouldn't have been granted here.

    On April 15, 2015, the State of Texas filed an appeal before the US Court of Appeals for the Fifth Circuit.

    State briefs: Inmate on death row nearly 30 years wins federal appeal

    HOUSTON — A federal appeals court has upheld a lower court ruling that cleared the way for a new punishment hearing for a Harris County man on death row for fatally shooting his ex-girlfriend and her 2-year-old son nearly 30 years ago in Houston.

    The 5th U.S. Circuit Court of Appeals says jurors deliberating punishment for Michael Wayne Norris didn’t have the proper instructions to consider evidence from his attorneys that showed Norris’ good character traits.

    Norris, now 58, was convicted in 1987 of the fatal shootings of 38-year-old Georgia Rollins and her son, Keith, at their Houston apartment. Norris at the time already was a convicted murderer on parole.

    A federal district judge last year ruled in favor of Norris’ appeal. The state appealed that ruling to the 5th Circuit.
