    Summary of Offense:

    On July 8, 2002, in Dallas, Edwards and a co-defendant killed Tommy Walker, 34, and Mickell Goodwin, 26, during a restaurant robbery.

    Edwards was sentenced to death in Dallas County in December 2003.

    Co-defendant Kirk Edwards (TDCJ number 01209322) was sentenced to 25 years in prison.

    A man arrested and questioned Monday following a fatal shooting at a Dallas County sandwich shop is a former employee of the store, police said. The Balch Springs Police Department said that 28 year-old Terry Darnell Edwards is one of two suspects in the midmorning robbery that left two workers dead. According to police, robbers shot to death the 34-year-old manager of the Subway store, Tommy Walker, and his employee, Mekell Goodwin, 26, both of Dallas.

    Police said both victims were parents. Walker reportedly had six children and Goodwin two young children.

    Second suspect surrenders in sandwich shop killings

    BALCH SPRINGS (AP) — The second suspect in the shooting deaths of two Subway sandwich shop workers turned himself in to authorities Tuesday morning after his mother helped him negotiate with police.

    Kirk Darnell Edwards, 32, surrendered the day after his cousin Terry Darnell Edwards, a 28-year-old former employee at the shop, was arrested after allegedly disposing of a gun in a trash bin near the restaurant.

    Arrest warrants for the men alleged two counts of capital murder.

    Two men entered the sandwich shop Monday as it was opening, shot and killed the manager, Tommy Walker, 34, and an employee, Mickell Goodwin, a 26-year-old mother of two.

    Both Dallas residents were shot in the upper torso, and the men fled with about $3,000, Balch Springs Police Chief Ed Morris said. He said police found three spent cartridges.

    Kirk Edwards turned himself in to the Dallas Police Department about 11 a.m. Tuesday.

    "I believe that his mother was very instrumental in having him turn himself in," Morris said.

    Terry Edwards, an ex-convict, was fired from the Subway about a month ago. He was arrested after he was seen dumping a gun into a trash bin next to a cafeteria across the street from the sandwich shop in suburban Balch Springs. Lancaster is 25 miles east of Balch Springs, a southeast Dallas suburb.

    Police said they found a .380-caliber hand gun in the trash bin.

    Morris said he didn't know why Terry Edwards was fired but said the motive for the killings appeared to be robbery.

    Terry Edwards was jailed on two probable cause capital murder arrest warrants. His bond was set at $1 million on each count.

    HOUSTON – A federal appeals court on Tuesday denied the appeal of a man facing the death penalty for his role in the 2002 killings of two workers at a Balch Springs sandwich shop.

    Terry Darnell Edwards, 41, was convicted in November 2003 of capital murder in the July 2002 deaths of Subway manager Tommy Walker and store employee Mickell Goodwin. No execution date has been set.

    Edwards had been fired from his job at the Subway less than a month before the killings. He and co-defendant Kirk Edwards – his then-32-year-old cousin – went to the Subway on the morning of July 8, 2002 as it was opening and robbed the store of about $3,000.

    Police were able to arrest him the same day after he was spotted dumping a .38 caliber handgun into a trash bin outside a nearby cafeteria on Lake June Road.

    Edwards – 30 years old at the time and a Lancaster resident – had already served a stretch in state prison before the robbery and murders. He was sentenced in 1997 to concurrent five-year terms for theft and for possession of cocaine with intent to distribute. He was paroled in 1999.

    He had argued that he was denied a fair trial because of the judge gave improper instructions during jury selection. The 5th U.S. Circuit Court of Appeals rejected the argument.

    Defense attorneys said during the trial that Kirk Edwards was the shooter.

    Supreme Court Turns Down North Texas Man On Death Row

    HOUSTON (CBSDFW.COM/AP) — The U.S. Supreme court has refused an appeal from a 42-year-old man sent to death row for the murders of two North Texas sandwich shop workers during robbery 13 years ago.

    The high court, without comment Monday, rejected the appeal from Terry Edwards. He was convicted and condemned in 2003 for the fatal shootings of a Balch Springs Subway store manager and an employee. Killed were 34-year-old Tommy Walker and 26-year-old Mickell Goodwin.

    Evidence showed Edwards had been fired from the store a few weeks before the shootings in July 2002. About $3,000 was taken in the holdup.

    Edwards had argued in earlier unsuccessful appeals that his Dallas County trial judge gave improper instructions to jurors during jury selection, violating his right to an impartial jury.
