    District Attorney considering death penalty in child murder

    The Dougherty District Attorney is considering seeking the death penalty in the murder of her 19 month old Albany child.

    The child's mother and her boyfriend were both indicted for murder by the Grand Jury Wednesday.

    19-month old Janaysia Stevenson was beaten to death March 29th.

    Prosecutors say 28-year old Gregory Evans admitted beating the child at least three times.

    20-year old Chaitia Stevenson was charged with murder for not protecting her child.

    The DA says he may go after the death penalty for Evans but not Stevenson.

    "So that is still a matter to be determined very shortly. Whether we will ultimately seek the death penalty in this case," said Edwards.

    49-year old Glenda Brown, the director of the East Albany daycare center the little girl attended, still faces charges of failing to report the abuse.

    That case will be tried in state court.

    Stevenson and Evans remain in the Dougherty County Jail.

    ALBANY, GA - An Albany man is re-indicted so the District Attorney can now seek the death penalty against him for the murder of a toddler.

    Wednesday, the grand jury indicted 28-year old Gregory Evans on malice and felony murder charges.

    He admitted he beat 19 month old Janaysia Stevenson at least three times in March. She died March 29th. The girl's mother, 20-year old Chaitia Stevenson, is also charged with murder for not protecting her child.

    Albany daycare director pleads guilty

    The director of an East Albany daycare center pled guilty to failure to report abuse charges in the death of a toddler.

    49-year old Glenda Brown was the director of the Springs Little Citizens Learning Academy on Radium Spring Road.

    Investigators say she knew 19-month old Janaysia Stevenson had been beaten by her mother and her boyfriend before her death on March 29th, but failed to notify authorities as required by law.

    Dougherty District Attorney Greg Edwards said "In this instance we feel it was very important to make sure that everyone understood that you must report if you a mandatory reporter. You can save a life, you can change an outcome. We must make sure this is done."

    Brown was given a pre-trial diversion sentence, and must pay a $300 fine. Prosecutors plan to seek the death penalty against Gregory Evans for the toddler's beating death. The mother, Chaitia Stevenson, is also charged with murder for not protecting her child.

    Man faces death penalty trial for baby's death

    ALBANY, GA (WALB) - In a Dougherty County death penalty case, Gregory Evans was re-indicted on murder charges to move toward trial.

    Gregory Evans was indicted on ten charges including murder, in the beating death of 19 month old Janaysia Stevenson in March 2011.

    Prosecutors say the child was beaten so viciously, her liver, kidneys, and intestines were hemorrhaged, killing her.

    Because of the cruelty, prosecutors are seeking the death penalty.

    "Beaten brutally by the defendant. And that is what is included in the current indictment. The aggravating circumstance, and we will be pursuing this as a death penalty case," said D. A. Greg Edwards.

    Now moving toward trial, prosecutors re-indicted Evans to assure he was indicted by a grand jury with a constitutionally mandated diverse makeup.

    Prosecutors seek death penalty in child murder case

    ALBANY, GA (WALB) - Prosecutors again filed written notice Friday to seek the death penalty against Gregory Evans, for the 2011 murder of a 19-month-old child.

    Under a new indictment filed with a grand jury with a proper diverse makeup, prosecutors again are seeking the death penalty.

    Evans is charged with viciously beating 19-month-old Janaysia Stevenson to death in March 2011. Investigators said the child died from a lacerated kidneys, liver, and intestines suffered in a prolonged beating.

    Evans will be arraigned formally again on September 10th.

    At a death penalty hearing for an Albany man charged with killing a toddler, defense lawyers questioned the constitutionality of the make-up of the grand jury that indicted him.

    Gregory Evans is charged with murdering 19-month-old Janaysia Stevenson in March 2011. He was re-indicted on 10 charges. Including murder, in February 2015.

    Prosecutors got that 2nd indictment to make sure the grand jury was diverse enough, but the District Attorney says defense attorneys Monday still argued its constitutionality.

    Prosecutors hope the death penalty trial can be held next year. "We are trying to schedule all of the hearings that are related to pre-trial motions so that we can get them done by the end of this calendar year," said Greg Edwards. Dougherty D. A.

    The next pre-trial hearing in the death penalty murder charge is September 12th.

    Capital crime defendants appear in Dougherty Co. court

    DOUGHERTY CO., GA (WALB) - On Thursday, three defendants went before Dougherty County Superior Court Judge Denise Marshall, each one charged with a capital crime.

    "These are matters that we believe is appropriate for a jury to determine the appropriate punishment," explained District Attorney Greg Edwards.

    The hearing is part of the early stages in what is a long process for two of the men who are charged with crimes that happened in the last year.

    But for the third man, who has been behind bars for seven years, his trial date is expected sooner.

    Arelious Haynes, Shanorris Taylor and Gregory Evans have been indicted by a grand jury on aggravated statutory circumstances.

    Prosecutors are calling the murders in court "vile, horrible and inhumane."

    Haynes is charged with murdering two women in 2017
    . The indictment reveals two children under the age of 10 saw the crime committed.

    Taylor is charged with murdering a mentally disabled person
    , Javis Walker, who tried to stop a robbery at an East Albany Dollar General.

    And Evans' case dates back to 2011. He is charged with the murder of a 19-month-old child.

    "First a jury determines whether or not an individual is guilty or not guilty, then the jury determines the punishment," explained Edwards.

    Haynes, Taylor and Evans are only three of seven people in Dougherty County the state is seeking the death penalty for. It's a small percentage of cases in relation to the number of homicides Dougherty county has seen in the last few years.

    "Every homicide is not a death penalty case," said Edwards.

    Capital punishment can take longer to prosecute.

    Evans has been locked up since 2011 with more than 100 motions filed since then. He's an example of how slowly the wheels of justice turn in a death penalty trial.

    "The process that's outlined requires the court take steps to make sure every potential issue and right of the defendant is recognized and addressed by the pre-trial motions so everything that can be considered is considered before we get to the trial," explained Edwards.

    The men did not speak much in court on Thursday other than claiming their rights to remain silent.

    Haynes did show emotion and could be seen wiping his face when the prosecutors read him his charges.

    Edwards is leading the cases for the murder trials. He is being assisted by other attorneys within his office.

    Georgia Capital Defender Gerald Word is representing the defense, along with another capital defender in the state's office.

    Man enters guilty plea in 2011 baby death

    ALBANY, Ga. (WALB) - A man charged in the 2011 beating death of a 19-month-old baby pleaded guilty Thursday morning.

    Gregory Evans, 37, pleaded guilty to nine counts in connection to the death of Janaysia Stevenson.

    Judge Denise Marshall sentenced Evans to the following:

    • Count 1, malice murder: Life in prison without the possibility of parole.
    • Count 2, felony murder: This count was vacated.
    • Counts 3-6, aggravated battery: Merged into Count 1.
    • Counts 7 and 9, battery and Count 8, cruelty to children in the third degree: 12 months to serve and runs concurrently with Count 1.

    The sentencing was negotiated with Evans’ counsel. Evan gave up his opportunity to be tried by a jury.

    Evans entered his plea in front of his family and Stevenson’s father and grandmother.

    Family statements:

    Evelyn Hunt, Stevenson’s grandmother, said the baby used to cry every time she saw Evans. Hunt said she wanted Evans to get life without parole but not the death penalty.

    Kaywee Hunt, Stevenson’s father, said the last time he spoke to Evans, he told him about jobs. Kaywee Hunt cried on the stand and said behind his back, Evans was beating his child.

    Stevenson’s father said he has not been able to think positive since his daughter’s death. He said when he saw Stevenson at the hospital on her death bed, he saw a big boot print on her chest.

    Kaywee Hunt said he did not agree with Evans’ sentencing and wanted him to be given the death penalty.

    Case background:

    Stevenson died on March 28, 2011.

    The indictment stated Evans caused Stevenson’s death by striking her with a closed hand to her chest, sides, back and abdominal area, which caused fatal blunt force trauma.

    The indictment also stated aggravated battery was committed as Evans rendered certain parts of Stevenson’s body, including liver, kidneys and large intestine, useless.

    Evans was originally indicted on 10 charges.

    This case was originally a death penalty case.
