Does that mean he cannot past that deadline? Is he out of options and will this X go forward?

Juniper is not out of appeals. He hasn't entered into the federal appeals process. I called the federal district clerk of court after I saw the Supreme Court had denied. No one had heard anything.

Judge stays execution of Norfolk man in slaying of four

A federal judge stayed tonight’s scheduled execution of Anthony Juniper, a Norfolk man convicted of killing four people in 2004.

After being denied a stay by the U.S. Supreme Court on Wednesday, lawyers for Anthony Juniper went to a federal judge in Richmond and requested a stay. The judge issued a 90-day stay later that day.

Juniper was convicted in Norfolk of killing his ex-girlfriend, her two children and her brother.

Attorneys for Anthony Juniper are challenging a September Virginia Supreme Court ruling dismissing his claims of ineffective counsel. The Attorney General's Office did not oppose Juniper's request to block tonight’s execution so he can begin his federal appeals — the usual next step — but it does oppose his request for a new hearing

Judge rejects appeal by Va. death row inmate convicted of killing 4 in Norfolk

A federal judge has rejected an appeal by a Virginia death row inmate convicted of killing four people in Norfolk.

Anthony Juniper was sentenced to death for the 2004 murders of ex-girlfriend Keisha Stevens, her two children and her brother, Ruben Harrison III.

U.S. District Judge John Gibney in Richmond said Friday that prosecutors likely withheld evidence favorable to Juniper. However, he said the suppressed statements of certain witnesses would not have overcome DNA test results and other evidence pointing to Juniper's guilt.

Gibney also rejected Juniper's claims that he was denied effective representation at trial.

The 41-year-old Juniper came within one day of being executed in 2011. Gibney stayed the execution to allow him to pursue federal appeals.

On June 24, 2013, Juniper filed an appeal in the US Fourth Circuit Court of Appeals over the denial of his habeas petition in Federal District Court.

ANTHONY BERNARD JUNIPER v KEITH W. DAVIS, Warden,
    Sussex I State Prison

Norfolk death-row inmate gets small victory in appeal

The Fourth U.S. Circuit Court of Appeals has granted a small victory to death row inmate Anthony Bernard Juniper.

A federal judge in March denied Juniper’s claim of ineffective representation, made in a federal habeas petition. In the appeals court ruling on Tuesday, judges said Juniper is entitled to appointment of a new lawyer to review that claim.

Juniper was convicted of four counts of capital murder in the 2004 deaths of his ex-girlfriend Keisha Stevens, her two children Nykia and Shearyia Stevens, and her brother, Ruben Harrison.

Juniper was granted a stay of execution in 2011.

Hopefully, Morva, Porter and Prieto already have different counsel for their federal habeas claims.
