    Couple indicted on capital murder charges in 4-year-old's death; death penalty an option

    A Hardin County grand jury has indicted a Kountze couple on capital murder charges in connection with the death of a 4-year-old girl.

    District Attorney David Sheffield confirmed Tuesday the charges have been brought against Amanda Nichole Guidry, 30, and Jason Wade Delacerda, 34.

    Sheffield said his office will be seeking the death penalty against Delacerda and that the option still is open on Guidry.

    According to the Texas Penal Code, killing a child under 6 years old is considered capital murder.

    Guidry's daughter, Breonna Nichole Loftin, died Aug. 17 at a Beaumont hospital, where an examination documented burn marks, bruises and signs of apparent sexual abuse. The actual cause of death was blunt force trauma.

    Both Guidry and Delacerda are being held at the Hardin County Jail without bond, Sheffield said.

    Kountze man accused of capital murder will go to trial in July

    A court date has been set for a Kountze man charged with capital murder in the death of his girlfriend's 4-year-old daughter.

    Jason Wade Delacerda, 35, made a hearing appearance Wednesday in Hardin County's 356th District Court. Delacerda's attorneys requested a court date that would give them ample time to gather evidence and build their case. Judge Steve Thomas set a court date of July 27.

    Delacerda and his girlfriend, Amanda Nichole Guidry, 30, were both indicted for capital murder in August in connection with the death of Guidry's daughter, Breonna Nichole Loftin.

    According to police reports, Loftin died Aug. 17, 2011 at a Beaumont hospital. A medical examination of Breonna revealed she suffered burn marks, bruises and sexual abuse. According to her autopsy, Breonna died from blunt force trauma.

    District Attorney David Sheffield said his office will be seeking the death penalty against Delacerda and that the option remaines open in Guidry's case.

    Both Delacerda and Guidry remain in the Hardin County jail. Bond was denied in both cases.

    The state plans to seek the death penalty. The Hardin County criminal deputy clerk did not know the rescheduled trial date.

    Amanda Nichole Guidry, the child's mother, is set for trial on the same charge later in the spring.

    Loftin died Aug. 17 at a local hospital, where emergency room staff noted bruises, burn marks, broken ribs and other signs of physical and sexual abuse on her body.

    Witnesses said the child was spanked, kicked, thrown across a room and forced to stand barefoot on water bottle caps, according to previous Enterprise coverage.

    Case of 4-year-old's death stuck in limbo

    In 2011, Hardin County Sheriff Ed Cain said Breonna Nicole Loftin's injuries were the worst he'd even seen.

    The 4-year-old had broken ribs, an old fracture on her left leg, bruises and burn marks. Witnesses told police they had seen the girl beaten, thrown around and forced to stand barefoot on water bottle caps.

    The little girl's mother, Amanda Nichole Guidry, and the mother's boyfriend, Jason Shane Delacerda, were arrested and charged with capital murder.

    Two years later, the trial date has been reset at least three times. A new law that took effect Sept. 1 requiring all available evidence to be tested for DNA could delay a trial indefinitely.

    Hardin County District Attorney David Sheffield is seeking the death penalty against the pair because Loftin was under the age of 6.

    The case was scheduled to be tried in November, but more than 30 pieces of evidence in the case will have to be tested and tested again, he said.

    Senate Bill 1292, passed by the state Legislature this year, makes it mandatory for all evidence containing DNA collected in a criminal investigation to be tested before a capital murder case goes to trial. Prosecutors must meet with the defendant and "agree on which biological materials constitute biological evidence," the law reads.

    The bill was sponsored by Sen. Rodney Ellis, D-Houston, and had the support of Texas Attorney Greg Abbott.

    In a statement on the attorney general's website, Ellis argued that though Texas has the right to seek the death penalty against defendants accused of murder, the process needs more safeguards. The bill, he said, is one of those safeguards.

    "To be certain that only guilty murderers are executed, all evidence that can be tested for DNA should be tested for DNA - before the case goes to trial," Ellis said. "This will prevent endless appeals that game the system and delay justice for the families of victims."

    Some attorneys are concerned about the new law's unintended consequences, including a potential drop in the number of death-penalty cases prosecutors pursue and a delay in the handling of non-capital cases.

    Kountze woman charged in toddler's death freed on bond

    A Kountze woman accused of killing her 4-year-old child in 2011 was released from the Hardin County jail Tuesday after her attorney filed a motion to set bond, according to District Attorney David Sheffield.

    Amanda Nicole Guidry, 33, and her boyfriend, 37-year-old Jason Wade Delacerda, were arrested Aug. 17, 2011, after Guidry's daughter, Breonna Nichole Loftin, was hospitalized and later died from blunt force trauma to her head.

    The pair was indicted by a Hardin County grand jury later that month on an elevated charge of capital murder of a child younger than 6. A judge ordered the couple held on no bond.

    Guidry's attorney, Jimmy Hamm, recently filed a motion to set bond. Judge Earl Stover', of the 88th District Court, ruled in favor of the motion last Friday and set Guidry's bond at $250,000.

    Sheffield said his office is seeking the death penalty for Delacerda, who remains in jail on no bond.

    The district attorney will ask a jury to sentence Guidry to life in prison without parole.

    A Christus St. Elizabeth emergency room physician told the responding officer Loftin had numerous injuries, including a bruise on her forehead and an abrasion to her temple, and it appeared she had been seriously abused, according to a probable cause affidavit.

    Jason Delacerda, who has been jailed in Hardin County for five years, will not be eligible to be released on bond before his capital murder trial in June, the Ninth Court of Appeals has ruled.

    Delacerda, 39, and 35-year-old Amanda Nichole Guidry, his girlfriend at the time, were indicted in August 2011 in connection with the death of Guidry's 4-year-old daughter Breonna Nichole Loftin. Both were denied bond.

    Hardin County District Attorney David Sheffield said he will seek the death penalty in Delacerda's case.

    According to previous Enterprise reporting, Loftin had broken ribs, an old fracture on her left leg, bruises and burn marks. Witnesses told police they had seen the girl beaten, thrown around and forced to stand barefoot on water bottle caps the night she was killed.

    Ryan W. Gertz, who was appointed to Delacerda's case two years ago, said he is surprised the county is seeking the death penalty, considering how costly it is.

    A Kountze man charged with capital murder in a 4-year-old girl's 2011 killing will go to trial early next year and could face the death penalty if convicted, Hardin County's District Attorney said.

    David Sheffield said jury selection in 40-year-old Jason Wade Delacerda's capital murder trial is scheduled to begin on Jan. 9.

    Sheffield is seeking the death penalty for Delacerda, who was indicted in 2011 along with his then-girlfriend Amanda Nichole Guidry, 36, in connection with her daughter's death.

    Breonna Nichole Loftin, 4, died at a Beaumont hospital on Aug. 17, 2011. According to previous Enterprise reporting, Breonna's cause of death was blunt force trauma.

    Hospital staff told Hardin County investigators the girl had burn marks, bruises and signs of sexual abuse, a sheriff's investigator wrote in a 2011 arrest affidavit for Guidry and Delacerda.

    According to that affidavit, witnesses told authorities that Breonna was forced to stand barefoot on water bottle caps as a punishment after she had been kicked and spanked.

    Guidry, the girl's mother, was released from jail in December 2014 on a reduced $250,000 bond. Her original bond was set at $1.5 million.

    Sheffield said he plans to prosecute Guidry next year but is not seeking the death penalty. She faces life in prison if convicted.

    Delacerda remains in the Hardin County jail and has been denied bond.

    Delacerda's case, the county's oldest capital murder case, has been scheduled for trial several times since his 2011 indictment, but delays have led to multiple postponements, Sheffield said. Most recently, Tropical Storm Harvey prevented an October trial date.

    "When the death penalty is being sought, we do everything to ensure that it is ready to be prosecuted," Sheffield said, addressing the trial delays. "We're intent on getting the most justice possible."

    Ryan Gertz, one of Delacerda's attorneys, said the defense is ready for the trial to proceed.

    He described the trial as a "who done it," saying a jury will have to decide which defendant – his client or Guidry – is responsible for Breonna's death.

    "This trial is asks how did the child die?" said Gertz, whose co-counsel for the trial is James Makin. "Not how were they treated before they died but how did they die ... I expect there will be some name calling and finger pointing."

    Gertz estimated jury selection could take up to four weeks. He suspects the actual trial will take two weeks.

    "The logistics in this case are both exceedingly complicated and relatively straight forward," Gertz said.

    Hardin County has three pending capital murder cases - Delacerda, Guidry and another - that Sheffield said he believes will be settled in 2018.

    The other case is against Donny Dominique Ratcliff, who was arrested in February of 2015 in connection with the death of his 9-month-old son, Donatello. An autopsy showed that the boy's cause of death was asphyxia, possibly manual strangulation or smothering.
